AN ORDINANCE AMENDING SECTION 2-31 OF THE CODE OF
ORDINANCES GOVERNING THE DISTINCTION BETWEEN
ROUTINE AND NONROUTINE AGENDA ITEMS BY AMENDING
SUBSECTION (D)(2) AND (D)(3) TO CHANGE THE DEMARCATION
BETWEEN ROUTINE ITEMS AND NONROUTINE ITEMS FROM
$50,000 TO $100,000
WHEREAS, there exists a necessity to efficiently prepare, review and finalize agenda
items for City Council's consideration; and
WHEREAS, the amount of time to facilitate the presentation of complete and accurate
agenda items to City Council varies by the subject of an agenda item; and
WHEREAS,the procurement cost of routine items has increased due to inflation over the
years; and
WHEREAS, the City Council now desires to amend Section 2-31 of the Code of
Ordinances to enhance timely and complete agenda item approvals by replacing Subsection(d) as
specifically delineated in Exhibit"A".
NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That Section 2-31(d)of the Code of Ordinances, City of Port Arthur,Texas,
is hereby amended to read as follows and delineated in Exhibit"A."
Section 3. That a copy of the caption of this Ordinance be spread upon the Minutes of
the City Council.
Section 4. That this being an Ordinance amending an Ordinance which does not carry
a penalty, and does not require publication, it shall take effect immediately from and after its
passage.

EXHIBIT "A"
Sec. 2-31. Requests to draft ordinances or resolutions; agenda items.
(d) (1) All items presented by staff to the city manager or city secretary for inclusion on the city council
agenda must be submitted in final form.
(2) Routine times approved by the city manager shall be presented to the city attorney for review on the
Friday preceding the agenda posting date. Routine items include contracts utilizing the city's standard
form contract that do not exceed$100,000.00.
(3) Nonroutine items approved by the city manager shall be presented to the city attorney for review on
the Friday that occurs at least two weeks preceding the agenda posting date. Nonroutine items include
the annual budgets,contracts and proposed/anticipated procurement expenditures exceeding
S100,000.00 by competitive bidding, request for proposal or request for qualifications.
