Dr. Hutchins is revising the documents in response to the concerns of Council. She will be in attendance at the November 3'a Council Meeting to review the documents. The application for LBE certification is ready for distribution. The application will be posted on the City's website, and publicized on the government channel, through the Chamber of Commerce, and through other available media in order to encourage participation. Upon completion of the certification process, Dr. Hutchins will be able to begin compliance evaluation. UPDATED P. R. NO. 15452 JJA: 09/30/09 RESOLUTION NO. A RESOLUTION AUTHORIZING THE AND COLLECTION OF THE CITY OF APPLICATION FOR CERTIFICATION ARTHUR BUSINESS ENTERPRISE (PABE) DISTRIBUTION PORT ARTHUR AS A PORT WHEREAS, the City of Port Arthur has various industrial district agreements which encourage industry to support the community by purchasing goods and services from `Port Arthur Business Enterprises' (PABE); and WHEREAS, the City Council has engaged Dr. Janis Hutchins to develop a methodology whereby to identify PABE and monitor industry's utilization of them; and WHEREAS, Dr. Hutchins has prepared the application for PABE certification, as revised after Council input September 8, 2009, attached hereto as Exhibit "A". NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1: The facts and opinions in the preamble are true and correct. The purpose of the Port Arthur Business Enterprise Program is to create a program that promotes spending by companies that have industrial district agreements with qualified Port Arthur local business enterprises as to increase the diversity of Port Arthur businesses with which such companies procure goods and services so that the pool of such businesses is representative of the business community at large. Which Port Arthur businesses are elieible to apaly for certification? Any Port Arthur business, including, but not limited to, a Port Arthur minority and/or women owned business enterprise (MWBE), a Port Arthur historically underutilized business (HUB), and a Port Arthur disadvantaged business enterprise (DBE) is eligible to apply far the certification under the procedures and criteria specified in the following section. How does a Port Arthur company earn the certification? • A Port Arthur Business Enterprise must perform a commercially useful function including the performance of the following functions 6y the business: - Being directly responsible for providing the materials, equipment, supplies, or services as required by the contract solicitation; - Performing work that is normal for its business services; - Carrying out its obligations by actually performing, managing, or supervising the work involved; - Maintaining its principal place of business at a fixed, established commercial address (not temporary building, post office box, or telephone answering service, or short-term lease) within the boundaries of the City; - Being afor-profit business; - Having been in operation for at least six months within the City; and - Verifying / Financial viability, / Adequate safety record, / Employees who are drug tested and background checked, and / Compliance with local, state and federal regulations and licensing requirements. • Complete the Application for Certification as a Port Arthur Business Enterprise, which can be found at the Cites website www.aortarthur.net and submit it to the Assistant City Manager. Does certification suarantee that the business automatically is placed on the approved vendors/bidders list of all companies with current Industrial Al3reements? The Port Arthur Business Enterprise certification does not circumvent the pre-qualification process for potential service contractors currently in place at area petrochemical plants. Each company has a unique process that serves its needs.
