Introduction: The intent of this agenda item is to seek the City Council's authorization for the City Manager to repair the axles,brakes,and final drives on the 826K Compactor by Mustang Cat of Beaumont,Texas,in the amount of$72,386.99. Background: The City of Port Arthur's Landfill is required by permit to stay in compliance by the Texas Commission on Environmental Quality(TCEQ)on daily operations. The permit requires an operational compactor on site at all times to ensure proper operations and compliance with state regulations. The City of Port Arthur's Landfill maintains one (1) operational compactor assigned to the working area, and the 826K compactor is the back-up compactor for this working area. Budget Impact: Funds are available in Landfill's Equipment Maintenance Account No. 403-50-320-5318-00-00-000. Recommendation: It is recommended that the City of Port Arthur's City Council approve PR 23845 authorizing the City Manager to repair the 826K compactor in the amount of$72,386.99. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH MUSTANG CAT OF BEAUMONT, TEXAS, TO REPAIR THE AXLES, BRAKES AND FINAL DRIVES ON THE 826K COMPACTOR EQUIPMENT NO. 2074 FOR THE LANDFILL THROUGH SOURCEWELL CONTRACT NO. 032119-CAT IN THE NOT TO EXCEED AMOUNT OF $72,386.99. FUNDS ARE AVAILABLE IN THE LANDFILL'S EQUIPMENT MAINTENANCE ACCOUNT NO. 403-50- 320-5318-00-00-000-. WHEREAS, the City of Port Arthur Landfill operates under conditions determined by permit and state regulatory agencies (TCEQ); and, WHEREAS, the 826K Compactor is essential for the Landfill to stay in compliance with regulations; and, WHEREAS, the repairs to the axles, brakes, and final drives are necessary to maintain this machine's operability; and, WHEREAS, the compactor will be used as a back-up to remain compliant with TCEQ regulations; and, WHEREAS, Sourcewell is a cooperative purchasing program for state and local governments; and, WHEREAS, Chapter 271 of the Local Government Code allows a city, by resolution of its governing body, to participate in cooperative purchasing programs as an alternative to a formal bid process; and, WHEREAS, pursuant to Resolution 13-556, the City of Port Arthur is authorized to participate in cooperative purchasing with JCB Sourcewell (formerly National Joint Powers Alliance) Cooperative Purchasing Program; and P.R. No. 23845 07/15/24 jam Page 2 of 3 WHEREAS, Mustang Cat can provide the repairs on the 826K Compactor through Sourcewell contract # 032119-Cat for the amount of $72,386.99; and, WHEREAS, Mustang Cat's quote #90928 is attached as "Exhibit A"; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, funding is available in the Public Works Landfill Equipment Maintenance Account 403-50-320-5318-00-00-000; and, THAT, the City Council of the City of Port Arthur hereby authorizes the City Manager to repair equipment No. 2074, a Caterpillar 826K compactor by Mustang Cat of Beaumont, Texas in the amount of $72,386.99 as exhibited in Exhibit A; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
