RE: PR 23972, Purchase of two New 1500 GPM Type I Fire Engine Apparatus
Introduction:
The purpose of this agenda item is to request the City Council's approval of Proposed
Resolution 23972 authorizing the purchase of two Pierce 1500 GPM Type I Fire Engine
Apparatus from Siddons-Martin Emergency Group of Denton,Texas,using BuyBoard pricing
for a total of$2,539,492.00. One engine will be assigned to Station 2, and the other will be
assigned to Station 8. These two Type I fire engines will replace Reserve Engine 3 and
Reserve Engine 5, which are 2002 and 2003 Type I engines. Siddons-Martin Emergency
Group operates a fire truck repair facility in Port Arthur,Texas.
Background:
These two-fire apparatuses will replace reserve engines 3 and 5, which are 1500 GPM Type I
fire engines. The older engines will be retired and sold at auction. The quoted price includes
discounts for chassis pre-payment and full pre-payment. Since the project will be prepaid,we
will receive a discount for buying and paying now instead of paying when we receive the
engines. We were given two options.
Option 1 is to order the two Type I engines and pay upfront for a cost of$2,539,492.00. Option
2 is to order the engines and pay when they arrive, for a cost of$2,897,320.00. Choosing
option 1 allows us to save$357,828. Therefore, I propose option 1 with the$300,000 plus
savings. The quoted cost includes loose equipment(extrication equipment,hand tools, ladders,
etc.) for these vehicles. The estimated delivery time is within 47-48 months of the ordering
date.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO
PURCHASE TWO (2) PIERCE 1500 GPM TYPE 1 FIRE ENGINE
APPARATUS FOR THE FIRE DEPARTMENT VIA THE
BUYBOARD COOPERATIVE PURCHASING PROGRAM FROM
SIDDONS-MARTIN EMERGENCY GROUP OF DENTON, TEXAS,
WITH OFFICES IN PORT ARTHUR,TEXAS IN THE AMOUNT OF
$2,537,492.00; FUNDING AVAILABLE IN FY 2024-2025 CAPITAL
IMPROVEMENT ACCOUNT NUMBER 307-19-047-8523-00-10-000
WHEREAS,the Fire Department has found it necessary to purchase two(2)Pierce
1500 GPM Type I Fire Engine Apparatus to replace existing 2002 and 2003 Pierce 1500
GPM Type I Fire Engines that have reached the end of useful frontline service life and will
be retired, and/or sent to auction; and
WHEREAS, the Fire Department along with the Finance Department have
determined that it is most cost effective to purchase said vehicle through the BuyBoard
Cooperative Purchasing Program; and
WHEREAS, Chapter 271 of the Texas Government Code allows a city, by
resolution of its governing body, to participate in cooperative purchasing programs, such
as Texas Buyboard, as an alternative to formal bid process; and
WHEREAS, pursuant to Resolution No. 02-341, the City of Port Arthur entered
into an interlocal agreement for cooperative purchasing with Texas Buyboard; and
WHEREAS,a copy of the contract pricing worksheet for the vehicle is attached as
Exhibit A with two options to purchase these two fire engines. Option 1 is to order the two
Type I engines and pay upfront for a cost of$2,539,492.00. Option 2 is to order the engines
and pay when they arrive,for a cost of$2,897,320.00. Choosing Option 1 allows us to save
$357,828.00; therefore, the Fire Department staff proposes Option 1 with the $300,000
plus savings; and
WHEREAS, the price includes loose equipment; and
WHEREAS, funds are budgeted and available for this purchase in FY 24-25
Capital Improvement Account Number 307-19-047-8523-00-10-000; and
WHEREAS, the Fire Department recommends to the City Council that the City
Manager be authorized to purchase two (2)Pierce 1500 GPM Type I Fire Engines in order
to replace two existing 2002 and 2003 1500 GPM Type I Fire Engines that have reached
the end of their usefulness as a frontline service unit.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF

Section 2. That the City Manager is hereby authorized and directed to purchase

Emergency Group of Denton, Texas through BuyBoard in the amount of$2,539,492.00,
as delineated in Exhibit"B"attached hereto.
Section 3. That a copy of the caption of this resolution shall be spread upon the
Minutes of the City Council.

such increase and the updated price for the customer's approval before proceeding with completion of the order along with

Taxes:Tax is not included in this proposal. In the event that the purchasing organization is not exempt from sales tax or any
other applicable taxes and/or the proposed apparatus does not qualify for exempt status, it is the duty of the purchasing
organization to pay any and all taxes due. Balance of sale price is due upon acceptance of the apparatus at the factory.
Late Fee:A late fee of.033% of the sale price will be charged per day for overdue payments beginning ten (10)days after
the payment is due for the first 30 days. The late fee increases to.044% per day until the payment is received. In the event a
prepayment is received after the due date,the discount will be reduced by the same percentages above increasing the cost
of the apparatus.
Cancellation: In the event this proposal is accepted and a purchase order is issued then cancelled or terminated by
Customer before completion, Siddons-Martin Emergency Group may charge a cancellation fee.The following charge
schedule based on costs incurred may be applied:
(A) 10% of the Purchase Price after order is accepted and entered by Manufacturer;
(B) 20% of the Purchase Price after completion of the approval drawings;
(C) 30%of the Purchase Price upon any material requisition.
The cancellation fee will increase accordingly as costs are incurred as the order progresses through engineering and into
manufacturing. Siddons-Martin Emergency Group endeavors to mitigate any such costs through the sale of such product to
another purchaser; however,the customer shall remain liable for the difference between the purchase price and, if
applicable,the sale price obtained by Siddons-Martin Emergency Group upon sale of the product to another purchaser, plus
any costs incurred by Siddons-Martin to conduct such sale.
Acceptance: In an effort to ensure the above stated terms and conditions are understood and adhered to, Siddons-Martin
Emergency Group, LLC requires an authorized individual from the purchasing organization sign and date this proposal and
include it with any purchase order. Upon signing of this proposal,the terms and conditions stated herein will be considered
binding and accepted by the Customer.The terms and acceptance of this proposal will be governed by the laws of the state
of Texas. No additional terms or conditions will be binding upon Siddons-Martin Emergency Group, LLC unless agreed to in
