NO. 24047 — A resolution calling for a public hearing to consider a Zoning Map Amendment (Zone Change) Introduction: The Port Arthur City Council is being asked to approve Proposed Resolution No. 24047, calling for a public hearing to consider granting a Zoning Map Amendment for approximately 179.73 acres of land being out of Lafitte's Landing 1 &2 and D. Gahagen, Jefferson County, Texas. The property is located in Lafitte's Landing 1 & 2 and D. Gahagen, Jefferson County, Texas. The request aims to amend the zoning from Commercial General (CG) to Medium Density Residential (MDR). Background: On or around July 8, 2024, City Staff along with the Planning & Zoning Commission began the discussion of a potential Zoning Map Amendment in regards to Lafitte's Landing 1 & 2 and D.Gahagen. The subject area is currently zoned Commercial General (CG). On August 22, 2024 City Staff met with property owners in order to express favor and/or opposition of the proposed change. A 30-day comment period was extended to property owners in order to receive feedback from those who may not have been able to attend the meeting or needed more information and clarity on the proposed change. In accordance with Appendix A, Section 6.03 of the City of Port Arthur Zoning Ordinance, any person or corporation having a proprietary interest in any property may petition the city council for a change or amendment to the provisions of this ordinance. The Planning & Zoning Commission may on its own motion or on request from the City Council institute a study and proposal for changes and amendments in the public interest. Notification of the hearing date and time will be published in the city's official newspaper and mailed to adjacent property owners within a 200-foot radius a minimum of 15 days before the public hearing. Budget Impact: None Recommendation: It is recommended that the City Council approve Proposed Resolution No. 24047, calling for a public hearing to consider granting a Zoning Map Amendment for approximately 179.73 acres of land being out of Lafitte's Landing 1 &2 and D. Gahagen, Jefferson County, Texas. The property is located in Lafitte's Landing 1 & 2 and D. Gahagen, Jefferson County, Texas. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A ZONING MAP AMENDMENT FOR 179.73 ACRES OF LAND BEING OUT OF THE LAFITTE'S LANDING 1 & 2 AND D. GAHAGEN SUBDIVISION, JEFFERSON COUNTY, TEXAS. (NORTH OF THE PORT ARTHUR CANAL, SOUTH OF SABINE LAKE, AND WEST OF THE SABINE LAKE CAUSEWAY BRIDGE) Z24-09 CITY OF PORT ARTHUR PLANNING & ZONING COMMISSION WHEREAS, on or around July 8, 2024, City Staff, along with the Planning &Zoning Commission, began discussions regarding a potential Zoning Map Amendment for Lafitte's Landing 1 & 2 and D. Gahagen, which is currently zoned Commercial General (CG); and WHEREAS, on August 22, 2024, City Staff met with property owners to gather feedback on their support or opposition to the proposed change, and a 30-day comment period was extended to allow property owners who could not attend the meeting or needed more information to provide their input; and WHEREAS, in accordance with Appendix A, Section 6.03 of the City of Port Arthur Zoning Ordinance, any person or corporation with a proprietary interest in any property may petition the City Council for a change or amendment to the ordinance, and the Planning & Zoning Commission may, on its own motion or at the request of the City Council, initiate a study and proposal for changes and amendments in the public interest; and P.R. Gahagen, Jefferson County, Texas as delineated in Exhibit "A"; and WHEREAS, the request aims to amend the zoning from Commercial General (CG) to Medium Density Residential (MDR); and WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change; and WHEREAS, notification of the hearing date and time will be published in the city's official newspaper and mailed to adjacent property owners within a 200-foot radius a minimum of 15 days before the public hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT the Planning and Zoning Commission held a public hearing for this case on December 09, 2024. THAT a public hearing to consider a Zoning Map amendment for a 179.73-acres of Land being out of Lafitte's Landing 1 & 2 and D. Gahagen, Jefferson County, Texas, delineated in Exhibit "A" shall be held on January 28, 2024, at 10:00 a.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by telephonic and videoconference. THAT notice of the public hearing shall be published at least fifteen days prior in the City's official newspaper before going to the City Council.
