BACKGROUND Attached is a list of found and/or abandoned bicycles, weed eaters, and lawnmowers that aze currently being stored at Port Arthur Police Department's property and evidence section. Deputy Chief Raymond E. Clazk advised the Purchasing Division and attempts were made to contact the owner (s) of such property, if known; however, the attempts were met with negative results. These items are no longer needed in the prosecution of any cases. BUDGETARY/FISCAL EFFECT None STAFFING EFFECT N/A SUMMARY The Purchasing Division recommends the City Council adopt Proposed Ordinance No. 6042 authorizing the donation of abandoned or unclaimed property, to wit; bicycles, weed eaters, and lawnmowers to Port Cities Rescue Mission of Port Arthur, Texas. PO No. 6042 P.O. No. 6042 09/28/09 DF ORDINANCE NO. AN ORDINANCE AUTHORIZING THE DONATION OF BICYCLES, WEED EATERS, AND LAWNMOWERS TO THE PORT CTTIES RESCUE MISSION OF PORT ARTHUR, TEXAS WHEREAS, the City of Port Arthur has abandoned or unclaimed property, to- wit: Bicycles, Weed Eaters, and Lawnmowers; and WHEREAS, the Police Department has indicated that an attempt to locate the owners, as required by Article 18.17 of the Code of Criminal Procedure, has been made and it has been unsuccessful; and WHEREAS, the Purchasing Manager has indicated the fair mazket value of this property (bicycles, weed eaters, and lawnmowers) aze less than Five Hundred ($500.00) per item and can therefore be donated under Article 18.17 of the Code of Criminal Procedure; and WHEREAS, it has been determined it would be in the best interest of the City to donate the bicycles, weed eaters, and lawnmowers, under the procedures as delineated in Article 18.17 of the Code of Criminal Procedure to Port Cities Rescue Mission of Port Arthur. NOW THEREFORE BE IT ORDAINED BY THE CTTY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That Raymond E. Clazk, Deputy Chief of Police, and Shawna Tubbs, Purchasing Manager, aze hereby authorized, pursuant to Article 18.17 of the Code of Criminal Procedure; to donate the bicycles, weed eaters, and lawnmowers, said property being shown in detail listed on Exhibit "A" attached hereto and made part hereof. Section 2. That all Ordinances in conflict herewith shall be repealed to the extent of the conflict only. Section 3. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council.
