Williams, Director of Human Resources RE: An Ordinance Approving a Total Loss to Police Unit#2082 in the Amount of$8,153.96 Nature of the request: On December 13, 2023, unit #2082 was being driven by Officer Brandon Lavin was traveling north in the parking lot when he collided with a pole base. The lack of the actual pole prevented the officer from seeing the point of reference to navigate the turn. The obstruction was approximately two (2) feet tall. Staff Analysis, Considerations: The City has Physical Damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool (TMLIRP) with a $2,500.00 deductible. TMLIRP has offered the City a settlement of$8,153.96, less the $2,500.00 deductible, making the final settlement offer $5,653.96 (Exhibit"A" attached). TMLIRP has deemed the unit to be a total loss. Recommendation: I recommend approval of Proposed Ordinance No. 7236 authorizing the property damage settlement against TMLIRP for damage sustained to Police Vehicle #2082 (2016 Chevy Tahoe). TMLIRP has offered to settle the claim for $8,153.96, less the $2,500.00 deductible, making the final settlement offer $5,653.96. This is considered a fair and reasonable settlement. Bucket Considerations: The funds received will be deposited in the general fund insurance proceeds account, HINGF. "Remember we are here to serve the Citizens of Port Arthur." P.O. AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE SETTLEMENT OF AN AUTOMOBILE PHYSICAL DAMAGE CLAIM IN THE AMOUNT OF $8,153.96 MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TMLIRP) AS A RESULT OF THE PROPERTY DAMAGE TO POLICE VEHICLE #2082 WHEREAS, on December 13, 2023, a police employee was travelling in the Jefferson City Shopping Center parking lot and attempted to make a turn and struck a concrete light pole base; and, WHEREAS, as a result of the damage, a claim was filed with the Texas Municipal League Intergovernmental Risk Pool (TMLIRP); and, WHEREAS, it has been determined that damages sustained by Police Vehicle #2082 were in excess of the fair market value of the vehicle; and, WHEREAS, TMLIRP has offered to settle the claim for $8,153.96, less the Automobile Physical Damage deductible amount of $2,500.00, making the final settlement $5,653.96, which is considered a fair and reasonable settlement. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1 . That, the facts and opinion in the preamble of this Ordinance are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount of $8,153.96, less the Automobile Physical Damage deductible amount of $2,500.00, making the final settlement $5,653.96, for the claim against TMLIRP in substantially the same form as delineated in Exhibit "A", in exchange for transfer of title of Vehicle #2082 to TMLIRP. Section 3. That, a copy of this Ordinance be spread upon the minutes of the City Council. P.O.
