NO. 24154—A resolution calling for a public hearing to consider a Zoning Text Amendment to Appendix A, The City of Port Arthur Zoning Ordinance Introduction: The Port Arthur City Council is being asked to consider the approval of Proposed 1 Resolution No. 24154, calling for a public hearing to consider granting a Zoning Text Amendment to Appendix A, The City of Port Arthur Zoning Ordinance. The request aims to amend Appendix A, Section 3. "Land Uses" of the Zoning Ordinance to include the following "Automobile" related uses as legally conforming uses in the Heavy Industrial & Light Industrial District: Tire Sales Automobile Repair- Minor Automobile Sales Automobile Re air& Sales Automobile Auction Background: On or around January 13, 2025, an application for a Zoning Text Amendment was filed with the Planning & Zoning Division. In accordance with Appendix A, Section 6.03 of the City of Port Arthur Zoning Ordinance, any person or corporation having a proprietary interest in any property may petition the city council for a change or amendment to the provisions of this ordinance. Notification of the hearing date and time will be published in the city's official newspaper and mailed to adjacent property owners within a 200-foot radius at least 15 days before the public hearing. The Planning & Zoning Commission will conduct a public hearing on March 3, 2025, at 5:30 P.M. Budget Impact: None Recommendation: It is recommended that the City Council consider the approval of Proposed Resolution No. 24154, calling for a public hearing to consider granting a Zoning Text Amendment to Appendix A, The City of Port Arthur Zoning Ordinance. Z25-02 CITY OF PORT ARTHUR WHEREAS, it is being requested that the City Council consider a Zoning Text Amendment to Appendix A, Section 3. Land Uses, City of Port Arthur Zoning Ordinance; and, WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: THAT the facts and opinions in the preamble are true and correct. THAT the Planning and Zoning Commission will hold a public hearing for this case on March 3, 2025. THAT the notice of the public hearing for the Planning and Zoning Commission was published in the city's official newspaper on January 18, 2025, and included in the utility billing statement mailouts for January 2025. THAT a public hearing with the Port Arthur City Council to consider a Zoning Text Amendment to Appendix A, the City of Port Arthur Zoning Ordinance, delineated in Exhibit "A" shall be held on March 25, 2025, at 10:00 a.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by telephonic and videoconference. THAT notice of the public hearing shall be published at least fifteen days prior in the City's official newspaper before going to the City Council.
