ZONE CHANGE REQUESTZ24-06 (B) Julie Kay Hollingsworth Rhoden Department of Development ServicesDivision of Planning REQUEST… City Council is being asked to consider aSpecificUsePermitforapproximately1.2865acres(56,039.94 SF)of land,Tract 2 of Lots 9 &10,Block 165,City of Port Arthur,JeffersonCounty,Texas The properties are located at 2509 &2545LakeshoreDrive PURPOSE… The purpose of this request is to obtain a SpecificUsePermitfortheoperationofa“ProfessionalOffice”in a Planned Development -9 District (PD-9). The granting of this SUP is contingent upon theapprovalofProposedOrdinanceNo.7262,amendingPlannedDevelopmentDistrict–9 by adding“professional office”as a use type to section 2(A)(3)ofpermitteduses. BACKGROUND… July 11, 2024 –The application for the zoning request was submitted to the Planning Division. August 1, 2024 -notification sent to adjacent property owners within 200 ft. July 24, 2024 –Public Notice published in Port Arthur Newspaper. The Planning and Zoning Commission (P&Z) met in a Regular Session to conduct a public hearing on August 19, 2024, at 5:30 p.m. The Planning Commission voted 3:0 recommending to approvesaid request. On July 30, 2024, -City Council approved Res. No. 23-859, calling for a public hearing. August 10, 2024 -Notification was published in the Port Arthur Newspaper and mailed to adjacent property owners on August 12, 2024. CURRENT ZONING Current Zoning : Planned Development -9 (PD-9) Planned Development District 9 was established to preserve and protect the historic character of the City’s designated historic district. SUP #242 The purpose of Specific Use Permit –240 (SUP #242) is to allow for the operation of a Professional Office, local Building in the City’s Historic District. A Professional Office (local) is an establishment for the conduct of a variety of businesses in an office setting completely enclosed within a structure less than or equal to 20,000 square feet. **Traditional business hours for professional offices: 9 a.m. –5:00 p.m. (40-hour workweek) ZONING DESIGNATION AERIAL VIEW STREET VIEW OF PROPERTY IN QUESTION(LAKESHORE DRIVE) VIEW OF PROPERTIES ADJACENT TO THE SUBJECT PROPERTY AND THE REAR PUBLIC COMMENT… In accordance with Texas Local Government CodeSections211.006 and 211.007,a public hearing wasscheduledonthefollowingdates/times to receive publiccomment: •P&Z Commission: August 19, 2024, at 5:30 p.m. •Written Opposition: 0 •Verbal Opposition: 0 •Letter(s) Returned:0 •City Council: August 23, 2024, at 06:00 p.m. •Written Opposition: 0 •Verbal Opposition: 0 •Letter Returned:0 A City Council may approve or deny the proposed matter by a simple majority vote.In the event,however,that a proposed change to a regulation or boundary is denied by the Planning &Zoning Commission,then the proposed change must be approved by at least three fourths (3/4) of all members of the City Council who are qualified to vote.
