Background: The centrifuge building roof has reached the end of its useful life. Mike Barnett Construction, Inc. of Port Neches, Texas provided a quote through the Southeast Texas Purchasing Cooperation administrated by Region 5 Education Service Center (Region 5 ESC) for $46,650.00 to replace the centrifuge building roof with new 24 ga, galvalume PBR Roof Panel. Budget Impact: Funding is available in Account No. 410-40-210-5312-00-00-000, Building Maintenance. Recommendation: It is recommended that the City Council approve PR No. 23725, authorizing the replacement of the centrifuge building roof at the Water Purification Plant as described/outlined above. OF PORT NECHES, TEXAS FOR THE WATER PURIFICATION PLANT CENTRIFUGE BUILDING ROOF REPLACEMENT UNDER THE SOUTHEAST TEXAS COOPERATIVE CONTRACT NO. 20240202, ADMINISTERED BY THE REGION 5 EDUCATION SERVICE CENTER (REGION 5 ESC), WITH A PROJECTED BUDGETARY IMPACT AMOUNT OF $46,650.00. FUNDING IS AVAILABLE IN ACCOUNT NO. 410-40-210-5312-00-00-000, BUILDING MAINTENANCE. WHEREAS,the centrifuge building roof has reached the end of its useful life; and WHEREAS, Mike Barnett Construction, Inc. of Port Neches, Texas provided a quote attached hereto as Exhibit "A", from Southeast Texas Purchasing Cooperation administered by Region 5 Education Service Center(Region 5 ESC),to replace the centrifuge building roof for the projected amount of$46,650.00; and WHEREAS, pursuant to Chapter 271, Subchapter D, of the Texas Local Government Code, a city, by resolution of its governing body, may participate in cooperative purchasing programs established by the State Facilities Commission for the purchase of goods at prices established through purchase contracts of the Commission; and WHEREAS,per Resolution No. 20-019,the City entered into an Interlocal Agreement for cooperative purchasing with Southeast Texas Purchasing Cooperation administered by Education Service Center (Region 5 ESC); and WHEREAS,Mike Barnett Construction, Inc. is a registered vendor on the Region 5 ESC, Southeast Texas Cooperative Purchasing Organization. WITNESSETH: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. This contract shall be for 3 months from the date stated on the Notice to Proceed. The City can terminate this contract at its convenience which includes, but is not limited to, funding not being available in any budget cycle with thirty (30) days written notice. 2. The Contractor will perform work as stated in the Contract Documents. 3. During the term of this Contract, the Contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor, windstorm certification and other services necessary in connection therewith, excepting those supplies specifically not required of Contractor in the Specifications. 4.
