Background: The City of Port Arthur entered into a contract with Woolpert,Inc. of Houston,Texas,through Resolution 24-175 to provide professional engineering design and bid services for the improvements of the 9th Avenue and 25th Street bridges. Woolpert has evaluated and designed the bridge repairs and is seeking direction from the City Council on the direction in which it wants to proceed. Woolpert sought direction from the City Council during its December 17,2024,executive session meeting but could not present its findings and receive direction. The deliberative process has delayed the finalization of designs,resulting in the firm's request for a contract extension to December 31,2025. Budget Impact: There is no funding impact for the contract extension. Recommendation: The City Council is recommended to approve PR 24138 authorizing the contract extension with Woolpert,Inc.of Houston,Texas,to complete the engineering design and bid services for the 9th Avenue and 25th Street bridges following direction from the City Council. A RESOLUTION AUTHORIZING THE CONTRACT EXTENSION FOR THE BRIDGE REPAIR PROJECT WITH WOOLPERT, INC. OF HOUSTON, TEXAS. THERE IS NO FUNDING IMPACT FOR THE CONTRACT EXTENSION. WHEREAS, the City Council authorized a contract with Woolpert, Inc. (Woolpert) of Houston, Texas, through Resolution 24-175 to provide professional engineering design and bid services for the improvements of two bridges as noted in the Texas Department of Transportation's biannual report; and, WHEREAS, Woolpert has evaluated and designed the bridge repairs and is seeking direction from the City Council; and, WHEREAS, Woolpert sought direction from the City Council during its December 17, 2024 executive session meeting but was unable to present its findings and receive direction; and, WHEREAS,the deliberative process has delayed the finalization of designs as explained in Exhibit A, resulting in the firm's request for a contract extension to December 31, 2025; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, a contract extension(see Exhibit B) with Woolpert, Inc. of Houston, Texas, for the design of the 9th Avenue and 25th Street bridges for no additional cost; and, PR 24138 01/17/2025 FCR Page 2 of 3 THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Box 1089 Port Arthur,Texas 77640 Re: Subject:Request for Contract Time Extension-City of Port Arthur Bridge Repair Project-10020879.00 Dear Ms. Roberts, This letter formally requests a time extension to our current contract for the City of Port Arthur Bridge Repair Project(10020879.00).The City of Port Arthur is currently evaluating the best course of action for the project,considering both bridge replacement and repair alternatives. While we understand and support the City's due diligence in this important decision, the ongoing evaluation process has created a delay on the project. This delay significantly impacts on our ability to adhere to the original project schedule. In our recent discussions, you acknowledged the need for a contract extension. Therefore, we propose extending the current contract completion date to December 31, 2025.This extension will provide adequate time to accommodate the City's decision-making process and allow us to proceed efficiently once a clear direction is established. We appreciate your understanding and cooperation in this matter. We are committed to the successful completion of this project and look forward to continuing our work with the City of Port Arthur. WITNESSETH: That for and in consideration of the payment terms, conditions, and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The term of this Contract extension shall be for a period of 163 days from the date of the original contract expiration date of April 29, 2025. 2. The Contractor will perform work as stated in the Contract Documents. 3. During the term of this Contract, the Contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of Contractor in the Specifications. 4. The CONTRACTOR agrees to perform all the work described in the Specifications and Contract Documents and comply with the terms therein for the original contract amount of$178,818.40. 5. The term "Contract Documents" means and includes the following: a) Agreement b) General Information c) Specifications d) 14id Extension Memo e) Notice to Proceed 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors, and assigns. 7.
