REQUEST:
The cabinetry at the West Side Development Center needs to be replaced. Mike Barnett
Construction of Port Neches, Texas can do this work for $49,843.00 out of account number 307-
15-043-8512-00-10-000-.
ANALYSIS/CONSIDERATION:
The cabinetry at the West Side Development Center has Formica peeling and faces damaged.
Due to this condition, replacement is required. Mike Barnett Construction of Port Neches, Texas
has provided a proposal for this work under the Region 5 Education Service Center Southeast
Texas Cooperative Contract#20250202 in the amount of$49,843.00 out of account number 307-
15-043-8512-00-10-000- Project BU 0021.
RECOMMENDATION
A resolution authorizing the City Manager to enter into an agreement with Mike Barnett
Construction of Port Neches, Texas to replace the cabinetry at the West Side Development
Center in the amount of$49,843.00. Funds available in account number 307-15-043-8512-00-
10-000- Project BU 0021.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
INTO AN AGREEMENT WITH MIKE BARNETT CONSTRUCTION OF
PORT NECHES, TEXAS THROUGH THE REGION 5 EDUCATION
SERVICE CENTER SOUTHEAST TEXAS COOPERATIVE
PURCHASING PROGRAM CONTRACT NUMBER 20250202 TO
REPLACE CABINETRY AT THE WEST SIDE DEVELOPMENT
CENTER IN THE AMOUNT OF $49,843.00. FUNDS AVAILABLE IN
ACCOUNT NUMBER 307-15-043-8512-00-10-000- PROJECT BU 0021.
WHEREAS, the West Side Development Center needs new cabinetry; and
WHEREAS, Mike Barnett Construction of Port Neches,Texas can do this work for
$49,843.00; and
WHEREAS,Mike Barnett Construction of Port Neches, Texas has a cooperative
contract with Region 5 #20250202; and,
WHEREAS,pursuant to Chapter 271, Subchapter D of the Texas Government Code, a
city,by resolution of its governing body, may participate in cooperative purchasing programs
established by the State Facilities Commission for the purchase of goods at prices established
through purchase contracts of the Commission; and,
WHEREAS,per Resolution No. 20-019, the City entered into an interlocal agreement
for cooperative purchasing with the Region 5 Education Service Center Southeast Texas
Cooperative Purchasing Program ("Region 5").
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT,the facts and opinions in the preamble are true and correct.
THAT,the City Manager is hereby authorized to execute an agreement with Mike
Barnett Construction of Port Neches,Texas through Region 5 Contract No. 20250202 to add new
cabinetry to the West Side Development Center in the amount of$49,843.00, in substantially the
same form as attached hereto as Exhibit"A"; and.
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

Re: Cabinet replacement in 4 offices, Kitchenette and the copier area.
We at Mike Barnett Construction are offering you this proposal for the following scope of work. Our estimate
includes all labor and materials to perform the scope of work. Our scope of work is based upon the site
inspection and specifications provided by the owner. If there are any omissions and/or additions to designing
specifications,the owner needs to review and acknowledge the changes to the General contractor.These
changes may affect the proposal provided.
Scope of work: To remove and replace damaged cabinetry in various areas.
A. To remove and replace the cabinetry in the(4)four offices.
• To remove plastic laminate countertops Approx 142"long in each office
• To remove 36"tall upper cabinetry approx. 142" long in each office
• To replace approx. 142"of countertop with laminated legs in each office,to match color selection of
newest existing kitchen cabinetry
• To furnish and install 4"stacked laminated backsplash and end wall splash on each countertop.
• To replace 36"tall upper cabinets approx. 142" long in each office,to match color selection of
newest existing kitchen cabinetry.
• To remove and replace wood Quarter round trim at the base of the panel legs against flooring
surfaces.
B. Copier area:
• To remove Lower plastic laminate cabinets and countertops Approx 11'9"long in the copier area.
• To remove 36"tall upper cabinetry approx. 11'9 long in the copier area.
• To replace approx. 11'9 of lower cabinetry with countertop in copier area,to match color selection
of newest existing kitchen cabinetry
• To furnish and install 4"stacked laminated backsplash and end wall splash on countertop.
• To replace 36"tall upper cabinets approx. 11'9 long in copier area,to match color selection of
newest existing kitchen cabinetry.
C. Kitchenette:
• To remove plastic laminate uppers and lower cabinets approx. 5'1" long in the Kitchenette
• To replace 36"tall upper and lower cabinetry 5'1"with countertop long in the kitchenette.
• To furnish and install full height stacked laminated backsplash and end wall splash on countertop.
• Detach and reset the kitchen sink and faucet. Detach and reset electrical outlet.

Inclusions/Exclusions:
• Clean and dispose of debris.
• Cover and protect furniture and floor.
• Permit/Performance and payment bonds are excluded.
• Content manipulation is excluded and is the responsibility of the owner/tenant.
• Our bid excludes detaching and resetting any computers or electronics.
• Repainting of walls and trim due to demolition is excluded and we will provide the owner with a
quote as needed. All paint work is excluded.
• Asbestos/Lead paint/mold abatement,testing, or remediation is excluded.
Pricing: We are offering this proposal with all labor,material, equipment and required insurance to furnish
and install cabinets and countertops in all four offices for the following price of: Forty-nine thousand eight
hundred and forty-three dollars and no cents: ($49,843.00) plus all applicable taxes.
• All bids are subject to change based upon market materials increases that are beyond our control.
• Due to the market increases in rising materials cost our bid is good for 30 days.

CONTRACT FOR THE NEW CABINETRY FOR THE CIVIC CENTER
DEPARTMENT IN THE CITY OF PORT ARTHUR
THIS AGREEMENT, made this day of , 2025, by
and between the City of Port Arthur, a municipal corporation organized under the laws of
the State of Texas, hereinafter called "OWNER" or "CITY" and Mike Barnett Construction
a(n) herein acting by and through
Individual,firm,partnership or corporation
Mike Barnett Construction, Owner,hereinafter called "CONTRACTOR".
WITNESSETH: That for and in consideration of the payment terms, conditions
and agreements set forth herein, OWNER and CONTRACTOR agree as follows:
1. The term of this Agreement shall be from Notice to Award to ninety working days
after an agreed upon start date between the Civic Center Department and
Contractor., unless sooner terminated under the provision hereof. The City can
terminate this contract at its convenience which includes, but is not limited to,
funding not being available in any budget cycle within thirty (30) days written
notice.
2. The Contractor will perform Cabinetry Replacement at the West Side Development
Center as stated in the Contract Documents.
3. During the term of this Contract, the Contractor will furnish at his own expense all
of the materials, supplies, tools, equipment, labor and other services necessary to
connection therewith, excepting those supplies specifically not required of
Contractor in the Specifications.
4. The CONTRACTOR agrees to perform all the work described in the specifications
and contract documents and to comply with the terms therein for the unit prices
shown in the original bid attached hereto.
5. The term "Contract Documents" means and includes the following:
1) Agreement
2) Proposal
3) Notice of Award
4) Notice to Proceed
6. This Agreement shall be binding upon all parties hereto and their respective heirs,
executors, administrators, successors, and assigns.
7. IN WITNESS WHEREOF,the parties hereto have executed, or caused to be
executed by their duly authorized officials, this Agreement in(2 copies) each of which
shall be deemed an original on the date first above written.
