Operation of a Pre-Owned Automobile Sales Lot Located at 1801
Woodworth Boulevard
Introduction:
The purpose of this agenda item is to request that the City Council consider and approve
P.O. NO. 7348, granting Specific Use Permit No. 244 (SUP #244) for the operation of
a pre-owned automobile sales lot on property located at 1801 Woodworth Boulevard,
Port Arthur, Texas.
The property is legally described as 0.324 acres of Land, Lots 11 and 12, Block 327,
Port Arthur, Jefferson County, Texas.
Background:
On or around May 23, 2025, an application was filed with the Planning and Zoning
Commission requesting a Zoning Map Amendment to grant a Specific Use Permit (SUP
#244) to operate a pre-owned automobile sales lot at the above-referenced location.
A public hearing before the Planning and Zoning Commission was held on July 7, 2025,
at 5:30 p.m.. In accordance with public notification requirements, notices were mailed
to all property owners within a 200-foot radius of the subject site and published in the
Port Arthur Newspaper on June 12, 2025.
The Planning and Zoning Commission, after reviewing the request, voted 3:0 in favor of
recommending approval of the SUP to the City Council.

The City Council, in response to the Commission's recommendation, approved
Proposed Resolution No. 24400 calling for a public hearing on July 29, 2025, at 6:00
p.m., to receive public comments concerning the proposed SUP.
Notice of the City Council's public hearing was:
• Published in the Port Arthur Newspaper (Weekend Edition: July 12-13, 2025)
• Posted on the City's official website on July 8, 2025
• Shared on the City's official social media platforms on July 10, 2025

Recommendation:
It is recommended that the City Council approve P.O. NO. 7348, granting Specific Use
Permit No. 244 (SUP #244) for the development and operation of a pre-owned
automobile sales lot at 1801 Woodworth Boulevard, Port Arthur, Texas.

AN ORDINANCE AMENDING APPENDIX A — ZONING, CODE OF
ORDINANCES, CITY OF PORT ARTHUR, TEXAS, GRANTING SPECIFIC
USE PERMIT NO. 244 (SUP #244) FOR THE OPERATION OF A PRE-
OWNED AUTOMOBILE SALES LOT ON PROPERTY LOCATED AT 1801
WOODWORTH BOULEVARD, DESCRIBED AS LOTS 11 AND 12,
BLOCK 327, PORT ARTHUR, JEFFERSON COUNTY, TEXAS
(VIOLATION OF ANY PROVISION OF THIS ORDINANCE SHALL BE
GUILTY OF A MISDEMEANOR AND SHALL BE PUNISHED BY A FINE
NOT EXCEEDING $2,000.00, AS PROVIDED IN CHAPTER 1, SECTION
1-13 OF THE CODE OF ORDINANCES, AND EACH DAY WHICH
VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A
SEPARATE AND DISTINCT OFFENSE.); AND PROVIDING FOR
PUBLICATION IN THE OFFICIAL NEWSPAPER OF THE CITY OF PORT

Affordable Auto Enterprises
WHEREAS, in accordance with Appendix A, Section 24-100 of the City of Port
Arthur Zoning Ordinance, Derrick Graham, being the owner of Affordable Auto
Enterprises, and having proprietary interest in the real property is requesting Specific Use
Permit (SUP #244) to allow for the development and operation of a pre-owned automobile
sales lot on a 0.324-acre tract of land described as Lots 11 and 12, Block 327, City of
Port Arthur, Jefferson County, Texas, and more commonly known as 1801 Woodworth
Boulevard; and
WHEREAS, the property is currently zoned Commercial Retail (CR), and the use
of land for automobile sales requires the issuance of a Specific Use Permit under the
provisions of the City of Port Arthur Zoning Ordinance (Appendix A, Section 3); and
WHEREAS, all requirements of Article XI, Section 2(b) of the City Charter and
Appendix A — Zoning of the City of Port Arthur Code of Ordinances, including Sections

211.006 and 211.007 of the Texas Local Government Code, having been fulfilled, the City
Council held a public hearing on July 29, 2025, at 6:00 p.m.; and
WHEREAS, in accordance with Section 211.007 of the Texas Local Government
Code and Section 6.03(D) of the City's Zoning Ordinance, the Planning and Zoning
Commission held a public hearing for this case on July 7, 2025, with proper notice mailed
to adjacent property owners within a 200-foot radius on June 12, 2025, and published in
the Port Arthur News on June 14, 2025; and
WHEREAS, the Planning and Zoning Commission voted 3:0 to recommend
approval of the proposed zoning text amendment; and
WHEREAS, in accordance with Section 211.006(a) of the Texas Local
Government Code and Section 5.02 of the City's Zoning Ordinance, the City Council
adopted Proposed Resolution No. 24400 calling for a public hearing to be held July 29,
2025, at 6:00 p.m.; and
WHEREAS, notice of the July 29, 2025 public hearing was published in the Port
Arthur News on July 12-13, 2025 (attached as Exhibit "B"), posted on the City's website
on July 8, 2025 (attached as Exhibit "C"), and published on the City's social media
platforms on July 10, 2025 (attached as Exhibit "D"), in accordance with legal
requirements; and
WHEREAS, the City Council finds that approving Specific Use Permit No. 244 is
in the interest of public health, safety, and welfare and promotes orderly development
within the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:

Section 1. That the Zoning Map of the City of Port Arthur, Texas, be amended to grant
Specific Use Permit No. 244(SUP#244)to allow for the development and operation of Automobile
Sales/Repair at the following location:
0.324-Acre Tract of Land
Lots 11 and 12, Block 327,
Port Arthur, Jefferson County, Texas
(1801 Woodworth Boulevard, Port Arthur, TX)
EXHIBIT "A"
Section 2. That the Building Official and the Director of Development Services are
hereby authorized and directed to make all necessary updates to the Official Zoning Map
to reflect the zoning classifications and use permissions set forth herein.
Section 3. That if any section, subsection, sentence, clause, phrase, or portion of
this Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent provision,
and such holding shall not affect the validity of the remaining portions hereof.
Section 4. That all ordinances and parts of ordinances in conflict herewith are
hereby repealed, but only to the extent of such conflict.
Section 5. That any person, firm or corporation who violates any provision of this
ordinance shall be guilty of a misdemeanor and shall be punished by a fine not exceeding
$2,000.00, as provided in Chapter 1, Section 1-13 of the Code of Ordinances, and each
day which violation is permitted to exist shall constitute a separate and distinct offense.
Section 6. That this Ordinance or its caption and penalty shall be published at
least one (1) time within ten (10) days after final passage hereof in the official newspaper
of the City of Port Arthur. This Ordinance shall take effect immediately after the date of
such publication.

Section 7. That because this request has not been protested according to Section
24-105 of Appendix A — Zoning of the Port Arthur Code of Ordinances or 211.006 of the
Texas Local Government Code, a three-fourths (3/4) majority (6 votes) is not required for
the adoption of this Ordinance.
