RE: An Ordinance Approving a Property Damage Settlement in the Amount of$19,950.00 for
Damages to City of Port Arthur Police Unit#2374
Nature of the request: On December 22, 2024, the operator of Police Unit #2374 (2020
Ford Explorer) was involved in a motor vehicle accident on 9th Avenue and Gulfway Drive. The
operator of Unit #2374 stated he was responding to assist another officer when crossing the
intersection on a green light. The operator failed to cross the intersection with due care by not
utilizing his red and blue overhead emergency lights nor his patrol unit siren to clear the
intersection causing an accident. The motor vehicle accident caused front and right-side damage
to Unit#2374 as well as two additional units owned by citizens.
Staff Analysis, Considerations: The City filed a claim with Texas Municipal League
Intergovernmental Risk Pool (TMLIRP) and has offered the City of Port Arthur a settlement of
$19,950.00, less the $2,500.00 deductible, making the final settlement, #17,450.00 (Exhibit "A"
attached) which is considered a fair and reasonable settlement for Unit#2374.
Recommendation: I recommend approval of Proposed Ordinance No. 7327 authorizing the
property damage settlement against Texas Municipal League — Intergovernmental Risk Pool
(TML-IRP) for damage sustained to Police Unit #2374 (2020 Ford Explorer). Texas Municipal
League-Intergovernmental Risk Pool has offered to settle the claim for $19,950.00, less the
$2,500.00 deductible, making the final settlement offer $17,450.00. TMLIRP has deemed the
unit to be a total loss. This is considered a fair and reasonable settlement.
Budget Considerations: The funds received will be deposited in the Insurance Proceeds
Project#HINGF.

ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE
SETTLEMENT OF A PHYSICAL DAMAGE CLAIM IN THE AMOUNT OF $19,950.00
MADE AGAINST TEXAS MUNICIPAL LEAGUE-INTERGOVERNMENTAL RISK POOL
(TMLIRP) AS A RESULT OF PROPERTY DAMAGE TO POLICE UNIT #2374
WHEREAS, on December 22, 2024, the operator of Police Unit #2374 (2020 Ford
Explorer) was involved in a motor vehicle accident on 9th Avenue and Gulfway Drive. The
operator of Unit #2374 stated he was responding to assist another officer when crossing
the intersection on a green light; and,
WHEREAS, as a result of the damage, a claim was filed with Texas Municipal
League- Intergovernmental Risk Pool (TML-IRP); and,
WHEREAS, it has been determined that the damage sustained by Police Unit #2374
was in excess of the fair market value of the vehicle; and,
WHEREAS, TML-IRP has offered to settle the claim for $19,950.00, less the Physical
Damage deductible amount of $2,500.00, making the final settlement offer $17,450.00,
which is considered a fair and reasonable settlement.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR, TEXAS:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Manager is hereby authorized to execute settlement in the
amount of $19,950.00, less the Physical Damage deductible amount of $2,500.00, making
the final settlement offer $17,450.00, for the claim against TMLIRP in substantially the
same form as delineated in Exhibit "A", in exchange for transfer of the title of Police Unit
#2374 to TMLIRP.
Section 3. That, a copy of this Resolution be spread upon the minutes of the City
Council.
READ, ADOPTED, AND APPROVED this day of , AD, 2025, at a
Meeting of the City Council of the City of Port Arthur, Texas, by the following
