RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR, TEXAS, AUTHORIZING 4 FILM CO.'S USE OF CITY
PROPERTY IN CONNECTION WITH THE PRODUCTION OF A
MOTION PICTURE, NOTWITHSTANDING THE COMPANY'S
FAILURE TO OBTAIN A FILMING PERMIT PRIOR TO
COMMENCEMENT OF FILMING; AND PROVIDING AN EFFECTIVE
DATE (REQUESTED BY COUNCILMEMBER HAMILTON EVERFIELD).
WHEREAS, the City of Port Arthur ("City") seeks to promote economic
development, including opportunities presented by the film and entertainment industries;
and
WHEREAS, 4 Film Co. ("Company") was engaged in the production of a motion
picture project ("Project") within the City; and
WHEREAS, the Company commenced filming activities within the City without
first obtaining a filming permit as required by Ordinance 21-63; and
WHEREAS, the Company has acknowledged its oversight and has submitted an
application and the permit fees to comply with all applicable City requirements; and
WHEREAS, the City Council finds that allowing the Company to proceed with its
use of City property in the Project, serves the public interest by supporting local economic
activity and promoting the City as a film-friendly community; and
WHEREAS, the City Council further finds that the approval of this Resolution will
not prejudice the City's enforcement of permitting requirements in the future.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
THAT the City Council hereby authorizes 4 Film Co. to use City property in the
Project, subject to the conditions set forth in this Resolution.
THAT the authorization granted herein is contingent upon the following:
The Company shall indemnify and hold harmless the City, its officers, employees, and
agents from any claims or damages arising out of or related to the use of City property.
THAT the City Council's approval of this Resolution does not waive or otherwise
diminish the City's authority to enforce compliance with its permitting requirements in the
future.
THAT this Resolution shall take effect immediately upon its passage.
READ, ADOPTED AND APPROVED on this day of December, A.D., 2024,
at a Council Meeting of the City Council of the City of Port Arthur, Texas, by the following
vote:
