within 30 days of receipt of the plat from the director of Planning, together with a
recommendation and in compliance with the applicable requirements of V.T.C.A., Local
Government Code, Sections 212.014 thru 212.016. Such decision shall consist of approval or
denial.
PUBLIC NOTICE:
On Thursday, March 28, 2024, ten (10) notices were mailed to adjacent property owners within a
200 ft. Radius and published in the Port Arthur Newspaper a minimum of fifteen (15) days before
the P & Z public hearing scheduled for April 15, 2024

BACKGROUND:
An application was filed with the Planning and Zoning Commission on or around March 25, 2024,
requesting a zoning map change from High-Density Residential to Heavy Industrial for the purpose of
a laydown yard.

The pre-development meeting was conducted on March 6, 2024. Participants included the
Representatives from the City’s Planning and Zoning Division, Chief Building Official, Sanitarian, Solid
Waste Division, Regulatory Services, Engineering Division, and the Fire Marshal’s Office.
A Representative from Drainage District No. 7 and client representation from SouTex Surveyors were
in attendance.
The developer and/or their representative were provided with information regarding the
development, along with contact information if additional guidance is needed.
Any person or corporation having a proprietary interest in any property may petition the City Council
for a change or amendment to the provisions of this ordinance. The Planning and Zoning Commission
may institute a study and proposal for changes and amendments in the public interest on its own
motion or on request from the City Council.
A Zoning Map Change (Rezoning) is a change or modification to the boundaries of any zoning district
within the Zoning District Map.
ANALYSIS:
Section 203(A) of the Zoning Ordinance provides district regulations for development in said district.
ACCESS:
The project entrance(s) are located on Main Avenue.
PUBLIC NOTICE:
On Wednesday, February 14, 2024, sixteen (16) notices were mailed to adjacent property owners
within a 200 ft. radius and published in the Port Arthur Newspaper a minimum of fifteen (15) days
before the P&Z public hearing scheduled for April 15, 2024.
FISCAL IMPACT/BUDGET IMPLICATIONS:
N/A
RECOMMENDED ACTION:
Per Local Government Code Section 211.007, the Planning and Zoning Commission shall make a
preliminary report and hold a public hearing before submitting a final report to the City Council with
a recommended action.
