RESOLUTION NO.
A RESOLUTION OF THE CITY OF PORT ARTHUR, TEXAS TO REPEAL THE
CITY COUNCIL'S PAST APPOINTMENTS OF ACTING ASSISTANT CITY
SECRETARIES AND ASSISTANT CITY SECRETARIES IN COMPLIANCE WITH
THE CHARTER OF THE CITY OF PORT ARTHUR, TEXAS.
WHEREAS,the City of Port Arthur,Texas,is a home-rule municipality and is a"Council-Manager"
form of government; and
WHEREAS,all powers of the City shall be vested in and exercised by an elective City Council,which
shall enact legislation, adopt budgets, determine policies and APPOINT the:
CITY MANAGER
CITY ATTORNEY
CITY SECRETARY AND
CITY JUDGE.
See Article I, Section 4 of the Port Arthur City Charter; and
WHEREAS, pursuant to Resolution Nos. 08-020, 09-078, 11-033 and 11-420, the City Council
appointed Acting Assistant City Secretaries and Assistant City Secretaries without the charter's
jurisdiction to appoint. The City Council may PROVIDE COMPENSATION for assistants as it may
deem necessary,but not appointment.See Article VII,Section 3 of the Port Arthur City Charter;and
WHEREAS,the City Council's appointment of AssIs TAN T City Secretaries has caused confusion on
who they report to and who conducts their performance evaluations; and
WHEREAS,the City Council seeks to repeal its appointment acts under Resolution Nos.08-020,09-
078, 11-033 and 11-420, but will continue to provide for the compensation of said assistant(s) as
authorized by City Council's approved annual municipal budget and the City of Port Arthur's Wage
and Compensation Plan.
Now THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS:
SECTION 1. The facts and above-recitals in the preamble are true and correct.
SECTION 2. The City Council hereby repeals these resolutions to comply with its City Charter:
Resolution No. 08-020—Appointment of Acting Assistant City Secretary. See Exhibit A
Resolution No. 09-078—Appointment of Assistant City Secretary. See Exhibit B

SECTION 3. The City Council will continue to provide for the compensation of said assistant(s)as
authorized by City Council's approved municipal budget and the City of Port Arthur's Wage and
Compensation Plan.
SECTION 4. That a copy of the caption of this Resolution shall be spread upon the Minutes of the
City Council.

A RESOLUTION APPOINTING AN ACTING ASSISTANT
CITY SECRETARY PURSUANT TO ARTICLE VII,
SECTION 3 OF THE CITY CHARTER (REQUESTED BY
COUNCILMEMBER BEARD)
WHEREAS, pursuant to Resolution No. 07-558, the City Council
appointed Terri Hanks as Acting City Secretary; and
WHEREAS, the City Council deems it in the public's interest to
appoint an Acting Assistant City Secretary.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are
true and correct.
Section 2. That pursuant to Article VII, Section 3 of
the Charter of the City of Port Arthur, the City Council hereby
appoints Sherri Bellard as Acting Assistant City Secretary with
compensation to be provided in accordance with the City of Port
Arthur' s Wage and Compensation Plan.
Section 3. That Sherri Bellard be and she is hereby
authorized to perform all duties which may be delegated to her by
the Acting City Secretary, Terri Hanks, and to do any and all acts
and to perform any and all duties which the Acting City Secretary,
Terri Hanks, may be authorized or directed to do or perform under
the laws of the State of Texas and the Charter, Ordinances, and

THE ASSISTANT CITY SECRETARY PURSUANT TO
ARTICLE VII, SECTION 3 OF THE CITY CHARTER

WHEREAS, Sherri Ballard was appointed Acting Assistant City
Secretary, pursuant to Resolution No. 08-020, which was approved on
January 16, 2008; and
WHEREAS, the City Council desires to appoint Sherri Ballard as
the Assistant City Secretary of the City of Port Arthur.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble
are true and correct .
Section 2 . That Sherri Ballard is hereby confirmed as
Assistant City Secretary, effective March 15, 2009 at Range 47 and
initially at Step 3, in accordance with the City of Port Arthur' s
Wage and Compensation Plan and receive a $250 per month car
allowance .

AN ACTING ASSISTANT CITY SECRETARY
WHEREAS, the City Council deems it in the best interest of the
City to appoint an Acting Assistant City Secretary in the absence
of the Assistant City Secretary.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1 . That the facts and opinions in the preamble are
true and correct.
Section 2 . That Kelly Moore is herein appointed as
Acting Assistant City Secretary, with compensation set at Range
47, Step 1.
Section 3 . That the Acting Assistant City Secretary shall
comply with the City Charter in all respects, including performance

A RESOLUTION PERTAINING TO THE APPOINTMENT OF THE
ASSISTANT CITY SECRETARY PURSUANT TO ARTICLE VII SECTION 1
OF THE CITY CHARTER
WHEREAS, pursuant to Resolution No. 11 - qi9 Sherri Bellard was appointed City
Secretary; and,
WHEREAS, said appointment creates a vacancy of the Assistant City Secretary in the
office of the City Secretary; and,
WHEREAS, the City Council deems it necessary and appropriate to fill said vacancy;
and,
WHEREAS, Kelly Moore was appointed Acting Assistant Secretary, per Resolution No.
11-033, effective January 25, 2011, with compensation set at Range 47, Step 1; and,
WHEREAS, the City Council desires to appoint Kelly Moore as the Assistant City
Secretary of the City of Port Arthur.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That Kelly Moore is herein appointed Assistant City Secretary of the City
of Port Arthur, effective September 20,2011,with compensation set at Range 47, Step_of the
City's Wage and Compensation Plan,pursuant to the terms of Article VII, Section 1 of the
Charter .
Section 3. That the Assistant City Secretary shall carry out the duties of the City
Secretary in the absence of the appointee.
Section 4. That the terms,conditions or benefits as delineated in Exhibit"A" shall
also be applicable to the City Secretary.
