Background: The existing 12" sanitary sewer on Tremont Street and Pump Station 7 has failed. Upon inspection, it was found to have excessive inflow in the section. The section is approximately 420 feet long. The line carries the sewage from the area bounded by Dowling Road to the West, Tremont to the North, 1st Avenue to the East, and Quinn Street to the South. Its failure was causing backups and issues for this entire area and very high influent flows at the Wastewater Treatment Plant (WWTP). The emergency memo was issued to Global Drilling Inc. of Winne, Texas. The scope included the installation of two manholes, and pipe bursting of the existing 12-inch clay line with 12-inch HDPE pipe. Budget Impact: The total budgetary impact is$147,260.00 and funding is available in Account No. 405-40-000- 8516-00-00-000, Project No. WS0006-CON, contingent upon the approval of a budget Amendment via adoption of proposed ordinance No. 7261. Recommendation: It is recommended that City Council approve Proposed Resolution No. 23829, ratifying the emergency repair as described/outlined above. A RESOLUTION RATIFYING THE CITY MANAGER'S DECISION TO AUTHORIZE THE EMERGENCY REPAIR OF 12" GRAVITY SEWER IN SABINE PASS, FOR THE TOTAL NOT TO EXCEED AMOUNT OF $147,260.00 FROM WATER UTILITIES ACCOUNT NO. 405-40-000- 8516-00-00-000, PROJECT NO. WS0006-CON IS CONTINGENT UPON THE APPROVAL OF A BUDGET AMENDMENT VIA ADOPTION OF PROPOSED ORDINANCE NO. 7261. WHEREAS, the 12-inch sanitary sewer that crosses the marsh between Tremont Street and Pump Station 7 failed causing a serious safety and health concerns and also a state violation; and, WHEREAS,the emergency memo (Exhibit"A")authorized the emergency repair and the project was completed including, two manholes installed, and 420 ft of 12-inch pipe replaced (Exhibit"B"); and, WHEREAS, pursuant to Section 252.022(a)(1) this purchase is authorized because of a public calamity that requires the immediate appropriation of money to relieve the necessity of the municipality's residents or to preserve the property of the municipality; and, WHEREAS, it is authorized pursuant to Section 252.022(a)(3) of the Local Government Code because of the unforeseen damage to public machinery, equipment, or other property. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the facts and opinions in the preamble are true and correct; and, THAT, City Council hereby ratifies the City Manager's decision to authorize the emergency repairs for the total not to exceed amount of$147,260.00 (Invoice and daily report PR No. 23829 6/4/2024 cv Page 2 of 3 attached as Exhibit "B") from Account No. 405-40-000-8516-00-00-000, Project No. WS0006- CON; and, THAT, a copy of the caption of this Resolution shall be spread upon the Minutes of the Meeting of the City Council.
