of the Woodworth Boulevard Streetscape Improvements Project from Lakeshore Drive to State
Highway 87(Gulfway Drive).Funding is available from Capital Account No.307-21-053-8517-
00-10-000. Project No. ST4014-ENG.
Introduction:
The intent of this agenda item is to seek the Port Arthur City Council's approval for the City Manager or his designee to
execute an amendment to the professional services agreement with Arceneaux, Wilson & Cole, LLC, of Port Arthur,
Texas, increasing the original contract amount by $448,493.00 for the construction management services of the
Woodworth Streetscape Improvements Project from Lakeshore Drive to State Highway 87 (Gulfway Drive) to a new
contract amount of$831,903.00. Project No. ST4014-ENG.
Background:
Woodworth Boulevard has been nominated for roadway and drainage improvements and beautification for its primary
entryway from Memorial Boulevard into downtown Port Arthur. Pursuant to Resolution No. 21-542, approved by the
Port Arthur City Council on December 20,2021,$3,000,000.00 was allocated for the engineering,design and construction
associated with improvements to Woodworth Boulevard from Lakeshore Drive to State Highway 87(Gulfway Drive).
Pursuant to Resolution 22-284,approved by the City Council on June 21,2022,the City Manager was authorized to enter
into an agreement with Arceneaux, Wilson & Cole, LLC (AWC) of Port Arthur, Texas, to provide professional
engineering services associated with the reconstruction of Woodworth Boulevard from Lakeshore Drive to Gulfway Drive
(Highway 87)for$383,410.00. Subsequentially, AWC provided construction budgets and renderings of the Woodworth
Boulevard Project, and it was determined that the original $3,000,000.00 allocated under Resolution No. 21- 542 would
only be sufficient to repair and rehabilitate the project successfully from Lakeshore Drive to 7fh Street. Resolution No.
23-149,approved by City Council,requested that the City Manager amend Resolution No. 21-542 to reflect the addition
of$4,200,000.00 to the Woodworth Boulevard Streetscapes Improvements Project for the total budgeted project amount
of$7,200,000.00.
The current funding allocation was still not sufficient to cover the total bid cost of the project, creating a deficit of
$6,700,000.00. Resolution No. 23-149 needed to be amended to reflect the addition of$7,000,000.00 to the Woodworth

Boulevard Project for the total budgeted amount of$14,200,000.00 contingent upon a budget amendment to allocate
funding. Pursuant to Ordinance No. 24-05, approved by City Council, $14,200.000.00 was allocated for the project to
the Capital Fund.
Pursuant to Resolution No.22-284, Port Arthur's City Council authorized the City Manager to enter into an engineering
services agreement with Arceneaux, Wilson, & Cole, LLC (AWC) of Port Arthur, Texas, to provide professional
engineering,planning, design services,and drawings for the Woodworth Boulevard Project.
Pursuant to Resolution No. 24-050, Port Arthur's City Council authorized a construction agreement with MK
Constructors, LLC,of Vidor,Texas for the amount of$13,426,347.62.
Pursuant to Resolution No. 24-116, the City Council authorized the City Manager or his designee to negotiate an
amendment to the professional engineering services agreement with AWC for construction management services
associated with the Woodworth Streetscape Improvements Project.
AWC has submitted a proposal for engineering construction phase services for the Woodworth Boulevard Streetscape
Improvements Project,reflecting a price increase of$448,493.00 for the new amended contract amount of$831,903.00.
Budget Impact:
Funds are available in the Street Capital Fund Account No.: 307-21-053-8517-00-10-000. Project No. ST4014-ENG.
Recommendation:
It is recommended that the City of Port Arthur's City Council approve PR No. 23602, authorizing the City Manager or
his designee to amend the professional services agreement with Arceneaux,Wilson&Cole,LLC, of Port Arthur,Texas,
increasing the original contract by$448,493.00 for the construction management services of the Woodworth Streetscape
Improvements Project from Lakeshore Drive to State Highway 87(Gulfway Drive)to a new total contact amount not to
exceed$831,903.00. Project No. ST4014-ENG.

SERVICES ASSOCIATED WITH THE WOODWORTH STREETSCAPE
IMPROVEMENTS PROJECT FROM LAKESHORE DRIVE TO STATE
HIGHWAY 87 (GULFWAY DRIVE), INCREASING THE ORIGINAL
CONTRACT AMOUNT BY $448,493.00 TO A NEW CONTRACT
AMOUNT NOT TO EXCEED $831,903.00. FUNDING IS AVAILABLE

WHEREAS, the approval of the contract amendment with Arceneaux, Wilson &
Cole, LLC, (AWC) of Port Arthur, Texas, is hereby, deemed an appropriate action; now,
therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Council hereby authorizes the City Manager to amend the
professional engineering services agreement with Arceneaux, Wilson & Cole, LLC, (AWC)
of Port Arthur, Texas, in substantially the same form attached as Exhibit "A", for the
construction management of the Woodworth Boulevard Streetscape Improvements
Project, increasing the original contract amount by $448,493.00 to a new contract amount
not to exceed $831,903.00; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the
City Council.

Subject: P.R. No. 23517
Proposed Resolution No. 23517 is requesting the City Council to authorize the City Manager
or his designee to negotiate an Amendment to the Professional Engineering Services
Agreement with Arceneaux Wilson and Cole (AWC) for Construction Phase Management
Services associated with the Woodworth Streetscape Improvements.
Staff is relying upon a Request for Qualifications (RFQ) for Engineering Service for Street&
Drainage Projects (Bid No. P22-013), wherein AWC was selected as one of the engineering
firms pursuant to Resolution 22-087.
Please be aware after review of the RFQ, we are unable to locate any reference to
construction phase management services. The Legal Department recommends that the
City strictly follow the purchasing policy and state law with regard to the selection of a
vendor.

AMENDMENT NO. 1
This Amendment to the Agreement for Professional Services ("Agreement") is made by
and between the City of Port Arthur, Texas, a Texas home-rule municipality located in Jefferson
County,Texas("City"),and Arceneaux Wilson&Cole,LLC("Professional")(individually,each
a"Party"and collectively, "Parties"),acting by and through the Parties'authorized representatives.
City and Professional hereby agree that the Agreement for Professional Services approved
under Resolution No. 22-284 is hereby amended as delineated in the attached exhibits and as
follows:
Article IV
Schedule of Work
4.1 Professional agrees to commence services upon written direction from City and to
complete the tasks set forth in 0-7-0) (591) calendar days, from the issuance of written Notice to
Proceed by City.
Article V
Compensation And Method Of Payment
5.1 City shall pay Professional for the services specifically as set forth in ExhibitA and
in accordance with the Rate Schedule in an amount not to exceed($383,410.00) $831,903.00 for
said services.

Arceneaux Wilson&Cole LLC(AWC)is pleased to submit the following proposal and
for the opportunity to assist you with the engineering construction phase services
for the Woodworth Blvd., Paving and Streetscape Improvements Project. Based on
our understanding of the project, we recommend the following basic scope of
services described below.
BASIC SCOPE OF SERVICES
1) Assist the City in conducting a pre-construction conference.
2) Attend the project Kick-off meeting.
3) Attend construction progress meetings for the project(anticipated
591-day construction schedule).
4) Provide a full-time(40 hours per week)construction inspector for the
project.
5) Assist the City in public meetings as required for the project.
6) Review and approve construction submittals.
7) Review and respond to RFI's.
8) Coordinate utilities with the proposed scope of work.

9) Correct any design errors and or pay discrepancies and adjustments as
necessary.
10) Prepare monthly pay requests for city approval.
11) Prepare change orders and required documentation for City approval. •
12) Prepare project closeout documentation.
13) Provide a"Record of Construction Drawings"based on mark-ups
supplied by the contractor.
14) Provide shape files to update the City's GIS database with the changes
to the drainage system,sanitary sewer,and water system.
SERVICES NOT A PART OF OUR SCOPE OF WORK
Services specifically excluded from our proposed Scope of Services include,
but are not necessarily limited to the following:
1) Construction Staking.
2) Fees for permitting.
3) Traffic studies.
4) Traffic impact analysis.
5) Traffic signal design.
6) Design for trench safety.
7) Quality control and materials testing services during construction.
8) Subsurface utility excavation to locate existing facilities.
9) Title research fees.
10) Environmental Services including but not limited to the following:
a. Environmental site assessments.
b. Threatened and endangered species surveys.
c. Waters of the US.Determination.
d. Wetland Delineation.
e. USACE permitting and/or coordination.
f. Lead paint evaluation and abatement.
g. Preparation and/or application for SW3P permit.

PROFESSIONAL FEE
AWC proposes to perform the engineering services as outlined in the SCOPE OF
BASIC SERVICES. We propose compensation based on a fixed fee of Four Hundred
Forty-Eight Thousand, Four Hundred Ninety-Three Dollars ($448,493.00). We look
