GULFWAY DRNE , SW SIDE (4 MILES OF THE 4 WAY STOP IN SABINE PASS) WILL BE USED FOR THE TOWER MENTIONED IN P.R.15531 DATE: 10/16/09 BACKGROUND: The City council is being asked to approve a 5.00 acre section out of Tract 178, of the McGaffey Survey, A-167 for a specific use to construct a radio communication tower for the local Texas Point Wildlife Refuge group. The Planning and Zoning Commission approved this case, on September 21, 2009. A specific use permit (SUP) is required by Ordinance 97-65, of the City Codes even if the zoning is "I" (industrial). Based on the discussion with the applicant as to need and reconstruction of their offices for operations, there was no protest submitted to the Board. Applicant -Dean Bossert, Wildlife Refuge Manager Owner(s) -United States Department of Interior Fish and Wildlife Incorporation BUDGETARY/FISCAL EFFECT: None STAFFING/EMPLOYEE EFFECT: None SUMMARY: The Planning and Zoning Commission recommends approval of this case. AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF PORT ARTHUR BY GRANTING A SPECIFIC USE PERMIT FOR TEXAS POINT NATIONAL WILDLIFE REFUGE TO INSTALL A 100 FOOT RADIO COMMUNICATION TOWER THE FACILITY WILL BE ON 5.00 ACRES, AT 7950 S. GULFWAY DRIVE, OUT OF TRACT 178, JOHN MCGAFFEY SURVEY, A-167, PORT ARTHUR, JEFFERSON, COUNTY, TEXAS; VIOLATION OF THIS ORDINANCE (OR THE ZONING ORDINANCE OF THE CITY OF PORT ARTHUR) IS PUNISHABLE AS PROVIDED IN SECTION 1-13 OF THE CITY ORDINANCES AS AMENDED BY FINE NOT EXCEEDING TWO THOUSAND [$2,000.00] DOLLARS; THE ZONING IS INDUSTRIAL AND WILL REMAIN SO; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER OF THE CITY OF PORT ARTHUR AND EFFECTIVE IMMEDIATELY AFTER THE PUBLICATION DATE. Z09-06 - (SUP 209) TEXAS POINT NATIONAL WILDLIFE REFUGE 100 FT. COMMUNICATION TOWER-RADIO RELAY ON ABOUT 5.00 ACRES WHEREAS, Article XI of the Charter and the Zoning Ordinance, of the City of Port Arthur, Texas, including the Local Government Code, Sections 211.006 and 211.007, having been fulfilled, the City Council shall hold a public hearing on October 20, 2009 at 7:00 p.m.; and WHEREAS, the proposed change has not been protested in accordance with subsection (d) of said Section 211.006 and aze in compliance with Sections 211.010-211; and WHEREAS, having received and considered the recommendation of the Planning and Zoning Commission that the proposed change be approved, the City Council finds that it would be in the P.O. N0.6041 10/16/09 - CWR Page 2 of 4 public interest and general welfare of the City to change the Zoning designation of the hereinafter described property; and WHEREAS, pursuant to subsections (d) and (f) of Section 211.006 Local Government Code, Section 24-105 of the City Zoning Ordinance requires, in order for the proposed change to take effect, the affirmative vote of at least three-fourths of all members of the City Council (i.e., at least seven [7] members) if the proposed change is protested in accordance with said subsection (d). BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: SECTION 1. That the Specific Use Permit -SUP 209 be ganted fora 100 ft communication tower on the following lot: 7950 Gulfway Drive, AKA-Tract 178, John McGaffey Survey, A-167, Sabine Pass, Port Arthur, Jefferson County, Texas (4 miles west of the four way stop in Sabine Pass just south of State Highway 87 on the described tract of land) EXHIBIT "A" Location shown as per case Z09-06- SUP 209 Exhibit "B" FAA Approval & Ordinance 97-65 explaining specific conditions for antennae usage Exhibit "C" The district remains "I" for Industrial. SECTION 2. That the Specific Use Permit shall be issued subject to the following mandatory wnditions: That the owner shall permit co-locators when feasible and the height shall not extend beyond 100 feet. All FAA and FCC approvals shall be obtained prior to operation to ensure no conflict with other operating towers. SECTION 3. That the Building Official and the Director of Planning aze authorized and directed to make all necessary changes to the "Zoning Map, City of Port Arthur, Texas" on file in P.O. NO.6041 10/16/09 - CWR Page 3 of 4 the offices of the Building Official and the Planning and Zoning Commission, so as to reflect on said Map, the changes hereby made in conformity with the legend of said Map. SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a sepazate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions hereof. SECTION 5. All ordinances and parts of ordinances in conflict herewith aze hereby repealed. SECTION 6. Any person, firm or corporation who violates any provision of this Ordinance or the City's Zoning Ordinance shall be guilty of a misdemeanor and shall be punished by a fine not exceeding Two Thousand ($2,000.00) Dollars as provided in General Provision -Section I-13 of the Code of Ordinances, and each day such violation shall be permitted to exist shall constitute a separate offense. SECTION 7. This Ordinance or its caption and penalty shall be published at least one (1) time within ten days after final passage hereof in the official newspaper of the City of Port Arthur. This Ordinance shall take effect immediately after the date of such publication. SECTION 8. Because Section 24-105 of the Zoning Ordinance does not apply, seven (7) votes aze not required to adopt this Ordinance.
