Introduction: The intent of this Agenda Item is to request the City Council's approval of P. R. No. 24184 authorizing the City Manager to renew for the third year(second and final renewal) a contract with United Site Services,of Texas,Inc. of Beaumont, Texas for the rental of regular portable toilets, wheelchair accessible toilets, ADA accessible toilets and portable toilets with hand washing station for the Parks and Recreation Department with a total projected budgetary impact of$60,000.00 annually. Background: The City of Port Arthur has over 32 parks which are utilized by citizens and visitors throughout the year. Further, several of the parks are home to baseball, softball and football leagues which increases the number of patrons on the parks. The vast majority of parks do not have fixed rest room facilities. The City, and other organizations, sponsor events at various locations throughout the city and portable toilets are needed. The Parks and Recreation Department desires to renew the contract for the third year(second and final renewal) with United Site Services, of Texas, Inc. of Beaumont, Texas. Budget Impact: Funding in the amount of$60,000.00($30,000.00 Parks and Recreation Rent Account Number 001-25-065-5401-00-20-000; $15,000.00 Public Works Rent Account Number 403-50-320- 5401-00-00-000 and $15,000.00 Pleasure Island Building Maintenance Account Number 450- 60-415-5312-00-00-000) is available annually for this purpose. A RESOLUTION AUTHORIZING THE THIRD YEAR (SECOND AND FINAL RENEWAL) FOR THE RENTAL OF REGULAR TOILETS, WHEELCHAIR ACCESSIBLE TOILETS, ADA ACCESSIBLE TOILETS, AND PORTABLE TOILETS WITH HAND WASHING STATION WITH UNITED SITE SERVICES, OF TEXAS, INC. OF BEAUMONT, TEXAS WITH A PROJECTED BUDGETARY AMOUNT OF $60,000.00 ANNUALLY, FOR THE PARKS AND RECREATION DEPARTMENT, FUNDING AVAILABLE ($30,000.00 PARKS AND RECREATION RENT ACCOUNT NUMBER 001-25-065-5401-00-20-000, $15,000.00 PUBLIC WORKS RENT ACCOUNT NUMBER 403-50-320-5401-00-00-000, AND $15,000.00 PLEASURE ISLAND BUILDING MAINTENANCE ACCOUNT NUMBER 450- 60-415-5312-00-00-000) WHEREAS, pursuant to Resolution No. 23-177, the City of Port Arthur entered into a contract with United Site Services, of Texas, Inc. of Beaumont, Texas for the rental of regular toilets, wheelchair accessible toilets, ADA accessible toilets and portable toilets with hand washing station; and, WHEREAS, the contract included an option to renew for two (2) additional one-year periods; and, WHEREAS, pursuant to Resolution No. 24-209, the City of Port Arthur renewed the contract with United Site Services, of Texas, Inc. of Beaumont, Texas for the second year (first renewal) for the rental of regular toilets, wheelchair accessible toilets, ADA accessible toilets and portable toilets with hand washing station; and, WHEREAS, the Parks and Recreation Department desires to renew the contract for the third year (second and final renewal), with United Site Services, of Texas, Inc. of Beaumont, Texas for the rental of regular toilets, wheelchair accessible toilets, ADA accessible toilets and portable toilets with handwashing station with a total projected budgetary impact of$60,000.00 per year, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the City Council of the City of Port Arthur hereby authorizes the third year (second and final renewal) of the contract with United Site Services, of Texas, Inc. of Beaumont, Texas for the rental of regular toilets, wheelchair accessible toilets, ADA accessible toilets and portable toilets with hand washing station with a total projected budgetary impact of $60,000.00, attached hereto as Exhibit"A". Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. WITNESSETH: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The term of this Contract shall be from May 16, 2025 to May 15, 2026, unless sooner terminated under the provision hereof. The City can terminate this contract at its convenience which includes, but not limited to, funding being available in any budget cycle with thirty (30) days written notice. 2. The Contractor will supply regular portable toilets, wheelchair accessible toilets, ADA accessible toilets and portable toilets with hand washing station as stated in the Contract Documents. 3. During the term of this Contract, the Contractor will furnish at his own expense all of the materials, supplies, tools, equipment, labor and other services necessary to connection therewith, excepting those supplies specifically not required of Contractor in the Specifications. 4. The CONTRACTOR agrees to perform all the work described in the specifications and contract documents and to comply with the terms therein for the amount of $135.00 for regular portable toilets, $155.00 for wheelchair accessible toilets, $210.00 for ADA accessible toilets and $195.00 for portable toilet with hand washing station in an amount not to exceed $60,000.00 annually. 5. The term "Contract Documents" means and includes the following: 1) Renewal Agreement 2) Advertisement for BIDS* 3) Addenda* 4) General Information* 5) Specification* 6) Bid* 7) Notice of Award* 8) Notice to Proceed Page 1 of 2 *These items were attached to the original contract. 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns. 7. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by their duly authorized officials,this Agreement in(2 copies) each of which shall be deemed an original on the date first written above.
