Background: The Clarifier#401 at the Port Acres WWTP was experiencing structural issues,including multiple cracks, which led to partially treated wastewater leaking and pooling around the clarifier which compromised the efficiency of the treatment process and posed the risk of permit violations from the Environmental Protection Agency (EPA) and the Texas Commission on Environmental Quality (TCEQ), as well as posing a health and safety concern. An Emergency Memo was issued on March 25, 2025 for the repairs of the Clarifier#401. The emergency repair was completed by Allco LLC for work including concrete repairs at the bottom 4 feet of the exterior wall at and below the interior floor line, along with sealing the cracks within the clarifier structure. Budget Impact: The total budgetary impact is$85,678.00 and funding in Water System Maintenance Account 405- 40-00-8516-00-00-000 is contingent upon the approval of budget amendment in Proposed Ordinance No. 7340. Recommendation: It is recommended that City Council approve Proposed Resolution No. 24375, ratifying the emergency repair of Clarifier#401 at the Port Acres WWTP as described/outlined above. A RESOLUTION RATIFYING THE CITY MANAGER'S DECISION TO AUTHORIZE THE EMERGENCY REPAIR OF CLARIFIER#401 AT THE PORT ACRES WASTEWATER TREATMENT PLANT BY ALLCO LLC OF BEAUMONT, TEXAS IN THE TOTAL AMOUNT OF $85,678.00; FUNDING IN CIP ACCOUNT NO. 405-40-000-8516-00-00-000 IS CONTINGENT UPON THE APPROVAL OF THE BUDGET AMENDMENT IN PROPOSED ORDINANCE NO. 7340. WHEREAS, Clarifier #401 at the Port Acres Wastewater Treatment Plant (WWTP) was experiencing structural issues,including multiple cracks,which led to partially treated wastewater leaking and pooling around the clarifier; and, WHEREAS,the leaking and pooling compromised the efficiency of the treatment process and posed risks of permit violations and potential fines from the Environmental Protection Agency (EPA) and the Texas Commission on Environmental Quality (TCEQ), as well as, posed public health and safety concerns; and, WHEREAS, on March 25, 2025, the City Manager signed an emergency memo (Exhibit "A"), authorizing the emergency repair by Allco LLC of Beaumont, Texas; and, WHEREAS, Allco LLC completed the repairs and submitted the invoice totaling $85,678.00 (Exhibit"B"); and, WHEREAS,pursuant to Section 252.022(a)(1)of the Texas Local Government Code,this purchase is authorized because of a public calamity that requires the immediate appropriation of money to relieve the necessity of the municipality's residents or to preserve the property of the municipality; and, WHEREAS,it is further authorized pursuant to Section 252.022(a)(2) of the Texas Local Government Code to preserve or protect the public health or safety of the municipality's residents.
