Blackketter, P.E., Director of Public Works SUB]ECT P.R. #15539 - Chg of Scope for Arceneaux & Gates for CWSRF TWDB Projects DATE 28 September 2009 RECOMMENDATION: I recommend that the City Council approve Proposed Resolution No. 15539, revising the scope of the contract with Arceneaux & Gates Consulting Engineers, Inc. to include additional design phase services for the Sanitary Sewer Rehabilitation - CWSRF TWDB Projects, increasing the budget for these services by $56,500 to a total of $421,500. BACKGROUND: In Resolution 09-238, the City entered into a contract with Arceneaux & Gates Consulting Engineers, Inc. (Arceneaux) for the engineering design services for sanitary rehabilitation that are to be funded by a Texas Water Development Board Clean Water State Revolving Fund grant from the American Reinvestment and Recovery Act (ARRA). Because of the very short time frame to prepare plans and specifications, Arceneaux incurred additional expenses involved in preparing the application, bidding the construction projects, coordinating with the TWDB, etc. This additional work is for an amount of $56,500, bringing the contract to a total of $421,500. BUDGETARY/FISCAL EFFECT: Funding is available in Project 426016, 426-1625-532.54-00. EMPLOYEE/STAFF EFFECT: None. WHEREAS, on June 2, 2009, the City Council of the City of Port Arthur ---mot ux a es onsu ing ngmeers o o ur; Texas for professional services related to basic design services in the not-to-exceed amount of $365,000; and, WHEREAS, the Texas Water Development Board has awarded $15,080,000 to the City of Port Arthur for sanitary sewer projects; and, WHEREAS, Arceneaux & Gates Consulting Engineers, Inc. was instrumental in completing the necessary plans and specifications in the short time available; and, WHEREAS, Arceneaux & Gates Consulting Engineers, Inc. incurred additional expenses for application preparation, preparing and bidding the construction projects, coordinating with the TWDB, etc. in the amount of $56,500 (see Exhibit "A'~; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: P.R. No. 15539 Page 2 THAT, the facts and opinions in the preamble are true and correct; and, THAT, revising the scope of services to include the application preparation and preparing and bidding the construction projects, increasing the budget for engineering design and construction phase services by $56,50D to a total of $421,500 (Project 426016, 426-1625-532.54-00,), is herein approved, and the City Manager is authorized to execute said Change of Scope as attached in Exhibit "B"; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
