No. 7349 — Establishing Planned Development District— 45 (PD-45) for Property Located at 8520 Wilson Avenue Introduction: The purpose of this agenda item is to request that the City Council consider and approve P.O. No. 7349, establishing Planned Development District — 45 (PD-45) on approximately 2.892 acres of land located at 8520 Wilson Avenue, consisting of Lot 23, Tracts 6 & 7, and part of Lot 11, Tract 6, Peek Addition, Port Arthur, Jefferson County, Texas. The applicant proposes to develop and operate a multi-purpose event center on the site. Background: On or around September 25, 2024, an application was filed with the Planning and Zoning Commission requesting a Zoning Map Amendment to rezone the subject property from Medium Density Residential (MDR) to a Planned Development District (PD-45) to facilitate the construction and operation of a multi-purpose event center. As part of early community engagement efforts: • During the second week of October 2024, the Montrose community convened to discuss the proposed development. Many attendees at that meeting expressed opposition to the project. • On Thursday, March 6, 2025, a second community meeting was held. At that meeting, the property owner provided a comprehensive presentation including "Remember,we are here to serve the Citizens of Port Arthur" P.O.Box 1089 X Port Arthur,Texas 77641-1089 X 409.983.8101 X FAX 409.982.6743 detailed project explanations, diagrams, and visual renderings. As a result, public perception shifted, and most attendees expressed support, though some opposition remained. Based on the shift in public sentiment and completion of outreach efforts, Planning Staff proceeded with the formal zoning process. These meetings were conducted prior to the public hearing, scheduled for May 5, 2025, to ensure all stakeholders had the opportunity to be informed and provide input. The Planning and Zoning Commission held a public hearing on May 5, 2025, at 5:30 p.m. Public notices regarding the hearing were: • Mailed to adjacent property owners within a 200-foot radius; and • Published in the Port Arthur News on March 19, 2025. The Commission received one (1) letter of opposition from the property owner at 8323 Alabama Avenue and one (1) letter of support from the property owner at 8338 Wilson Avenue, both of which were read into the record. Following the hearing, the Commission voted 3:0 to recommend that the proposed zone change be approved by the Port Arthur City Council. The City Council subsequently adopted Resolution No. 25-180, calling for a public hearing on the matter to be held on June 3, 2025, at 6:00 p.m. However, due to issues with the newspaper publication notice, the hearing was rescheduled to ensure proper legal notification to the public. The rescheduled public hearing is set for July 29, 2025, at 6:00 p.m. Notices of the hearing were: • Published in the Port Arthur News weekend edition on July 12-13, 2025. • Posted on the City's website on July 8, 2025; and • Shared via the City's social media platforms on July 10, 2025. Budget Impact: None Recommendation: It is recommended that the City Council approve P.O. No. 7349, establishing Planned Development District — 45 (PD-45) for the development and operation of a multi- purpose event center at 8520 Wilson Avenue, as recommended by the Planning and Zoning Commission. AN ORDINANCE AMENDING APPENDIX A — ZONING, CODE OF ORDINANCES, CITY OF PORT ARTHUR, TEXAS, TO REZONE A 2.892- ACRE TRACT OF LAND LOCATED AT 8520 WILSON AVENUE, LEGALLY DESCRIBED AS LOT 23, TRACTS 6 & 7, AND PART OF LOT 11, TRACT 6, PEEK ADDITION, PORT ARTHUR, JEFFERSON COUNTY, TEXAS, FROM MEDIUM DENSITY RESIDENTIAL (MDR) TO PLANNED DEVELOPMENT DISTRICT — 45 (PD-45) TO ALLOW FOR THE DEVELOPMENT AND OPERATION OF A MULTI-PURPOSE EVENT CENTER (VIOLATION OF ANY PROVISION OF THIS ORDINANCE SHALL BE GUILTY OF A MISDEMEANOR AND SHALL BE PUNISHED BY A FINE NOT EXCEEDING $2,000.00, AS PROVIDED IN CHAPTER 1, SECTION 1-13 OF THE CODE OF ORDINANCES, AND EACH DAY WHICH VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE AND DISTINCT OFFENSE.); AND PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER OF THE CITY OF PORT ARTHUR AND EFFECTIVE IMMEDIATELY AFTER PUBLICATION DATE. Z24-10 Melecio F. Ceja WHEREAS, in accordance with Appendix A, Section 24-100 of the City of Port Arthur Zoning Ordinance, Melecio F. Ceja, being the owner and having proprietary interest in the real property is requesting a zoning change from Medium Density Residential (MDR) to a Planned Development District (PD-45) for the purpose of constructing and operating a multi-purpose event center on approximately 2.892 acres of land located at 8520 Wilson Avenue, legally described as Lot 23, Tracts 6 & 7, and part of Lot 11, Tract 6, Peek Addition, Port Arthur, Jefferson County, Texas; and WHEREAS, all requirements of Article XI, Section 2(b) of the City Charter and Appendix A — Zoning of the City of Port Arthur Code of Ordinances, including Sections 211.006 and 211.007 of the Texas Local Government Code, having been fulfilled, the City Council held a public hearing on July 29, 2025, at 6:00 p.m.; and 4 P.O.NO.7349 0712012025 pdl PAGE 2OF10 WHEREAS, in accordance with Section 211.007 of the Texas Local Government Code and Section 6.03(D) of the City's Zoning Ordinance, the Planning and Zoning Commission held a public hearing for this case on May 5, 2025, with proper notice mailed to adjacent property owners within a 200-foot radius and published in the Port Arthur News on March 19, 2025; and WHEREAS, the Commission received one(1) letter of opposition from the property owner at 8323 Alabama Avenue and one (1) letter of support from the property owner at 8338 Wilson Avenue; and WHEREAS, the Planning and Zoning Commission voted 3:0 to recommend approval of the proposed zoning text amendment; and WHEREAS, in accordance with Section 211 .006(a) of the Texas Local Government Code and Section 5.02 of the City's Zoning Ordinance, the City Council adopted Resolution No. 25-180 calling for a public hearing to be held on June 3, 2025; however, due to publication issues, the public hearing was rescheduled to July 29, 2025, at 6:00 p.m.; and WHEREAS, notice of the July 29, 2025 public hearing was published in the Port Arthur News on July 12-13, 2025 (attached as Exhibit "B"), posted on the City's website on July 8, 2025 (attached as Exhibit "C"), and published on the City's social media platforms on July 10, 2025 (attached as Exhibit "D"), in accordance with legal requirements; and WHEREAS, the City Council finds that approving this Planned Development District is in the interest of public health, safety, and welfare and promotes orderly development within the City. P.O. NO.7349 0712012025 pdl PAGE 3 OF 10 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the Zoning Map of the City of Port Arthur, Texas, be amended to change the zoning classification from Medium Density Residential (MDR) to Planned Development District —45 (PD-45): 2.892-Acre Tract of Land Lot 23, Tracts 6 & 7, and part of Lot 11, Tract 6, Peek Addition, Port Arthur, Jefferson County, Texas (8520 Wilson Avenue, Port Arthur, TX) EXHIBIT "A" Section 2. The Planned Development District — 45 (PD-45) shall allow for the development and operation of a multi-purpose event center, consistent with the site plan, renderings, and project description provided by the applicant and recommended by the Planning and Zoning Commission. Section 3. That the Building Official and the Director of Development Services are hereby authorized and directed to make all necessary updates to the Official Zoning Map to reflect the zoning classifications and use permissions set forth herein. Section 4. That if any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions hereof. Section 5. That all ordinances and parts of ordinances in conflict herewith are hereby repealed, but only to the extent of such conflict. P.O.NO.7349 0712012025 pdl PAGE 4 OF 10 Section 6. That any person, firm or corporation who violates any provision of this ordinance shall be guilty of a misdemeanor and shall be punished by a fine not exceeding $2,000.00, as provided in Chapter 1, Section 1-13 of the Code of Ordinances, and each day which violation is permitted to exist shall constitute a separate and distinct offense. Section 7. That this Ordinance or its caption and penalty shall be published at least one (1) time within ten (10) days after final passage hereof in the official newspaper of the City of Port Arthur. This Ordinance shall take effect immediately after the date of such publication. Section 8. That because this request has not been protested according to Section 24-105 of Appendix A — Zoning of the Port Arthur Code of Ordinances or 211.006 of the Texas Local Government Code, a three-fourths (3/4) majority (6 votes) is not required for the adoption of this Ordinance.
