ORDINANCE NO.
AN ORDINANCE RESCINDING ORDINANCE NO. 24-17 IN ITS
ENTIRETY, RELATING TO THE SALE OF PUBLIC PARK LAND
APPROVED BY THE QUALIFIED VOTERS OF PORT ARTHUR,
LOCATED AT 2201 LAKESHORE DRIVE, COMMONLY KNOWN AS
CIVIC PARK
WHEREAS, on April 23, 2024, the City Council adopted Ordinance No. 24-17,
authorizing the sale of Civic Park, approved by the qualified voters of Port Arthur, to the
prospective buyer, Daniel Carrillo Lozano; and; and
WHEREAS, the sale did not materialize because the buyer failed to close the
transaction, resulting in the termination of the contract; and
WHEREAS, the property will be relisted for sale on a multiple listing service by a
licensed broker.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That Ordinance No. 24-17, in its entirety, is hereby rescinded.
Section 3. That a copy of the caption of this Ordinance shall be spread upon the
Minutes of the City Council.

the contract and before the time Seller provided this notice to Buyer.

Buyer failed to close the transaction on or before May 14th, 2024 as per the Amendment dated
April 29th, 2024
NOTE: This notice is not an election of remedies. Release of the earnest money is governed
by the contract.
