Introduction: The intent of this agenda item is to seek the City Council's authorization to purchase a 50 kW standby generator with installation for the Landfill Division. Background: The Public Works Landfill Division is required to stay in compliance with the Texas Commission on Environmental Quality(TCEQ). The landfill must report all waste disposal to TCEQ, and it is imperative that all buildings maintain power at all times for this purpose. City Council approved the purchase of this equipment in the 2024-2025 fiscal year budget's capital equipment schedule. Budget Impact: Generac Industrial Power of Waukesha,Wisconsin,which maintains contract number 092222- GNR with the Sourcewell Cooperative Purchasing Contract,provided a competitive quote for a 50 kW standby generator with installation for $47,432.00. The Landfill's Equipment Account, 403-50-320-8522-00-00-000,will fund the equipment. Recommendation: It is recommended that the City of Port Arthur's City Council approve PR 24191 authorizing the City Manager to purchase a generator with installation for the Public Works Landfill Division from Generac Industrial Power of Waukesha, Wisconsin, through the Sourcewell Cooperative Purchasing Contract. A RESOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE A GENERATOR WITH INSTALLATION FROM GENERAC INDUSTRIAL POWER FOR THE LANDFILL DIVISION THROUGH THE SOURCEWELL COOPERATIVE PURCHASING CONTRACT NUMBER 092222-GNR FOR $47,432.00. FUNDS ARE AVAILABLE IN THE LANDFILL'S EQUIPMENT ACCOUNT NUMBER 403-50-320-8522-00-00-000. WHEREAS, the Public Works—Landfill Division is required to stay in compliance with the Texas Commission on Environmental Quality(TCEQ); and, WHEREAS,the Landfill's continuous operation is imperative, and lapses in power could hinder these operations; and, WHEREAS, the City Council approved the purchase of this equipment in the 2024-2025 fiscal year budget's capital equipment schedule; and, WHEREAS, Chapter 271 of the Texas Local Government Code allows a city, by resolution of its governing body, to participate in cooperative purchasing programs as an alternative to a formal bid process; and, WHEREAS, per Resolution Number 13-556, the City of Port Arthur is authorized to participate in cooperative purchasing with JCB Sourcewell (formerly National Joint Powers Alliance) Cooperative Purchasing Program; and, WHEREAS,Generac Industrial Power of Waukesha,Wisconsin is a dealer and part of the Sourcewell Cooperative Purchasing Program under JCB Sourcewell Contract Number 092222- GNR, and submitted a quote for a generator with installation to provide power to both buildings at the landfill in the amount of$47,432.00 (attached hereto as Exhibit A). NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: THAT,the facts and opinions in the preamble are true and correct; and, PR 24191 2/21/2025 JAM Page 2 of 3 THAT,the City Manager of the City of Port Arthur is hereby authorized to purchase a 50 kW standby generator with installation from Generac Industrial Power of Waukesha, Wisconsin, through the Sourcewell Cooperative Purchasing Contract for$47,432.00; and, THAT,funding for this purchase is available in the Landfill's Equipment Account Number 403-50-320-8522-00-00-000; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Clarifications and Exceptions: 1. Offloading and placement of the generator is not included and is the responsibility of the purchaser. 2. Any unforeseen problems with existing site or electrical circuitry that affect the completion, change is scope of supply and/or projects cost will be invoiced to the End User 5. A&A takes responsibility for sizing the system and turnkey solution.Any errors or emissions in the scope of supply or materials will be the responsibility of A&A 6. This proposal is based on specification of drawings. 7. Generator installation services are not included and are the responsibility of the purchaser. This includes all related mechanical piping(exhaust or fuel systems),electrical conduit and electrical wiring. 8. Generator preventative maintenance services are not included and are the responsibility of the purchaser. 9. NETA acceptance testing, harmonic content testing,insulation resistance testing, infrared scanning and/or ground fault testing are not included in this proposal.Standard factory testing and standard on-site testing at unity power factor are included. 10. Coordination study,3rd party site testing, protective relay calibration,settings, etc. are not included in this proposal. 11. Fuel is not included in this proposal unless specifically listed above. Diesel fuel is required for startup and testing of generator and will be the responsibility of the purchaser. 12. All permitting, including Air Quality Management District(AQMD or APCD),will be the responsibility of the purchaser. 13. Installation of exhaust silencer(if removed for shipping)shall be the responsibility of the installing contractor. 14. Breaker and automatic transfer switch lugs are provided per the factory offerings and submittal information per UL2200 and UL1008 approvals. Projects that require lug changes will be done by others at their expense. 3 of 4 15. Proposal does not include federal, state,or local sales, use, property,TERP,or excise taxes. In lieu of such taxes,the purchaser must provide the seller a tax exemption certificate acceptable to the proper taxing authorities prior to the order being processed 16. Lead times listed in this proposal are an estimate of current factory production schedules and should be verified at time of order release. Lead time: 10- 13 Weeks+Installation time Terms and Conditions Net 30 days, subject to review and approval by our Credit Dept. Payment obligations are not dependent or contingent upon the manner in which purchaser may receive payment from others. No retainage against this order will be permitted unless agreed to ahead of time.Warranty is invalid without factory start up. Start up will be done during normal business hours.Additional charges will be applied to start ups requested on weekends or off normal business hours.
