Project No. ST4014-ENG. Introduction: The intent of this agenda item is to seek the Port Arthur City Council's approval for the City Manager or his designee to execute an amendment to the professional services agreement with Arceneaux, Wilson & Cole, LLC, of Port Arthur, Texas, increasing the original contract amount by $448,493.00 for the construction management services of the Woodworth Streetscape Improvements Project from Lakeshore Drive to State Highway 87 (Gulfway Drive) to a new contract amount of$831,903.00. Project No. ST4014-ENG. Background: Woodworth Boulevard has been nominated for roadway and drainage improvements and beautification for its primary entryway from Memorial Boulevard into downtown Port Arthur. Pursuant to Resolution No. 21-542, approved by the Port Arthur City Council on December 20,2021,$3,000,000.00 was allocated for the engineering,design and construction associated with improvements to Woodworth Boulevard from Lakeshore Drive to State Highway 87(Gulfway Drive). Pursuant to Resolution 22-284,approved by the City Council on June 21,2022,the City Manager was authorized to enter into an agreement with Arceneaux, Wilson & Cole, LLC (AWC) of Port Arthur, Texas, to provide professional engineering services associated with the reconstruction of Woodworth Boulevard from Lakeshore Drive to Gulfway Drive (Highway 87)for$383,410.00. Subsequentially, AWC provided construction budgets and renderings of the Woodworth Boulevard Project, and it was determined that the original $3,000,000.00 allocated under Resolution No. 21- 542 would only be sufficient to repair and rehabilitate the project successfully from Lakeshore Drive to 7fh Street. Resolution No. 23-149,approved by City Council,requested that the City Manager amend Resolution No. 21-542 to reflect the addition of$4,200,000.00 to the Woodworth Boulevard Streetscapes Improvements Project for the total budgeted project amount of$7,200,000.00. The current funding allocation was still not sufficient to cover the total bid cost of the project, creating a deficit of $6,700,000.00. Pursuant to Ordinance No. 24-05, approved by City Council, $14,200.000.00 was allocated for the project to the Capital Fund. Pursuant to Resolution No.22-284, Port Arthur's City Council authorized the City Manager to enter into an engineering services agreement with Arceneaux, Wilson, & Cole, LLC (AWC) of Port Arthur, Texas, to provide professional engineering,planning, design services,and drawings for the Woodworth Boulevard Project. Pursuant to Resolution No. 24-050, Port Arthur's City Council authorized a construction agreement with MK Constructors, LLC,of Vidor,Texas for the amount of$13,426,347.62. Pursuant to Resolution No. 24-116, the City Council authorized the City Manager or his designee to negotiate an amendment to the professional engineering services agreement with AWC for construction management services associated with the Woodworth Streetscape Improvements Project. AWC has submitted a proposal for engineering construction phase services for the Woodworth Boulevard Streetscape Improvements Project,reflecting a price increase of$448,493.00 for the new amended contract amount of$831,903.00. Budget Impact: Funds are available in the Street Capital Fund Account No.: 307-21-053-8517-00-10-000. Project No. ST4014-ENG. Recommendation: It is recommended that the City of Port Arthur's City Council approve PR No. 23602, authorizing the City Manager or his designee to amend the professional services agreement with Arceneaux,Wilson&Cole,LLC, of Port Arthur,Texas, increasing the original contract by$448,493.00 for the construction management services of the Woodworth Streetscape Improvements Project from Lakeshore Drive to State Highway 87(Gulfway Drive)to a new total contact amount not to exceed$831,903.00. No. 23517 Proposed Resolution No. 23517 is requesting the City Council to authorize the City Manager or his designee to negotiate an Amendment to the Professional Engineering Services Agreement with Arceneaux Wilson and Cole (AWC) for Construction Phase Management Services associated with the Woodworth Streetscape Improvements. Staff is relying upon a Request for Qualifications (RFQ) for Engineering Service for Street& Drainage Projects (Bid No. P22-013), wherein AWC was selected as one of the engineering firms pursuant to Resolution 22-087. Please be aware after review of the RFQ, we are unable to locate any reference to construction phase management services. The Legal Department recommends that the City strictly follow the purchasing policy and state law with regard to the selection of a vendor.
