RE: P.R. NO. 24158 —A resolution calling for a public hearing to consider a
Specific Use Permit
Introduction:
The Port Arthur City Council is being asked to approve Proposed Resolution No. 24158,
calling for a public hearing to consider granting a specific use permit for approximately
0.4854 acres of land consisting of all of Lots 18-20 and part of Lots 21-24, Block 24,
Rosemont Park Addition, Port Arthur, Jefferson County, Texas.
The property is located at 3635 and 3645 39th Street.
The request aims to allow for the construction and operation of "Retail, Local"(Shopping
Center) in the Planned Development-14 District.
Background:
On or around January 28, 2025, the property owner of 3645 & 3635 39th Street applied
for a specific use permit (SUP) to construct & operate a "Retail, Local' (Shopping
Center) in the Planned Development 14 District. Per Appendix A, Section 3: Land Uses,
providing an effective date of January 1, 2023, a "Retail, Local" (Shopping Center) is
prohibited in a Planned Development 14 District without the approval of a specific use
permit.
In accordance with Appendix A, Section 6.07 of the City of Port Arthur Zoning
Ordinance, the City Council, after a public hearing and proper notice to all parties

affected and after recommendations by the Planning and Zoning Commission, may
authorize the issuance of Specific Use Permits for the uses indicated by "SUP" in 3.03.
Land Use Table. Specific Use Permits (SUP) are issued to the property, not to the
applicant, use, or business.
The City Council may, in the interest of the public welfare and to ensure compliance
with this ordinance, establish conditions of operation, location, arrangement, and
construction of any uses listed as Specific Use Permits; the City Council may impose
such development standards and safeguards as the conditions and locations indicate
important to the welfare and protection of adjacent property from noise, vibration, dust,
dirt, smoked, fumes, gas odor, explosion, glare, offensive view, or other undesirable or
hazardous conditions.
Notification of the hearing date and time will be published in the city's official newspaper
and mailed to adjacent property owners within a 200-foot radius at least 15 days before
the public hearing.
The Planning & Zoning Commission will conduct a public hearing on March 3, 2025, at
5:30 P.M.

Recommendation:
It is recommended that the City Council approve Proposed Resolution No. 24158,
calling for a public hearing to consider granting a specific use permit for approximately
0.4854 acres of land consisting of all of Lots 18-20 and part of Lots 21-24, Block 24,
Rosemont Park Addition, Port Arthur, Jefferson County, Texas.
The property is located at 3635 and 3645 39th Street.
The City Council public hearing shall be held on Tuesday, March 25, 2025, at 10:00
a.m.

WHEREAS, it is being requested that the City Council consider a Specific Use
Permit for 0.4854 acres of land consisting of all of Lots 18-20 and part of Lots 21-24,
Block 24, Rosemont Park Addition, Port Arthur, Jefferson County, Texas, as delineated
in Exhibit "A"; and,
WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a
public hearing must precede any zoning change.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
THAT the facts and opinions in the preamble are true and correct.
THAT the Planning and Zoning Commission will hold a public hearing for this case
on March 3, 2025.
THAT the notice of the public hearing for the Planning and Zoning Commission
was published in the city's official newspaper on February 8, 2025, and mailed to nineteen
(19) adjacent property owners within a 200-ft. radius of the proposed site on February 13,
2025.
THAT a public hearing with the Port Arthur City Council to consider a Specific Use
Permit for a .491-acre of Land being out of the Rosemont Addition, Jefferson County,
Texas, delineated in Exhibit "A" shall be held on March 25, 2025, at 10:00 a.m. in the City

Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by
telephonic and videoconference.
THAT notice of the public hearing shall be published at least fifteen days prior in
the City's official newspaper before going to the City Council.
THAT a copy of the caption of this Resolution is spread upon the Minutes of the
City Council.
READ, ADOPTED, AND APPROVED this day of February, A.D. 2025, at a
Regular Meeting of the City Council of the City of Port Arthur, Texas, by the following vote:
