AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A
CORRECTION SPECIAL WARRANTY DEED FOR TRACT 39-A(LOT 39)
OF THE MARINA COLONY SUBDIVISION,COMMONLY KNOWN AS 430
ISLAND WAY,LOCATED IN MARINER'S COVE ON PLEASURE ISLAND
WHEREAS, in 1996, the Pleasure Island Commission filed a Replat Map of the Marina
Colony Subdivision, attached hereto as Exhibit "A" and approved by Resolution 96-201, which
included all of Lot 39 and a portion of Reserve Tract"D",thereby creating what is now designated as
Tract 39-A, as recorded in Volume 15, Page 345 of the Map Records of Jefferson County; and
WHEREAS, in 2003, under County Clerk's File No. 2003027224, the Pleasure Island
Commission executed a conveyance that inaccurately described the property intended for conveyance
by referencing only Lot 39, instead of the correct designation, Tract 39-A; and
WHEREAS,File No. 2003027224,along with all subsequent conveyances recorded under
File Nos. 2012036152 and 2020009602, contains the same clerical error; and
WHEREAS,the current owner is seeking a correction deed to rectify the error and secure
clear title for the sale of Tract 39-A;however,the Pleasure Island Commission has been dissolved,
and ownership of Marina Colony was transferred to the City of Port Arthur pursuant to the approval
of Proposition 11 in the 2013 election.
NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Council hereby authorizes the City Manager to execute a
Correction Special Warranty Deed,in substantially the same form attached as Exhibit"B",in favor
of the current titleholders,Neal E. Windham and Katie Beth Windham,to reflect the correct legal
descriptions of Tract 39-A, commonly known as 430 Island Way.
Section 3. That the correction deed shall convey any remaining interest in the portion of
Reserve Tract "D" now incorporated into Tract 39-A, correcting the inaccurate description in the
deed recorded under County Clerk's File No. 2003027224.

PURSUANT TO SECTION 5.027 OF THE TEXAS PROPERTY CODE, THIS DOCUMENT IS A

ERROR IN THE LEGAL DESCRIPTION.

of MARINA COLONY, SECTION ONE, a Subdivision to the City of Port Arthur,
Jefferson County, Texas, according to the map or plat thereof on file and of record in
Volume 15,Page 345, Map Records of Jefferson County,Texas.
The property is commonly known as 430 Island Way, Port Arthur, Jefferson County,
Texas 77642.
Reservations from and Exceptions to Conveyance and Warranty:
Any and all restrictions, covenants, conditions and easements, mineral and/or royalty
reservations of record, if any, relating to the hereinabove described property,but only to the
extent they are still in effect, and all zoning laws, regulations and ordinances of municipal
and/or other governmental authorities, if any, but only to the extent that they are still in
effect,relating to the hereinabove described property.

All of the improvements located upon the above-described property, if any, are being
conveyed "AS IS, WHERE IS, WITH ALL FAULTS" with no warranty whatsoever given
in regard to their quality or condition.
Grantor, for the consideration and subject to the reservations from and exceptions to
conveyance and warranty, grants, sells, and conveys to Grantee the property, together with
all and singular the rights and appurtenances thereto in any wise belonging,to have and hold
it to Grantee, Grantee's heirs, executors, administrators, successors, or assigns forever.
Grantor binds Grantor and Grantor's heirs, executors, administrators, and successors to
warrant and forever defend all and singular the property to Grantee and Grantee's heirs,
executors, administrators, successors, and assigns against every person whomsoever
lawfully claiming or to claim the same or any part thereof, except as to the reservations
from and exceptions to conveyance and warranty, when the claim is by, through or under
Grantor,but not otherwise.
When the context requires, singular nouns and pronouns include the plural.
This Correction Warranty Deed is made in place of and to correct Special Warranty Deed
from Pleasure Island Commission dated June 5, 2003, recorded under County Clerk's File
No. 2003027224. The conveyance inaccurately described the property intended for
conveyance by referencing only Lot 39, instead of the correct designation, Tract 39-A.
