RE: P.R. 23910—Request to Renew Funds from the Port Arthur Economic
Development Corporation(PAEDC)Pursuant to a Voter Proposition
Introduction:
The intent of this Agenda Item is to request the City Council's approval of P.R. No. 23910
approving the continued use of the City of Port Arthur Type A Economic Development
Corporation sales and use tax funds to be used for enhancements at Adams Park, Rose Hill
Park, and the Recreation and Senior Citizens Center pursuant to 505.152 of the Texas Local
Government Code at a rate of$1,000,000 per year for an additional three (3) year period as
authorized by the voters at the May 1, 2021 election.
Background:
Pursuant to Ordinance No 21-10, a special election was conducted on May 1, 2021, to submit a
proposition regarding the use of Port Arthur Economic Development Corporation sales and use tax
funds for enhancements at Adams Park, Rose Hill Park and the Recreation and Senior Citizens
Center to voters. The Proposition read as follows:
"Shall the City of Port Arthur Type A Economic Development Corporation sales and use tax
funds be used for enhancements at Adams Park, Rose Hill Park, and the Recreation and
Senior Citizens Center pursuant to 505.152 of the Texas Local Government Code at a rate
of$1,000,000 per year for a three-year period with an option to renew for up to an additional
three(3)year period in the amount of$1,000,000 per year authorization if approved by a 2/3
vote of the City Council."
An ordinance canvassing the returns and declaring the results of the special election, pursuant to
Ordinance No 21-34, shows that the proposition was approved by the qualified voters of Port Arthur.
As mentioned in the proposition, there is an option to renew for up to an additional three (3) year
period in the amount of$1,000,000 per year"...if approved by a 2/3 vote of the City Council."

The Port Arthur Economic Development Corporation Board held a special meeting on
and the Board recommended that the City Council renew Proposition 1 for an
additional three (3)year period.
I am requesting the renewal of the $1,000,000 per year funding for an additional three (3) year
period with approval subject to the 2/3 City Council vote requirement.
Budget Impact:
$1,000,000 per year for three (3)years from the Economic Development Corporation
Recommendation:
It is recommended that the City Council approve P.R.No. 23910 approving the continued use
of the City of Port Arthur Type A Economic Development Corporation sales and use tax funds
to be used for enhancements at Adams Park, Rose Hill Park, and the Recreation and Senior
Citizens Center pursuant to 505.152 of the Texas Local Government Code at a rate of
$1,000,000 per year for an additional three (3) year period as authorized by the voters at the
May 1, 2021 election.

RESOLUTION NO.
A RESOLUTION APPROVING THE CONTINUED USE OF THE CITY OF
PORT ARTHUR TYPE A ECONOMIC DEVELOPMENT CORPORATION
SALES AND USE TAX FUNDS TO BE USED FOR ENHANCEMENTS AT
ADAMS PARK, ROSE HILL PARK, AND THE RECREATION AND SENIOR
CITIZENS CENTER PURSUANT TO §505.152 OF THE TEXAS LOCAL
GOVERNMENT CODE AT A RATE OF $1,000,000 PER YEAR FOR AN
ADDITIONAL THREE (3) YEAR PERIOD AS AUTHORIZED BY THE
VOTERS AT THE MAY 1, 2021 ELECTION
WHEREAS, pursuant to Ordinance 21-34, at the May 1, 2021 Election, the voters
approved Proposition 1 on the ballot which stated that "Shall the City of Port Arthur Type A
Economic Development Corporation sales and use tax funds be used for enhancements at Adams
Park, Rose Hill Park, and the Recreation and Senior Citizens Center pursuant to §505.152 of the
Texas Local Government Code at a rate of$1,000,000 per year for a three-year period with an
option to renew for up to an additional three (3) year period in the amount of$1,000,000 per year
authorization if approved by a 2/3 vote of the City Council."; and,
WHEREAS, said Proposition stated that said period of time can be extended an
additional three (3) years by the City Council by a two-thirds (2/3)vote of the City Council; and,
WHEREAS, at the City of Port Arthur Economic Development Corporation Board's
(PAEDC) Special Board Meeting held , the PAEDC recommended that City
Council renew Proposition 1 for an additional three (3) years (see attached memorandum from
Terry Stokes, CEO of the PAEDC attached as Exhibit"A"); now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
Section 1. That the City Council, by a 2/3 vote, hereby approves the renewal of the
City of Port Arthur Type A Economic Development Corporation sales and use tax funds to be
used for enhancements at Adams Park, Rose Hill Park, and the Recreation and Senior Citizens
Center

Section 2. That a copy of the caption of this Resolution be spread upon the Minutes
of the City Council.
