HomeMy WebLinkAboutPR 15602: ALLCO, INC. - WASTEWATER TREATMENT PLANT REHAB PROJECTMEMOR!~NDUM CITY OF PORT ARTHUR UTILITY OPERATIC-NS DEPARTMENT TO: Stephen Fitzgibbons, City Manager FROM: Kelly Eldridge, Director of Utility Operations ~~C-~o~-,~ DATE: October 29, 2009 SUBJECT: Proposed Resolution No. 15602 RECOMMENDATION I recommend that the City Council approve Proposed Resolution No. 15602 authorizing the execution of a contract with ALLCO, Inc., of Beaumont, Texas, in the estimated amount $8,141,753.00 for the Wastewater Treatment Plant Rehabilitation Project, Contract No. 5, City Project No. 404WWT. BACKGROUND This ARRA grant funded project will rehabilitate noted deficiencies found at our Main and Port Acres WWTP's. Five (5) contractors attended the mandatory pre-bid meeting, and the following two (2) bids were received on October 28, 2009: Recommended Recommended Bidder Total Bid Changes* Total Award ALLCO, Inc. $ 9,845,708.00 $1,703,955.00 $8,141,753.00 Beaumont, TX REYTEC Construction Resources, Inc. $10,585,460.00** Houston, TX * Recommended reductions include: $500,000 in emergency generator(s) now funded in an ORCA grant, all Supplemental ]terns, which are used only at the direction of the Engineer, and all Alternate Bid Items except for the FEMA-funded media replacement. ** The bid submitted by REYTEC acknowledged receipt of Addendum No. 1, which changed the bid form, but submitted their bid on the old form, which excluded some bid items. The apparent low bid submitted by ALLCO, Inc. was over our available ARRA funding, so City staffmet with the consulting engineer and the apparent low bidder to discuss items we maybe able to remove and still meet the requirements of our Attorney General's Judgement and TCEQ Design Criteria. The contractor and engineer are also discussing several other items that we may be able to reduce or eliminate with more field verification and specification clarification afterwards. Much of our Main WWTP electrical system is an unknown, as it is comprised of the original., two WWTP upgrades, and 48 years of maintenance repairs. The contractor, his electrical subcontractor, City staff, and our consultant will meet on site next week to better define a scope of work in an effort to reduce costs. We anticipate Change; Order No. 1 to be ready for approval at the next City Council meeting. BUDGET/FISCAL EFFECT We have approximately $5.5 million remaining in ARRA grant funds, no. 404-1625-532.83-00, City Project No. 404WWT. A FEMA Project Worksheet for Hurricane Ike damages has been approved that will cover at least the Alternate Bid Item at $306,000, and the balance will be funded through savings from other ARRA contracts and our existing bond fund we allocated for this work before this grant became available. STAFF/EMPLOYEE EFFECT City staff and our consulting engineer, Arceneaux & Glates, will oversee this project. SUMMARY I recommend that the City Council approve Proposed Resolution No. 15602 authorizing the execution of a contract with ALLCO, Inc., of Beaumont, Texas, in the estimated amount $8,141,753.00 for the Wastewater Treatment Plant Rehabilitation Project, Contract No. 5, City Project No. 404WWT. P.R. No. 15602 10-29-09 RESOLUTION NO. A RESOLUTION AWARDING A CONTRACT AND AUTHORIZING THE EXECUTION OF SAID CONTRACT IN THE ESTIMATED AMOUNT OF $8,141,753.00 FOR THE WASTEWATER TREATMENT PLANT REHABILITATION PROJECT, CONTRACT NO. S, BETWEEN THE CITY OF PORT ARTHUR AND ALLCO, INC.., OF BEAUMONT, TEXAS, ACCOUNT NO. 404-1625-532.83-00, CITY PROJECT NO. 404WWT. WHEREAS, the City is currently under an Agreed Order with the TCEQ to rehabilitate its sanitary sewer system; and, WHEREAS, there exists a need to reduce flows and eliminate sanitary sewer overflows in our collection and treatment systems and bring our treatment plants into permit compliance; and, WHEREAS, the City of Port Arthur advertised and received bids from two contractors for the Wastewater Treatment Plant Rehabilitation Project, Contract No. 5; and, WHEREAS, Arceneaux & Gates Consulting Engineers, Inc. has reviewed the bids, met with the apparent low bidder in order to make recommendations for cost reductions at the time of award, and recommends award to the lowest responsive, responsible bidder, ALLCO, Inc.; and, WHEREAS, a copy of their bid tabulation ,and recommendation is attached hereto as Exhibit "A"; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the City Council of the City of Port Arthur hereby awards the contract for the Wastewater Treatment Plant Rehabilitation Project, Contract No. 5 to the lowest responsive, responsible bidder to-wit; ALLCO, Inc., of Beaumont, Texas, for wastewater treatment plant rehabilitation at $8,141,753.00, contingent upon TWDB approval and funding; and, THAT the City Council of the City of Port Arthur hereby acknowledges and awards the unit prices shown for Supplemental Bid Items in the biid tabulation provided by Arceneaux & Gates P.R. No. 15602 10-29-09 Page 2 of 3 Consulting Engineers, Inc., attached hereto as Exhibit "A"; and, THAT the Mayor and City Manager of the City of Port Arthur are hereby authorized to execute on behalf of the City of Port Arthur a contract between the City of Port Arthur and ALLCO, Inc. in the amount of $8,141,753.00, a copy attached hereto as Exhibit "B", contingent upon TWDB approval; and, THAT the contractor shall not proceed on any phase or segment of this work until a Notice to Proceed is issued with receipt of performance and payment bond and certificate of insurance; and, THAT, the said contract is an exact dupli<;ate of a City Standard Form contract except for the changes (if any) shown in the Certificate of Sta~r~dard Form Contract, a copy of which is attached hereto as Exhibit "C", and said changes are hereby approved; and, THAT, the contractor shall sign the contract documents as well as this resolution agreeing to the terms hereof; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
