Background: The building roof of the Utilities Service Center office has reached the end of its useful life as the roof leaks when it rains and has resulted in mold growth on the ceiling tiles which poses a serious health concern. Mike Barnett Construction, Inc. of Port Neches, Texas provided a quote through the Southeast Texas Purchasing Cooperation Administrated by Region 5 Education Service Center(Region 5 ESC) for $135,030.00 to remove all old roofing at the Water Utilities Service Center building and replace it with a new 60 mil single ply TPO roofing system. Budget Impact: Budget impact is$135,030.00 and funding is available in Account No. 410-40-215-5312-00-00- 000, Building Maintenance. Recommendation: It is recommended that the City Council approve PR No. 23868, authorizing the replacement of the Utilities Service Center building roof as described/outlined above. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH MIKE BARNETT CONSTRUCTION, INC. OF PORT NECHES, TEXAS FOR THE UTILITIES SERVICE CENTER BUILDING ROOF REPLACEMENT UNDER THE SOUTHEAST TEXAS COOPERATIVE CONTRACT NO 20240202 ADMINISTRATED BY THE REGION 5 EDUCATION SERVICE CENTER (REGION 5 ESC), WITH A PROJECTED BUDGETARY IMPACT AMOUNT OF $135,030.00. FUNDING IS AVAILABLE IN ACCOUNT NO. 410-40-215-5312-00-00-000, BUILDING MAINTENANCE. WHEREAS, the Utilities Service Center building roof has reached the end of its useful life as the roof leaks when it rains and has resulted in mold growth on the ceiling tiles which poses a serious health concern; and, WHEREAS, Mike Barnett Construction, Inc. of Port Neches, Texas provided a Region 5 ESC Cooperative Purchasing Organization quote attached hereto as Exhibit"A" for $135,030.00 to replace the water utilities service center building roof; and, WHEREAS, pursuant to Chapter 271, Subchapter D, of the Texas Local Government Code, a city, by resolution of its governing body, may participate in cooperative purchasing programs established by the State Facilities Commission for the purchase of goods at prices established through purchase contracts of the Commission; and WHEREAS,per Resolution No. 20-019,the City entered into an Interlocal Agreement for cooperative purchasing with Southeast Texas Purchasing Cooperation Administrated by Education Service Center(Region 5 ESC); and, WHEREAS,Mike Barnett Construction, Inc. is a vendor on the Region 5 ESC, Southeast Texas Cooperative Purchasing Organization. Williams, Jr., CPPB Director of Finance Purchasing Manager EXHIBIT "A" CONTRACT FOR ROOF REPLACEMENT THIS AGREEMENT, made this day of , 2024, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY" and Mike Barnett Construction, Inc. of Port Neches, Texas hereinafter called "CONTRACTOR". WITNESSETH: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The CONTRACTOR will commence and complete the Utilities Service Center Roof Replacement. 2. The CONTRACTOR agrees to perform all the Work described in the Contract Documents and comply with the terms therein for the total sum of$135,030.00. 3. The term of this Agreement shall be for three (3) months from the start date on the Notice to Proceed, unless sooner terminated under the provision hereof. The City can terminate this contract at its convenience which includes, but is not limited to, funding not being available in any budget cycle within thirty (30) days written notice. 4. During the term of this Contract, the Contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of Contractor in the Specifications. 5. The CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms in the amounts stated in the bid documents. 6. The term "Contract Documents" means and includes the following: 1) Agreement 2) Scope of Work 3) Bid/Proposals 4) Notice of Award 5) Notice to Proceed 5. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns. 6. IN WITNESS WHEREOF,the parties hereto have executed, or caused to be executed by their duly authorized officials, this Agreement in (2 copies) each of which shall be deemed an original on the date first written above. Repairs We propose to furnish all labor, materials and insurance, to perform the scope of work below, for a sum of $135,030.00. This price includes 10% discount on materials and a 30% additional discount for coop membership. Scope of Work: Roof 1) Remove all old roofing and insulation down to deck. 2) Install new facia, prime and paint. 3) Remove and replace and paint 2"x 10"wood nailer. 4) Install Poly-ISO insulation. 5) Install a 1/8 taper system with ISO insulation taper. 6) Install 1/ Densdeck. 7) All insulation and securock mechanically fastened to deck. 8) Install new 22 ga galvanized cleat. 9) Install a 60miI single ply TPO roofing system. 10)Install new cap flashing. 11)Install new TPO boots on vent stacks. 12)Install 1 new rain collar on heater vent, prime and paint others as needed. 13)Flash around all penetrations and curbs. 14)Install a 60mi1 single ply TPO roofing system. 15)Clean up and haul off all trash. $86,500.00 • Work will be done as a 20 yr system. Manufacturer's Warranty cost not included. This cost can be provided upon request. Misc. Repairs 1. Tuck point around hose bibs, holes and around penetrations. 2. Mortar caulk corner on rear of building. $ 980.00 3. Pressure wash stained area on brick. $ 150.00 4. Wet Glaze all windows, galss to metal and metal to brick. $ 7,600.00 5.
