ORDINANCE NO.
AN ORDINANCE OF THE CITY OF PORT ARTHUR, TEXAS AMENDING
CHAPTER 62,SECTIONS 62-108 AND 62-109 OF THE CODE OF ORDINANCES
PROHIBITING A REGISTERED SEX OFFENDER FROM RESIDENCY WITHIN
1,000 FEET OF ANY SCHOOL AND/OR PARK.
WHEREAS,the Ordinance pertains to making it unlawful for a person who is required to register as a
sex offender pursuant to the Texas Code of Criminal Procedure,Chapter 62,to establish a permanent
or temporary residence within 1,000 feet of any school and/or parks; and
WHEREAS, certain school locations have undergone changes, necessitating the need to provide
updated clarity to the physical addresses of schools within the City of Port Arthur and further define
the word"School"; and
WHEREAS,the Ordinance needs to be amended to include all identified public parks.
Now THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS:
SECTION 1. That the facts and above-recital are true and correct.
SECTION 2. That Section 62-108 of the Code of Ordinances of the City of Port Arthur, Texas, is
hereby amended to read as follows:
"The following words, terms, and phrases, when used in this article, shall the meaning
ascribed to them in this section, except where the context clearly indicates a differeneet meaning:
Permanent residence. A place where the person abides, lodges, or resides for 14 or more
consecutive days.
School.An elementary or secondary school in which a child is enrolled or,if the child is not
enrolled in an elementary or secondary school,the public school district in which the child primarily
resides and as further defined by Section 101.028 of the Texas Family Code.
Temporary residence.A place where the person abides,lodges,or resides for a period of 14
or more days in the aggregate during any calendar year, and which is not the person's permanent
address,or a place where the person routinely abides,resides,or lodges for a period of four or more
consecutive or nonconsecutive days in any month, and which is not the person's permanent
residence."
SECTION 3. That Section 62-109 of the Code of Ordinances of the City of Port Arthur, Texas is
hereby amended to read as follows:
(a) It is unlawful for any person who is required by V.T.C.A., Code of Criminal Procedure ch.
62,to register as a sex offender(for an offense involving a child),to establish a permanent
residence or temporary residence within 1,000 feet of the following premises:

(b) This provision applies to any location designated as a public, private, charter school,
daycare, or any location that provides educational or childcare services.
(c) This provision also applies to any location designated as a public or private space,including
areas with playground equipment, where children commonly gather and engage in
recreational activities within the city of Port Arthur, Texas.
(d) For the purposes of determining the minimum distance separation,the requirement shall be
measured by following a straight line from the outer property line of the permanent or
temporary residence to the nearest property line of the premises where the children
commonly gather, as described herein.
(e) Exceptions: A person residing within 1,000 feet of those places where children commonly
gather,as specified herein does not commit a violation of this article if any of the following
apply:
(1) The person established the permanent or temporary residence and has complied with
all the sex offender registration laws of the state prior to the adoption of this article.
(2) The person was a minor when he or she committed the offense and was not convicted
as an adult.
(3) The person is a minor.
SECTION 3. This Ordinance shall take effect immediately from and after the date of passage and
is so resolved.
SECTION 4. That a copy of the caption of this Ordinance shall be spread upon the Minutes of the
City Council.
