Roberts,EIT, MEng, MBA, CPM, Public Works Director RE: P.R.No. 23756: Authorizing the Repair of the final drive on the D8T lldozer through Mustang Cat of Beaumont,Texas Introduction: This agenda item intends to seek the City Council's authorization to repair the D8T Bulldozer for the Landfill by Mustang Cat of Beaumont, Texas. Backiround: The Texas Commission on Environmental Quality(TCEQ)requires the Landfill to maintain equipment that will work the landfill's face.To remain compliant,a bulldozer shall be working properly on-site at all times to ensure proper operations. The City of Port Arthur's Landfill has two bulldozers assigned to the working area, and the D8T dozer is the primary dozer for this working area. (The secondary bulldozer is operational.) The D8T requires the removal and replacement of the final drive. Mustang Cat of Beaumont, Texas, submitted a quote for $40,283.30 through the Sourcewell Cooperative Purchasing Program. Budget Impact: Funds are available in the Landfill's Equipment Maintenance Account,403-50-320-5318-00-00-000. Recommendation: It is recommended that the City Council approves PR 23756 authorizing the repairs to the D8T bulldozer's final drive by Mustang Cat of Beaumont,Texas, for$40,283.30. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH MUSTANG CAT OF BEAUMONT, TEXAS, FOR THE REPAIR OF THE FINAL DRIVE ON THE D8T BULLDOZER FOR THE LANDFILL THROUGH SOURCEWELL CONTRACT NO. 032119-CAT FOR $40,283.30. FUNDS ARE AVAILABLE IN THE LANDFILL'S EQUIPMENT MAINTENANCE ACCOUNT 403-50-320- 5318-00-00-000. WHEREAS, the City's Landfill requires the employment of a bulldozer to maintain operations and compliance with the Texas Commission on Environmental Quality (TCEQ); and, WHEREAS, equipment number 2342, a Caterpillar(CAT) D8T bulldozer at the Landfill used for major daily operations, requires repair to the final drive and is therefore inoperable. (The secondary bulldozer is operational); and, WHEREAS, Chapter 271, Subchapter D, of the Texas Government Code, allows a city, by resolution of its governing body,to participate in cooperative purchasing programs such as the Sourcewell Cooperative Purchasing Program as an alternative to a formal bid process; and, WHEREAS, per Resolution Number 13-556, the City of Port Arthur is authorized to participate in cooperative purchasing with JCB Sourcewell (formerly National Joint Powers Alliance) Cooperative Purchasing Program; and, WHEREAS, Mustang CAT of Beaumont, Texas, is a part of the Sourcewell Cooperative Purchasing Program under JCB Sourcewell Contract Number 032119-CAT,and submitted a quote to repair the D8T Bulldozer for$40,283.30 as delineated in Exhibit A; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the facts and opinions in the preamble are true and correct; and, PR 23756 06/05/2024 jam Page 2 of 3 THAT,the City Council of the City of Port Arthur hereby authorizes the repair of the D8T bulldozer's final drive by Mustang Cat of Beaumont, Texas, for $40,283.30; and, THAT, funding is available in Landfill's Equipment Maintenance Account 403-50-320- 5318-00-00-000; and, this Resolution be s read u on the Minutes of the City THAT, a copyof the caption oft sp p p Council.
