The Port Arthur Zoning Board of Adjustment & Appeals will meet in regular session at
5:30 p.m., Thursday, October 22, 2009, in the City Council Chambers on the fifth floor of
the City Hall. The October 2°d agenda contains three applications.

I. Roll Call -Chairman, John Clayton convened the meeting.
Commissioners present: Eddie Scaggs, John Clayton, Homie "Hoa" Dinh, Deral Segler, Desiree
Edwards and George Boutte, Jr. (alternate) were present to constitute the necessary quorum.
Staff Members present: Planning Director, Colleen Russell
II. Minutes -July 30, 2009 -Public Hearing
Eddie Scaggs made a motion to accept the minutes of July 30, 2009 as presented; Deral Segler
seconded the motion.
Vote -All Yeas -- motion passed.
III. B09-10 (Public Hearing followed by Motion required)
A. B09-10 - M. Gardner -Lot 6, Block 328, Port Arthur Land Company, A-053400 (2700 18th
Street) Variance for 10-foot deficit in lot width - i.e. lot is currently 50 feet wide
instead of the required 60-foot lot width.
Speaking for: Tynequia Gardner, 2700 18th Street, Port Arthur, TX 77640
Speaking against: None
Mr. Scaggs made a motion to accept the staff recommendation to approve B09-10; Mr. Segler
seconded the motion.
Vote: All Yeas -Motion Passed

Variance for 10-foot deficit in lot width - i.e. lot is currently 50 feet wide instead of the
required 55-foot lot width.

Mr. Boutte made a motion to accept the staff recommendation to approve B09-11; Mr. Scaggs
seconded the motion.

Avenue) Variance for 10-foot deficit in lot width - i.e. lot is currently 40 feet wide
instead of the required 50-foot lot width.

Mr. Segler made a motion to accept the staff recommendation to approve B09-13 under the
condition that the property is re-platted and property lines are established before
construction begins; Mr. Dinh seconded the motion.

Mr. Boutte made a second motion to approve adjustments to be made by the builder for the
construction of the home in regards to placement within property lines to ensure that
fencing remains in place; Ms. Edwards seconded the motion.

BACKGROUND:
The Board of Adjustment is being asked to consider a variance for the following lot(s)/tract(s) in the City of
Port Arthur, Jefferson County, Texas.
VAR/ANCES WILL BE ON THE FOLLOWING LOT:

This site is located north of 10t" Street and east of Wellford Avenue. It is also known as Lots 5 and 6, Block 2, of
the Pekins Addition A-007400 from the Port Arthur Land Company, Port Arthur, TX 77640-4836. The zoning
is Two-Family housing or Duplex in the back. Notices were sent out in compliance with the Texas Local
Government Code Section 211 as well as the publication being done on October 4, 2009 for the October 22na
meeting, more than 15 days prior to the public hearing. A replat may be required prior to a permit being
issued or completed construction.

RECOMMENDATION:
Staff has no objections to this request due to the hardship of the family not being able to live in their home,

The Zoning Board of Adjustment and Appeals is requested to reduce the 10 foot setback on the garage. The
City requests no fencing, shrubbery or trees to cause visibility problems. Hedges shall be 2 feet of less. Other
lots with similar situations that will not meet the Code due to insufficient side setbacks, non-conformance
with the Subdivision/Zoning Ordinances shall be similarly viewed. Nevertheless, a legal request is being made
prior to the redevelopment of the lot with a three bedroom-house having two bathrooms.

Subdivision/Zoning Ordinances shall be similarly viewed. The building inspector shall rule on anything
contrary that is to be constructed that will still meet code. Nevertheless, a legal request is being made prior to
the redevelopment of the lot.
