NO. 7277 —A proposed ordinance authorizing the sale and deed for conveyance of a 2.023-acre strip of land part of the Port Arthur Heights Addition Introduction: This agenda item intends to seek the City Council's approval of P.O. NO. 7277 authorizing the sale of a 2.023-acre strip of Land, part of Blocks 26 through 30, Port Arthur Heights Addition (A.K.A. W. 19th Street Ditch), Port Arthur, Jefferson County, Texas, to Motiva Enterprises LLC in the amount of $79,400.00. Background: Motiva Enterprises LLC has expressed interest in acquiring a narrow, unmanned drainage ditch located within the boundaries of their refinery property but currently owned by the City of Port Arthur. The drainage ditch's shape, lack of access to public roads, and its small area render it unusable independently under the current zoning and development ordinances, aligning it with the criteria set forth in Section 272.001(b)(1) of the Texas Local Government Code. This section allows a municipality to sell such a strip of land to an adjacent property owner without undergoing the public bid process. The initial request from Motiva Enterprises was made on or around April 19, 2023. Since then, the matter has been brought before the City Council in executive session on multiple occasions to seek guidance on how to proceed with the sale. After careful consideration, the City Council directed staff to move forward with the necessary documentation, contingent upon the inclusion of a restrictive covenant. This covenant requires that Motiva Enterprises make a reasonable effort to divert stormwater toward "Remember,we are here to serve the Citizens of Port Arthur" P.O. This restriction is based on expert advice from the City's Engineering Consultant, Dr. Hani Tohme, and a written statement from Keestan X. Cole, PE, Vice President of Arceneaux, Wilson & Cole, and the City's Consultant for its Master Drainage Study. Motiva Enterprises has agreed to the restrictive covenant and wishes to proceed with the land purchase. The agreed-upon sale price is $79,400.00, determined through an independent appraisal conducted by Cooks & Associates, Inc. of Beaumont, Texas, in August 2023. Budget Impact: Motiva Enterprises LLC, requester, will pay the city$79,400.00 to the City of Port Arthur based on the determination through an independent appraisal conducted by Cooks & Associates, Inc. of Beaumont, Texas, in August 2023 for the conveyance of the 2.023- acre strip of land. Recommendation: It is recommended that the City Council approve P.O. NO. 7277 authorizing the sale of a 2.023-acre strip of Land, part of Blocks 26 through 30, Port Arthur Heights Addition (A.K.A. AN ORDINANCE AUTHORIZING THE SALE OF A 2.023- ACRE STRIP OF LAND, PART OF BLOCKS 26 THROUGH 30, PORT ARTHUR HEIGHTS ADDITION, PORT ARTHUR, JEFFERSON COUNTY, TEXAS AND FURTHER AUTHORIZE THE CITY MANAGER TO EXECUTE A SPECIAL WARRANTY DEED FOR THE CONVEYANCE WHEREAS, pursuant to Section 272.001(b)(1) of the Texas Local Government Code, a municipality may sell a narrow strip of land to an adjacent property owner due to its shape, lack of access to public roads, or small area cannot be used independently under its current zoning or under applicable subdivision or other development control ordinances; and, WHEREAS, it is deemed in the best interests of the citizens of Port Arthur to sale a 2.023-acre strip of land, part of Blocks 26 through 30, Port Arthur Heights Addition, Port Arthur, Jefferson County, Texas, as delineated in Exhibit "A", to Motiva Enterprises LLC. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1: That the facts and opinions in the preamble are true and correct. Section 2: That the City Council finds that the requirements under Section 272.001(b)(1) of the Texas Local Government Code have been met. Section 3: That the City Manager is authorized to convey, contingent upon closing, the city owned property legally described as a 2.023-acre strip of land, part of Blocks 26 through 30, Port Arthur Heights Addition, Port Arthur, Jefferson County, Texas, and, execute a Special Warranty Deed, in substantially the same form, as attached hereto as Exhibit "B", to Motiva Enterprises LLC in the amount of $79,400.00.
