NO. 24357 — Resolution Amending Resolution No. 25-180 to Reschedule a Public Hearing on a Zoning Map Amendment in Accordance with Chapter 211 of the Texas Local Government Code Introduction: The purpose of this memorandum is to request the City Council's consideration and approval of proposed Resolution No. 24357, authorizing the amendment of Resolution No. 25-180, which was adopted by the City Council on May 6, 2025, calling for a public hearing to consider a proposed zoning map amendment. The public hearing was initially scheduled for June 3, 2025, at 6:00 p.m. Background: On May 20, 2025, the City Council adopted Resolution No. 25-227, which rescheduled the regularly scheduled June 3, 2025, City Council meeting to June 4, 2025. Due to this change, the public hearing must also be rescheduled in order to comply with the publication notice requirements outlined in Section 211.006(a) of the Texas Local Government Code. The proposed resolution reschedules the public hearing to Tuesday, July 29, 2025, at 6:00 p.m. in the City Council Chambers, located at City Hall, 444 4th Street, Port Arthur, Texas. The public hearing will address a proposed zoning map amendment for approximately 2.892 acres of land, more specifically described as part of Lot 23, Tracts 6 and 7, and part of Lot 11, Tract 6, Peek Addition, Port Arthur, Jefferson County, Texas. Budget Impact: None Recommendation: Staff recommend that the City Council approve Proposed Resolution No. 24357 to ensure compliance with state law and allow adequate public notice before the rescheduled public hearing. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS, AMENDING RESOLUTION NO. 25-180 TO RESCHEDULE THE DATE OF A PUBLIC HEARING PURSUANT TO CHAPTER 211 OF THE TEXAS LOCAL GOVERNMENT CODE, REGARDING A ZONING MAP AMENDMENT FOR APPROXIMATELY 2.892 ACRES OF LAND (8520 WILSON AVENUE), AND PROVIDING FOR THE PUBLICATION OF NOTICE OF SAID PUBLIC HEARING Z24-10 (MELECIO F. CEJA) WHEREAS,the City Council of the City of Port Arthur, Texas, approved Resolution No. 25-180 on May 6, 2025, calling for a public hearing to be held on Tuesday, June 3, 2025, at 6:00 p.m., in accordance with Chapter 211 of the Texas Local Government Code; and WHEREAS, the purpose of the public hearing is for the City Council to consider a zoning map amendment for approximately 2.892 acres of land, more specifically described as part Lot 23, Tracts 6 and 7, and part of Lot 11, Tract 6, Peek Addition, Port Arthur, Jefferson County, Texas; and WHEREAS, on May 20, 2025, the City Council approved Resolution No. 25-227, rescheduling the regularly scheduled City Council meeting of June 3, 2025, to Wednesday, June 4, 2025; and WHEREAS, due to this change, the public hearing originally scheduled for June 3, 2025, must be rescheduled to comply with the notice and publication requirements outlined in Section 211.006(a) of the Texas Local Government Code, which states: "Before the 15th day before the date of the hearing, notice of the time and place of the hearing must be published in an official newspaper or a newspaper of general circulation in the municipality." P.R.NO.24357 6/20/2025-ARM/pdl PAGE 2 OF 6 WHEREAS, to meet the required notice timeframe, the public hearing must be rescheduled to a later date, and it is proposed that the hearing be held on Tuesday, July 29, 2025, at 6:00 p.m. in the City Council Chambers located at City Hall, 444 4th Street, Port Arthur, Texas. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council hereby amends Resolution No. 25-180 to reschedule the public hearing originally set for June 3, 2025, to Tuesday, July 29, 2025, at 6:00 p.m., in accordance with Chapter 211 of the Texas Local Government Code. Section 3. That the purpose of the public hearing shall be to consider a zoning map amendment for approximately 2.892 acres of land, consisting of part of Lot 23, Tracts 6 and 7, and part of Lot 11, Tract 6, Peek Addition, Port Arthur, Jefferson County, Texas, as delineated in Exhibit "A". Section 4. That notice of the time, date, and location of the rescheduled public hearing shall be published in a newspaper of general circulation in the City of Port Arthur before the 15th day prior to the hearing date, as required by Section 211 .006(a) of the Texas Local Government Code. Section 5. That the Planning and Zoning Commission held a public hearing on May 5, 2025, at 5:30 p.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Jefferson County, Texas, or by telephonic and videoconference. Section 6. That the City Manager or her designee is hereby authorized and directed to take all necessary actions to ensure that proper notice is published and that the public hearing is held as scheduled. That a copy of the caption of this Resolution is spread upon the Minutes of the City Council.
