Proposed Zoning Text Amendment to Allow Automobile-Related Use Types
in LI and HI Districts
Introduction:
The purpose of this memorandum is to request the City Council's consideration and
approval of proposed Resolution No. 24411, authorizing a second public hearing in
accordance with Chapter 211 of the Texas Local Government Code to consider a zoning
text amendment that would allow automobile-related use-types within Light Industrial (LI)
and Heavy Industrial (HI) zoning districts throughout the corporate city limits of Port
Arthur, Texas.
Background:
The City Council held a public hearing on May 6, 2025, at 6:00 p.m. to obtain public input
regarding the proposed zoning text amendment. The amendment seeks to permit
automobile-related uses, such as repair shops, vehicle service facilities, and related
operations, within LI and HI zoning districts to support industrial growth and job creation.
Following an internal review, staff determined that statutory publication and notice
requirements under Section 211.006 of the Texas Local Government Code were not
fully met in advance of the May 6th hearing. In order to ensure legal compliance and public
transparency, a second public hearing is required.
Budget Impact:
None
Recommendation:
Staff recommend that the City Council adopt the attached resolution authorizing and
scheduling a second public hearing to consider the proposed zoning text amendment.
The City Secretary's Office, Law Department, and Planning Staff will ensure that all
required notice and publication requirements are met prior to the new hearing.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR, TEXAS, REQUESTING A SECOND PUBLIC HEARING TO
CONSIDER A ZONING TEXT AMENDMENT TO APPENDIX A, SECTION
3. LAND USES, TO ALLOW AUTOMOBILE-RELATED USE TYPES IN
LIGHT INDUSTRIAL (LI) AND HEAVY INDUSTRIAL (HI) ZONED
DISTRICTS THROUGHOUT THE CORPORATE CITY LIMITS, IN
ACCORDANCE WITH CHAPTER 211 OF THE TEXAS LOCAL
GOVERNMENT CODE.
Z25-02 (CITY OF PORT ARTHUR)
WHEREAS, the City Council of the City of Port Arthur, Texas, is authorized under
Chapter 211 of the Texas Local Government Code to regulate zoning and land use within
the corporate limits of the city; and
WHEREAS, the City of Port Arthur is considering a zoning text amendment to allow
automobile-related use-types within Light Industrial (LI) and Heavy Industrial (HI) zoning
districts throughout the city; and
WHEREAS, the City Council conducted a public hearing on May 6, 2025, at 6:00
p.m., to receive public input on the proposed amendment; and
WHEREAS, due to publication requirements not being met in accordance with
Section 211.006 of the Texas Local Government Code, a second public hearing is
necessary to ensure full compliance with statutory notification and publication provisions;
and
WHEREAS, the City Council finds that the holding of a second public hearing will
promote transparency and provide additional opportunity for public participation in the
zoning amendment process.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:

Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the notice of the public hearing for the Planning and Zoning
Commission was published in the newspaper of general circulation in the City of Port
Arthur on January 18, 2025, and included in the utility billing statement mailouts for
January 2025, as delineated in Exhibit "A".
Section 3. That the City Council hereby directs that a second public hearing be
scheduled and held on July 29, 2025, at 6:00 p.m. in the City Council Chambers, Fifth
Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by telephonic and videoconference,
to consider a proposed zoning text amendment to Appendix A, Section 3. Land Uses, to
allow automobile-related use-types in Light Industrial (LI) and Heavy Industrial (HI) zoned
districts throughout the corporate city limits of Port Arthur, Texas.
Section 4. That the public hearing shall be conducted in accordance with the
requirements of Chapter 211 of the Texas Local Government Code, including but not
limited to Section 211.006 regarding publication and notice.
Section 5. That notice of the public hearing shall be published at least fifteen days
prior in the City's official newspaper before going to the City Council.
Section 6. That a copy of the caption of this Resolution is spread upon the Minutes
of the City Council.
