Duriso, Chief of Police 'y RE: PR 24192- Multiple Use Agreement between the Texas Department of Transportation and the Port Arthur Police Department regarding the usage of pole-mounted license plate reader(LPR) on the highway right of way Introduction: The purpose of this memorandum is to request City Council approval of a resolution authorizing the City Manager,or his designee,to enter into a Multiple Use Agreement,including the attached supplemental agreement with the Texas Department of Transportation (TxDOT). This agreement will permit the City to install and operate Automated License Plate Recognition (ALPR) cameras within TxDOT-managed right-of-ways. Background: The City of Port Arthur has entered into a service agreement with Flock Safety to acquire,install, and operate ALPR cameras to enhance law enforcement's ability to detect,deter, and investigate criminal activity. Funding for twelve(12) ALPR cameras was approved in the FY2025 Budget. Certain high-priority locations identified for camera placement fall within TxDOT right-of-way. As a condition of permitting, TxDOT requires that the City execute a Multiple Use Agreement along with the attached supplemental agreement and submit a council-authorized resolution, along with additional documentation, to the Texas Department of Public Safety. This documentation must include a letter of intended use and a copy of the Port Arthur Police Department's ALPR policy. Budget Impact: There is no additional fiscal impact. Funding for the equipment and installation was previously approved in the FY 2025 budget. Recommendation: It is recommended that the City Council authorize the City Manager,or his designee,to execute the Multiple Use Agreement and all corresponding documentation with TxDOT.This action will enable the City to proceed with the installation of ALPR cameras in critical corridors located on state right-of-ways. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A MULTIPLE USE AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE INSTALLATION AND OPERATION OF AUTOMATED LICENSE PLATE RECOGNITION (ALPR) CAMERAS WITHIN STATE RIGHT-OF-WAY; PROVIDING RELATED AUTHORIZATIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Port Arthur has entered into an agreement with Flock Safety for the acquisition,installation,and ongoing operation of automated license plate recognition(ALPR) cameras as part of a citywide initiative to enhance public safety and support law enforcement efforts; and WHEREAS,the City Council has duly appropriated funds in the Fiscal Year 2025 Budget for the purchase and strategic deployment of twelve(12)ALPR cameras; and WHEREAS, one or more of the proposed camera locations are situated within the right- of-way of state-maintained highways,which are under the jurisdiction of the Texas Department of Transportation(TxDOT); and WHEREAS, the installation of ALPR cameras within TxDOT right-of-way necessitates the execution of a Multiple Use Agreement, including its attached supplemental agreement and related permit, in accordance with TxDOT policies procedures; and WHEREAS, the permitting process further requires formal authorization by the City Council designating the City Manager, or his designee, to act on behalf of the City in all matters related to the execution of said agreement, and the submission of requisite documentation to TxDOT and the Texas Department of Public Safety, including a supplemental agreement , a letter describing the intended use of the ALPR system and a copy of the Port Arthur Police Department's applicable ALPR operational policy; and WHEREAS, the installation and operation of ALPR technology at key ingress and egress points on state roadways is in the best interest of public welfare and directly supports the City's ongoing efforts to prevent crime, enhance situational awareness, and protect the life, health, and safety of its residents; and WHEREAS, the City Council finds that authorizing entry into the Multiple Use Agreement is consistent with the City's mission to promote public safety and law enforcement effectiveness. NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,TEXAS: P.R. No. 24192 06/25/2025 JLH Section 1. That the recitals set forth above are hereby found to be true and correct and are adopted as findings of the City Council. Section 2. That the City Manager, or his designee, is hereby authorized to execute a Multiple Use Agreement with the Texas Department of Transportation for the purpose of permitting the installation and operation of automated license plate recognition (ALPR) cameras within TxDOT right-of-way. Section 3. That a copy of the fully executed agreement shall be attached hereto as Exhibit A. Section 4.That the City Manager,or his designee,is further authorized to prepare, execute, and submit all ancillary documents required to complete the permitting process with TxDOT and the Texas Department of Public Safety, including any correspondence, certifications, and policy documentation as may be necessary. Section 5. That the caption of this Resolution shall be spread upon the minutes of the City Council. WITNESSETH WHEREAS, on the day of , 20 25 , the governing body for the City entered into Resolution/Ordinance No. hereinafter identified by reference,authorizing the City 's participation in this agreement with the State;and WHEREAS, the City has requested the State to permit the construction, maintenance and operation of a public Pole Mounted License Plate Reader on the highway right of way, (ROADWAY SH 87 From FM347 CONTROL SECTION NO. 0306-03 ). (General description of area including either the control number or GPS coordinates.) Gulfway Dr From Jefferson Drive Port Arthur, TX(GPS 29.919334,-93.909628) shown graphically by the preliminary conceptual site plan in Exhibit"A"and being more specifically described by metes and bounds of Exhibit"B",which are attached and made a part hereof;and WHEREAS, the State has indicated its willingness to approve the establishment of such facilities and other uses conditioned that the City will enter into agreements with the State for the purpose of determining the respective responsibilities of the City and the State with reference thereto, and conditioned that such uses are in the public interest and will not damage the highway facilities, impair safety, impede maintenance or in any way restrict the operation of the highway facility, all as determined from engineering and traffic investigations conducted by the State. Form 2044(Rev.8/21) Page 2 of 10 AGREEMENT NOW, THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed as hereinafter set forth, it is agreed as follows: 1. DESIGN AND CONSTRUCTION City will prepare or provide forthe construction plans forthe facility,and will provide for the construction work as required by said plans at no cost to the State. Said plans shall include the design of the access control, necessary horizontal and vertical clearances for highway structures, adequate landscape treatment,adequate detail to ensure compliance with applicable structural design standards,sufficient traffic control provisions,and general layout.They shall also delineate and define the construction responsibilities of both parties hereto. Completed plans will be submitted to State for review and approval and when approved shall be attached to the agreement and made a part thereof in all respects. Construction shall not commence until plans have been approved by the State. Any future revisions or additions shall be made after prior written approval of the State. Any sidewalks, curb ramps and other pedestrian elements to be constructed, either on site or off site, by the City shall be in accordance with the requirements of Title II of the Americans With Disabilities Act(ADA)and with the Texas Accessibility Standards(TAS). Elements constructed by the City and found not to comply with ADA or TAS shall be corrected at the entire expense of the- City 2. INSPECTION Ingress and egress shall be allowed at all times to such facility for Federal Highway Administration personnel and State Forces and equipment when highway maintenanceoperations are necessary, and for inspection purposes;and upon request,all parking or other activities for periods req u ired for such operations will be prohibited. 3. PARKING REGULATIONS Parking regulations shall be established limiting parking to single unit motor vehicles of size and capacity no greater than prescribed for 11/2 ton trucks, such vehicles to conform in size and use to governing laws. Parking shall be permitted only in marked spaces. Parking shall be prohibited when a security threat, as determined by TxDOT, exists. Form 2044(Rev.8/21) Page 3 of 10 4. PROHIBITION/SIGNS Regulations shall be established prohibiting the parking of vehicles transporting flammable or explosive loads and prohibiting use of the area in any manner for peddling, advertising or other purposes not in keeping with the objective of a public facility.The erection of signs other than those required for proper use of the area will be prohibited.All signs shall be approved by the State prior to the actual erection. 5. RESPONSIBILITIES Timely maintenance, repair and operation of the facility shall be entirely the responsibility of the City . Such responsibility shall not be transferred, assigned or conveyed to a third party without the advanced written approval of the State.These responsibilities expressly include the timely maintenance and repair of any portion of the facility necessary to comply with the Americans with Disabilities Act. Further, such responsibility shall include picking up trash, mowing and otherwise keeping the facility in a clean and sanitary condition,and surveillance by police patrol to eliminate the possible creation of a nuisance or hazard to the public. Hazardous or unreasonably objectionable smoke,fumes,vapor or odors shall not be permitted to rise above the grade line of the highway, nor shall the facility subject the highway to hazardous or unreasonably objectionable dripping, droppings or discharge of any kind, including rain or snow. If the State determines that City has failed to comply with these responsibilities, it will perform the necessary work and charge City the actual cost of the work. 6. FEES Any fees levied for use of the facilities in the area shall be nominal and no more than are sufficient to defray the cost of construction, maintenance and operations thereof,and shall be subject to State approval. A. Retention Period. The City shall maintain all books, documents, papers, accounting records and other evidence pertaining to fees collected and costs (hereinafter called the Records). The City shall make the records available during the term of the Agreement and for four years from the date the Agreement is terminated, until completion of all audits, or until pending litigation has been completely and fully resolved,whichever occurs last. B. Audit Report. If fees are collected by the City for the use of the facility under this agreement, the City will provide the State an annual audit report detailing the fees collected for the use of the facility and the costs associated with constructing, maintaining, and operating the facility within the same period. If the report shows more fees collected than expenses for the construction,operation,or maintenance of the facility the City must provide a multiple year plan detailing how the additional revenue will be used for construction, operation, or maintenance of the facility. The State or any of its duly authorized representatives, the Federal Highway Administration, the United States Department of Transportation,Office of Inspector General, and the Comptroller General shall have access to the City 's records that are directly pertinent to this Agreement for the purpose of making audits and examinations. 7. TERMINATION UPON NOTICE This provision is expressly made subject to the rights herein granted to both parties to terminate this agreement upon notice,and upon the exercise of any such right by either party,all obligations herein to make improvements to said facility shall immediately cease and terminate and City shall be responsible for the facility's timely removal at no cost to the State. If the State determines that City has failed to timely remove the facility, it will perform the necessary work and charge City the actual cost of the work. 8. MODIFICATION/TERMINATION OF AGREEMENT If in the sole judgment of the State it is found at any future time that traffic conditions have so changed that the existence or use of the facility is impeding maintenance, damaging the highway facility, impairing safety or that the facility is not being properly operated, that it constitutes a nuisance, is abandoned, or if for any other reason it is the State's judgment that such facility is not in the public interest,this agreement under which the facility was constructed may be: (1) modified if corrective measures acceptable to both parties can be applied to eliminate the objectionable features of the facility; or(2)terminated and the use of the area as proposed herein discontinued. 9. PROHIBITION OF STORAGE OF FLAMMABLE MATERIALS All structures located or constructed within the area covered by the agreement shall be fire resistant. The storage of flammable,explosive or hazardous materials is prohibited. Operations deemed to be a potential fire hazard shall be subject to regulation by the State. 10. RESTORATION OF AREA The City shall provide written notification to the State that such facility will be discontinued forthe purpose defined herein. The City shall, within thirty(30)days from the date of said notification, clear the area of all facilities that were its construction responsibility under this agreement and restore the area to a condition satisfactory to the State. 11. PREVIOUS AGREEMENTS It is understood that this agreement in no way modifies or supersedes the terms and provisions of any existing agreements between the parties hereto. INDEMNIFICATION THE City WILL INDEMNIFY THE STATE AGAINST ANY AND ALL DAMAGES AND CLAIMS FOR DAMAGES, INCLUDING THOSE RESULTING FROM INJURY OR DEATH OF PERSONS OR FOR LOSS OF OR DAMAGE TO PROPERTY, ARISING OUT OF, INCIDENT TO OR IN ANY MANNER CONNECTED WITH THE CONSTRUCTION, OPERATION OR MAINTENANCE OF THE FACILITY, WHICH INDEMNIFICATION SHALL EXTEND TO AND INCLUDE ANY AND ALL COURT COSTS, ATTORNEY'S FEES AND EXPENSES RELATED TO OR CONNECTED WITH ANY CLAIMS OR SUITS FOR DAMAGES AND SHALL, IF REQUESTED IN WRITING BY THE STATE TO DO SO, ASSIST THE STATE OR RELIEVE THE STATE FROM DEFENDING ANY SUCH SUITS BROUGHT AGAINST IT. THE INDEMNIFICATION OF THE STATE SHALL EXTEND FOR A PERIOD OF TWO (2) YEARS BEYOND THE DATE OF TERMINATION OF THIS AGREEMENT. DURING EACH YEAR WHILE THERE IS ANY LIABILITY BY REASON OF THE AGREEMENT CONTAINED IN THIS SUBSECTION OF THIS RESOLUTION,INCLUDING THE CALENDAR YEAR 2025 ,THE City of Port Arthur (CITY)SHALL COMPUTE AND ASCERTAIN THE RATE AND AMOUNT OF AD VALOREM TAX, BASED ON THE LATEST APPROVED TAX ROLLS OF SAID ENTITY, WITH FULL ALLOWANCES BEING MADE FOR TAX DELINQUENCIES AND COSTS OF TAX COLLECTION, WHICH WILL BE SUFFICIENT TO RAISE AND PRODUCE THE MONEY REQUIRED TO PAY ANY SUMS WHICH MAY BE OR BECOME DUE DURING ANY SUCH YEAR,IN NO INSTANCE TO BE LESS THAN TWO(2%)PER CENT OF SUCH OBLIGATION, TOGETHER WITH INTEREST THEREON,BECAUSE OF THE OBLIGATION HEREIN ASSUMED. SAID RATE AND AMOUNT OF AD VALOREM TAX IS HEREBY ORDERED TO BE LEVIED AND IS HEREBY LEVIED AGAINST ALL TAXABLE PROPERTY IN SAID ENTITY FOR EACH YEAR WHILE ANY LIABILITY EXISTS BY REASON OF THE OBLIGATION UNDERTAKEN BY THIS SUBSECTION OF THIS RESOLUTION,AND SAID AD VALOREM TAX SHALL BE ASSESSED AND COLLECTED EACH SUCH YEAR UNTIL ALL OF THE OBLIGATIONS HEREIN INCURRED SHALL HAVE BEEN DISCHARGED AND ALL LIABILITY HEREUNDER DISCHARGED. No party to this agreement intends to waive, relinquish,limit or condition its general governmental immunity from liability in any way. Each party agrees and acknowledges that it is not an agent,servant,or employee of the other party and that under this provision each party is responsible only for its own acts and for those of its agents, servants,independent contractors or employees. Such responsibility includes,but is not Form 2044(Rev.8/21) Page 6 of 10 limited to any claims or amounts arising or recovered under the"Workers Compensation Law,"the Texas Tort Claims Act, Chapter 101, Texas Civil Practice and Remedies Code; or any other applicable laws o r regulations, all as time to time may be amended. Nothing in this agreement shall be construed as creating any liability in favor of any third party against the State and the City . Additionally,this agreement shall not ever be construed as relieving any third party from any liability against the State. Furthermore, the City shall become fully subrogated to the State's rig hts of recovery and shall be entitled to maintain any action over and against any third party who may be liable for damages. The State agrees to execute and deliver instruments and papers and to otherwise do that which is necessary to secure such rights. 13. INSURANCE The City , shall provide necessary safeguards to protect the public on State maintained highways including adequate insurance for payment of any damages which might result during the construction, maintenance, repair and operation of the facility. City shall include TxDOT as an additional insured by endorsement in City ,s commercial general liability insurance policy. Prior to beginning work on the State's right of way,the City 's construction contractor shall submit to the State a completed insurance form (TxDOT Form No. 1560)or appropriate certificate of self-insurance and shall maintain the required coverage during the construction of the facility. 14. USE OF RIGHT OF WAY It is understood that the State by execution of this agreement does not impair or relinquish the State's right to use such land for highway purposes when it is required for the construction or re-construction of the traffic facility for which it was acquired, nor shall use of the land under such agreement ever be construed as abandonment by the State of such land acquired for highway purposes, and the State does not purport to grant any interest in the land described herein but merely consents to such use to the extent its authority and title permits. 15. ADDITIONAL CONSENT REQUIRED The State asserts only that it has sufficient title for highway purposes. The City shall be responsible for obtaining such additional consent, permits or agreement as may be necessary due to this agreement. This includes, but is not limited to, appropriate permits and clearances for environmental, ADA and public utilities. 16. FHWA ADDITIONAL REQUIREMENTS If the Facility is located on the Federal-Aid Highway System, "ATTACHMENT A", which states additional requirements as set forth in the Federal Highway Administration's Title 23, Code of Federal Regulations,§710, shall be attached to and become a part of this agreement. Form 2044(Rev.8/21) Page 7of10 17.CIVIL RIGHTS ASSURANCES The City for itself, its personal representatives, successors and interests and assigns, as part of the consideration hereof, does hereby covenant and agree as a covenant running with the land that: (1) no persons, on the grounds of race, color, sex, age, national origin, religion or disabling condition,shall be excluded from participation in, be denied the benefits of,or be otherwise subjected to discrimination in the use of said facility; (2)that in the construction of any improvements on, over or under such land and the furnishing of services thereon, no person on the ground of race, color, sex, age, national origin, religion or disabling condition, shall be excluded from participation in, denied the benefits of,or otherwise be subjected to discrimination; (3)that the City shall use the premises in compliance with all other requirements imposed by or pursuant to Title 49, Code of Federal Regulations, Department of Transportation,Subtitle A, Office of the Secretary, Part 21, Non-discrimination in Federally-Assisted programs of the Department of Transportation-Effectuation of Title VI of the Civil Rights Act of 1964, and as said Regulations may be amended. That if in the event of any breach of the above non-discrimination covenants,the State shall have the right to terminate the agreement and reenter and repossess said land and the facilities thereon, and hold the same as if said agreement had never been made or issued. 18. AMENDMENTS Any changes in the time frame,character or responsibilities of the parties hereto shall be enacted by a written amendment executed by both parties hereto. 19. LEGAL CONSTRUCTION In case one or more of the provisions contained in this agreement shall for any reason be held invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any provision hereof and this agreement shall be construed as if such invalid, illegal, or unenforceable provision had never been contained in thisagreement. 20. AUDIT The State may conduct an audit or investigation of any aspect of this agreement. The City must provide the State with access to any information the State considers relevant to the investigation or audit. The audit can include, but is not limited to, any contract for construction or maintenance of any facility or structure authorized by this agreement or any contract to provide a service to the City if that service is authorized by this agreement. AUTHORITY OF STATE AUDITOR The state auditor may conduct an auditor investigation of any entity receiving funds from the state directly under the contract or indirectly through a subcontract under the contract. Acceptance of funds directly under the contract or indirectly through a subcontract under this contract acts as acceptance of the authority of the state auditor, under the direction of the legislative audit committee, to conduct an audit or investigation in connection with those funds. An entity that is the subject of an audit or investigation must provide the state auditor with access to any information the state auditor considers relevant to the investigation or audit. 22. TIMELY PAYMENT When required by any provision of this agreement requires a payment to be made to the State, the other party hereto shall within thirty(30)days from receipt of the State's written notification pay the State for the full cost of repairing any damages to the highway facility which may result from the other party's construction, maintenance, repair or operation of the facility. 24. WARRANTS The signatories to this agreement warrant that each has the authority to enter into this agreement on behalf of the party represented. Any significant revision in the design or construction of the facility shall receive prior approval by the Texas Department of Transportation subject to concurrency by the FHWA. 2. Any change in the authorized use of real property interest shall receive prior approval by the Texas Department of Transportation subject to concurrence by the FHWA. 3. Real property interest shall not be transferred,assigned or conveyed to another party without prior Texas Department of Transportation approval subject to concurrence by the FHWA. 4. This agreement will be revocable in the event that the real property interest facility ceases to be used or is abandoned. The Department of Public Safety agrees to maintain, operate, and manage a file of vehicle license plate information exported from the Texas Crime Information Center (TCIC) for the use of the User Agency. 4. The Department of Public Safety will ensure that. except in extraordinary circumstances. the file will be updated hourly. The file name will incorporate the date and time the file was created. 5. The User Agency recognizes there are inherent limitations in matching against data updated hourly. Therefore. if the User Agency gets a "hit" on the exported TCIC information, the User Agency agrees to conduct a real-time check of TCIC records to confirm that the hit record still exists in the live TCIC file. The User Agency will follow all Texas Crime Information Center/National Crime Information Center(TCIC/NCIC) policies for handling hits. 6. The Department of Public Safety or the User Agency may. upon 30 days notice, in writing, terminate this agreement. TX 78765-4143 TEXAS DEPARTMENT OF PUBLIC SAFETY CRIME RECORDS SERVICES LICENSE PLATE READER 1LPR1 USER AGREEMENT This document constitutes a User Agreement which sets forth the duties and responsibilities of the User Agency in order to gain access to the Texas Automated License Plate Reader (LPR) Database administered by the Texas Department of Public Safety(TXDPS). The User Agency shall be a criminal justice or law enforcement agency. USER AGENCY: Port Arthur Police Department ADDRESS: P.O. Box 1089, Port Arthur, Texas 77641 The LPR Database shall consist of shared data from all participating local, state, and federal agencies, as well as TXDPS captured data,of the following information associated with a license plate captured by an LPR: license plate numbers;latitude and longitude coordinates indicating where the plate was captured;date/time of the capture;and Originating Agency Identifier(ORI)information of the agency capturing the information. The LPR Database shall be maintained,operated,and managed by TXDPS on a 24 hour,7 days a week,365 days a year basis. A. USER AGENCY RESPONSIBILITIES 1. The User Agency may only access and use LPR information for official criminal justice purposes. LPR information shall not be accessed or used for any other purpose. 2. The User Agency shall allow TXDPS to share the User Agency's data contributed to the LPR Database with other authorized criminal justice or law enforcement agencies. 3. The User Agency shall provide its own internet connectivity and maintenance which meets Criminal Justice Information Services(CJIS)Security Policy requirements. 4. The User Agency shall retain sole ownership of, sole responsibility for, and exclusive control over the content of the information that it contributes to the LPR Database. S. The User Agency shall,at will and at any time,update,correct,or delete the information that it contributes to the LPR Database. 6. The User Agency has the sole responsibility to ensure that the information it contributes to the LPR Database was not obtained and is not maintained in violation of any federal,state,or local law applicable to that agency. 7. The User Agency has sole responsibility and accountability for ensuring compliance with all laws, regulations, policies, and procedures applicable to its entry and sharing of information into the LPR Database, including but not limited to the federal Driver's Privacy Protection Act (18 U.S.C. §2721 et seq.) and the Texas Motor Vehicle Records Disclosure Act(Tex.Transp.Code Ch.730). 8. The User Agency shall duly report to TXDPS,in writing,any instance in which LPR information is used in an unauthorized manner. Such notice shall be provided immediately,but no later than three(3) calendar days of when the User Agency first learned of the unauthorized use. 9. The User Agency has the duty, sole responsibility, and accountability to make reasonable efforts to ensure the accuracy,upon entry and continuing thereafter,of information that it contributes to the LPR Database. 10. The User Agency is solely responsible for the actions or omissions of its employees and officers. 11. The User Agency shall permit access to the LPR Database only to individual users who meet standard Texas Law Enforcement Telecommunications System (TLETS)credentials. TXDPS shall notify the User Agency if it receives a challenge to or reasonable question about the accuracy of the information submitted by the User Agency in the LPR Database. 2. The minimum retention period for information to remain in the LPR Database shall be three (3) years, unless the User Agency indicates to TXDPS that a shorter retention period is required. 3. TXDPS will provide system training to the LPR Database users at no charge to the User Agency at a time and location to be designated by TXDPS. The obligation of TXDPS to incur training costs is conditional upon sufficient funds budgeted and available. No financial liability shall be incurred by TXDPS by virtue of this User Agreement beyond monies available to it for the purpose of fulfilling this User Agreement. 4. TXDPS reserves the right to immediately suspend service to the User Agency or an individual user when applicable policies are violated. Service may be reinstated, in TXDPS' sole discretion, upon receipt of satisfactory assurance that such violations have been corrected. All costs for reconnection service are the responsibility of the User Agency. 5. TXDPS shall have the authority to inspect and audit the equipment, records, and operations of the User Agency to determine the User Agency's compliance with standards and requirements associated with TLETS,Texas Crime Information Center(TCIC)/National Crime Information Center(NCIC),and of this User Agreement throughout the term and for a period of four (4) years after the termination of this User Agreement. The User Agency shall maintain records regarding the use and dissemination of information in the LPR Database and shall provide such records to TXDPS immediately upon its request. 6. Any waiver of any breach or default of this User Agreement by TXDPS shall not constitute a waiver of any subsequent breach or default or a waiver of the provision itself. C. DURATION AND TERMINATION 1. This User Agreement is effective upon the date it is signed by the User Agency and shall remain in effect until terminated by TXDPS or the User Agency. 2. This User Agreement may be terminated at any time upon the mutual written consent of TXDPS and the User Agency. 3. TXDPS or the User Agency may terminate this User Agreement for convenience upon thirty (30) calendar days written notice to the other party. 4. TXDPS may terminate this User Agreement if the User Agency fails to comply with any provision of this User Agreement or is otherwise in default by providing written notice to terminate, which termination shall become effective immediately upon the User Agency's receipt of the notice. 5. In no event will termination by TXDPS give rise to any liability whatsoever on the part of TXDPS. 6. All rights, obligations,responsibilities,limitations,and other understandings with respect to the disclosure and use of all information by the User Agency as described in this User Agreement shall survive any termination. D. POLICY The License Plate Recognition(LPR)system will aid officers in ensuring the safety of our community. The LPR system identifies license plates and will not identify the person operating the motor vehicle. The Department may, as a separate step and for legitimate law enforcement purposes per the Federal Driver's Privacy Protection Act, and as set forth in this Policy, undertake to identify the owner of a vehicle in the event the LPR system generates an alert, such as by running the license plate number through the State's Department of Motor Vehicle(DMV)database. It shall be the policy of this Department that all Department members abide by the policy and its procedures set forth when using the LPR system,thereby increasing the efficiency and effectiveness of its public safety efforts in a manner that safeguards the privacy concerns of law-abiding citizens. II. PURPOSE The purpose of this Department policy is to establish guidelines for officers utilizing the License Plate Recognition (LPR) system. This policy will further establish guidelines for the deployment and actions permissible when using the system. The LPR system shall be restricted to legitimate law enforcement uses for the purpose of furthering law enforcement goals and enhancing public safety. Such uses and goals include, but are not limited to, providing information to officers that will assist in on-going criminal investigations, crime prevention, crime detection, the apprehension of wanted persons, ensuring the safety of vulnerable individuals through the recovery of missing and endangered persons, and improving the quality of life in our community through the identification and removal of stolen, unregistered, and uninsured motor vehicles. The Department shall utilize hot lists that further the above-specified goals of the LPR system where there is a legitimate and specific law enforcement reason for identifying a vehicle associated with an outstanding arrest warrant; vehicles related to missing persons investigations; vehicles associated with AMBER Alerts; stolen vehicles;vehicles that are reasonably believed to be involved in the commission of a crime; vehicles that are registered to or are reasonably believed to be operated by persons who do not have a valid operator's license or who are on the revoked or suspended list;vehicles with expired registrations;vehicles registered to persons who are subject to a restraining order issued by a court or by the Parole Board, or who are subject to any other duly issued order restricting their movements; vehicles registered to persons wanted by a law enforcement agency who are of interest in a specific investigation;and vehicles registered to persons who are on any watch list issued by a State or Federal agency responsible for homeland security when information has been received concerning a specific individual. III. DEFINITIONS A. LPR System —The system in its entirety, including all LPR cameras, software, and collected date. An LPR system is a computer-based system that utilizes special cameras to capture license plate information. The LPR system captures an infared image of a license plate and coverts it to a text file using Optical Character Recognition ("OCR") technology. The text is compared to various hot lists generated by local, state, and federal law enforcement agencies, including the National Crime Information Center("NCIC"), and generates an alert when there is a hit. B. Alert—An audible and/or visual signal activated upon the read of a license plate by the LPR system that has NOT BEEN VISUALLY VERIFIED by the officer against the photo in the LPR system. C. Tentative Hit — An alert by the LPR system that HAS BEEN VISUALLY VERIFIED by the officer against the LPR hotlist and photo HAS NOT BEEN VALIDATED by the officer or dispatch as a live query transaction OR CONFIRMED AS VALID with the original entering agency. PORT ARTHUR POLICE DEPARTMENT LPR POLICY AND PROCEDURES D. Live Query Transaction—A hit by the LPR system that HAS BEEN VALIDATED as active but HAS NOT BEEN CONFIRMED as valid by the entering agency. E. Confirmation (Confirmed Hit)—A hit by the LPR system that HAS BEEN CONFIRMED as valid and active by the original entering agency through secondary check. F. Hotlist— Data filed extracted from the law enforcement databases which contain a listing of stolen license plates, stolen vehicles, wanted persons, and other vehicles/persons actively being sought by a law enforcement agency such as Amber/Silver Alert vehicle/persons. These data extracts are generally facilitated at numerous times per day to provide current data. G. VSLEA— Vigilant Solutions Law Enforcement Academy —An Online on-demand website to learn about the LPR system and tools to enhance investigation with the LPR system. IV. PROCEDURE A. Management 1. The Department, by and through its Chief, is solely responsible for the day-to-day operation and management of the LPR system and for all tasks ancillary to its operation and management. The Chief shall assign Department personnel to operate and manage the LPR system on a day-to-day basis. 2. The Chief shall ensure that the LPR system is operated in conformity with this policy and other Department policies, procedures,rules,and regulations.The Chief shall enforce this Policy and shall act as the Department Head for all disciplinary and enforcement actions for any violations by Department personnel. B. Training 1. Training is available for anyone interested in gaining further knowledge of the LPR system in Vigilant Solutions Law Enforcement Academy (VSLEA). Installation and Functioning.The LPR cameras will be mounted on a marked cruiser,unmarked vehicle, and/or mounted in a stationary location. The LPR equipment will passively read the license plates of moving or parked motor vehicles using LPR optical character recognition • PORT ARTHUR POLICE DEPARTMENT LPR POLICY AND PROCEDURES technology and compare them against various hot lists uploaded or created by the Police Department. Scanned data files collected by the system will, on an ongoing basis, be automatically uploaded from the LPR camera to the Department's LPR database. 2. Hot Lists. Designation hot lists to be utilized by the LPR system shall be made by the Chief or his/her designee. Hot lists shall be obtained or compiled from sources as may be consistent with the purposes of the LPR system set forth in this Policy. These sources may include: a. NCIC Stolen Vehicle files, as available b. NCIC Stolen plates and Stolen Canadian plates, as available c. NCIC Wanted persons, as available d. NCIC Missing or Endangered person files, as available e. NCIC Supervised Release(Federal Probationers), as available f. NCIC Nationwide Domestic Violence Protection Orders, as available g. NCIC Violent Gang and Terrorist Organization File, as available h. NCIC Sexual Offender i. DMV Records of Suspended/Revoked Registrations j. Department-generated hot list(s)or manual entries of license plate numbers to existing hot list(s)created for purposes consistent with this Special Order as may be authorized by the Chief or his/her designee. 3. Login-Log-Out Procedure. To ensure proper operation and facilitate oversight of the LPR system, all users will be required to have individual credentials for access and use of the systems and/or data. 4. Auditing and Oversight. To ensure proper oversight into the use of the system and adhere to this policy, all activities (plate detections, queries, reports, etc.) are automatically recorded by the system for auditing purposes. 5. Permitted/Impermissible Uses. a. The LPR system and all data collected is the property of the Department. Department personnel may only access and use the LPR system for official and legitimate law enforcement purposes consistent with this Poles b. The following uses of the SLPR system are specifically prohibited: 1) Invasion of Privacy. Except when done pursuant to a court order, it is a violation of this Policy to utilize the LPR to record license plates except those of vehicles that are exposed to public view(e.g., vehicles on a public road, street, or that are on private property but whose license plate(s)are visible from a public road, street, or a place to which members of the public have access, such as the parking lot of a shop or other business establishment). 2) Harassment or Intimidation. It is a violation of this Policy to use the LPR system to harass and/or intimidate any individual or group. 3) Personal Use. It is a violation of this Policy to use the LPR system or associated scan files or hot lists for any personal purpose. 4) Anyone who engages in an impermissible use of the ALPR system or associated scan files or hot lists may be subject to: a) Criminal prosecution, b) Liability and/or c) Administrative sanctions, including termination, pursuant to and consistent with the relevant collective bargaining agreements and Department policies. 7. The file of TCIC information is provided to the User Agency for criminal justice purposes only. Furthermore. the User Agency agrees that the file created by the Department remains a TCIC file and will handle the information in the file and all activities related to the information in the file according to existing and future TCIC/NCIC policies. 8. The User Agency agrees to indemnify and save harmless.to the extent the law allows. the Texas Department of Public Safety, its Director and employees from and against any and all claims, demands, actions and suits, including but not limited to any liability for damages by reason of or arising out of any false arrest or imprisonment or any cause of action whatsoever, arising out of or involving any negligence on the part of the User Agency or its employees in the exercise or enjoyment of the Agreement. 9. No financial liability will be incurred by the Department of Public Safety by virtue of this agreement beyond monies available to it for the purpose of fulfilling this agreement. 10. Each party to this agreement agrees that it shall have no liability whatsoever for the actions and/or omissions of the other party's employees, officers, or agents. regardless of where the individual's actions and/or omissions occurred. Each party is solely responsible for the actions and/or omissions of its employees, officers, and agents: however, such responsibility is only to the extent required by Texas law. Where injury or property damage result from the joint or concurring acts and/or omissions of the parties. any liability shall be shared by each party in accordance with the applicable Texas law, subject to all defenses, including governmental immunity. These provisions are solely for the benefit of the parties hereto and not for the benefit of any person or entity not a party hereto; nor shall any provision hereof be deemed a waiver of any defenses available by law. 11. No modification or amendment to this agreement shall become valid unless in writing and signed by both parties. 12. This agreement constitutes the entire agreement between the parties with regard to the matters made the subject of this agreement. There are no other verbal or written covenants, agreements, understandings, representations. warranties, or restrictions between the parties. No rights or obligations shall be implied. 13. Neither party may assign or transfer this agreement or any interest in this agreement without the written consent of the other party. 14. Port Arthur PD agrees to the following supplemental terms and conditions: A. VALIDATION OF LEGITIMATE LAW ENFORCEMENT PURPOSE 1. Port Arthur PD certifies that it has completed TxDPS's verification process by providing all necessary information required for TxDPS to verify whether Port Arthur PD has a legitimate law enforcement purpose for the use of LPR cameras within the highway right of way. 2. Port Arthur PD further certifies that TxDPS has provided Port Arthur PD with a validation letter verifying and approving the Port Arthur PD's use of LPR cameras within the highway right of way for a legitimate law enforcement purpose. The Port Arthur PD shall provide TxDOT a copy of the validation letter, which is to be attached to this Supplemental Agreement and further attached to the Agreement. B. DATA USAGE,SHARING,AND STORAGE 1. "TxDPS LPR System" shall be defined as a system and/or network of LPR cameras installed on the highway right of way,consisting of data captured by TxDPS LPR cameras and data captured by any participating local,state,and federal agencies, if any,that is maintained,operated,and managed by TxDPS. 2. "LPR data" shall be defined as any and all information, including but not limited to,all images, locations, dates, and times, captured by LPR cameras operated, maintained, and installed within the highway right of way by_Port Arthur PD. In the event Port Arthur PD's LPR cameras are made part of TxDPS's LPR System "LPR data" shall also be defined to include all information, including but not limited to, all images, locations, dates, and times, captured by cameras installed, operated, and maintained by TxDPS, and/or other criminal justice or law enforcement agencies cooperating with the TxDPS LPR System. 3. All LPR data shall be owned, maintained, and stored by Port Arthur PD or, if the LPR cameras are part of the TxDPS LPR System, by TxDPS or a criminal justice or law enforcement agency cooperating with the TxDPS LPR System. 4. LPR data shall only be accessed, used, published, exchanged, or otherwise transferred by and to law enforcement or criminal justice personnel and strictly for law enforcement purposes. LPR data shall not be accessed by, used,sold, published, exchanged, or otherwise transferred to any commercial or private entity or individual for any reason. If LPR data is currently, or later discovered to be, accessible by commercial or private entities or individuals, access to such entities or individuals shall be immediately terminated. If such accessibility is not immediately terminated,TxDOT may, at its sole discretion, require the immediate removal of the LPR cameras from the highway right of way and terminate the Agreement. 5. The use, sharing, and storage of LPR data shall comply with all applicable local, state, and federal laws and regulations. C. COMPLIANCE WITH SUPPLEMENTAL TERMS 1. Port Arthur PD shall comply with the terms and conditions of this Supplemental Agreement. 2. Port Arthur PD shall require any vendor it employs to assist in the operation and maintenance of its LPR cameras to comply with the terms and conditions of this Supplemental Agreement, as well as all local, state, and federal laws and regulations. 3. Port Arthur PD shall, upon request, certify compliance with the terms and conditions of this Supplemental Agreement and provide any and all information requested by TxDOT to ensure compliance with this Supplemental Agreement at no cost to TxDOT. 4. Port Arthur PD acknowledges and agrees that any violation of the above terms and conditions may, at the sole discretion of TxDOT, result in the termination of the Agreement, and if terminated, the removal of all LPR cameras from within the highway right of way at the expense of Port Arthur PD. D. RESPONSIBILITY 1. Port Arthur PD acknowledges that TxDOT does not have access to any LPR data. Port Arthur PD acknowledges and agrees that it is individually responsible for obligations required under the Texas Public Records Act for requests made seeking LPR data. 2. Port Arthur PD acknowledges that it has, and agrees to assume, full responsibility regarding the installation and use of its LPR cameras on the highway right of way, including, but not limited to, any and all responsibility pertaining to the use, storage, and release of LPR data collected by the LPR cameras and/or System authorized by this agreement. Any person executing this Supplemental Agreement in a representative capacity hereby warrants that he/she is duly authorized to do so.
