RE: PR 24447—Ratification of Emergency Removal of Clogging from Primary
Clarifier A at the Main Wastewater Treatment Plant
Introduction:
The intent of this Agenda Item is for the City Council to ratify the emergency removal of clogging
from Primary Clarifier A at the Main Wastewater Treatment Plant (WWTP) by Empower
Industrial Solutions, LLC of Houston, Texas for a total amount of$30,000.00.
Background:
The 30-inch pipe that feeds raw sewage from the Influent Structure to the Primary Clarifier A at
the Main WWTP was clogged and diverting flows to the Stormwater Clarifier, which is only
permitted during peak flows. Such treatment operation flows posed the risk of permit violation
fines from and the Texas Commission on Environmental Quality (TCEQ), as well as posing a
health and safety concern. An Emergency Memo was issued on July 3, 2025 for the removal of
clogging from the Primary Clarifier A. Considering the July 4th Holiday weekend and operational
schedule, project was scheduled to begin Monday July 7, 2025 and completed July 10, 2025. The
emergency removal of clogging was completed by Empower Industrial Solutions, LLC for work
including removing the clog by cleaning the Primary Clarifier A and clearing up the 30-inch pipe
to the Primary Clarifier.
Budget Impact:
The total budgetary impact is $30,000.00 and funding in CIP Account 405-40-00-8516-00-00-000
is contingent upon the approval of budget amendment in Proposed Ordinance No. 7351.
Recommendation:
It is recommended that City Council approve Proposed Resolution No. 24447, ratifying the
emergency removal of clogging from Primary Clarifier A at the Main WWTP as
described/outlined above.

A RESOLUTION RATIFYING THE CITY MANAGER'S
DECISION TO AUTHORIZE RATIFICATION OF THE
EMERGENCY REMOVAL OF CLOGGING FROM
PRIMARY CLARIFIER A AT THE MAIN WASTEWATER
TREATMENT PLANT BY EMPOWER INDUSTRIAL
SOLUTIONS, LLC OF HOUSTON, TEXAS IN THE TOTAL
AMOUNT OF $30,000.00; FUNDING IN CIP ACCOUNT NO.
405-40-000-8516-00-00-000 IS CONTINGENT UPON THE
APPROVAL OF THE BUDGET AMENDMENT IN
PROPOSED ORDINANCE NO. 7351.
WHEREAS, the 30-inch pipe that feeds raw sewage from the Influent Structure to the
Primary Clarifier A at the Main Wastewater Treatment Plant(WWTP)was clogged causing flows
to the Stormwater Clarifier,which is only permitted during peak flows; and,
WHEREAS, such treatment operation flows were in permit violations and have potential
fines from the Texas Commission on Environmental Quality (TCEQ), as well as, posed public
health and safety concerns; and,
WHEREAS,on July 3,2025,the City Manager signed an emergency memo(Exhibit"A"),
authorizing the emergency cleaning by Empower Industry Solution, LLC of Houston, Texas; and,
WHEREAS,considering the July 4th holiday weekend and operational schedule,Empower
Industry Solution,LLC was scheduled to begin work on July 7th,2025 and completed the removal
of clogging on July 10th,2025 and submitted the invoice totaling $30,000.00 (Exhibit"B"); and,
WHEREAS,pursuant to Section 252.022(a)(1)of the Texas Local Government Code,this
purchase is authorized because of a public calamity that requires the immediate appropriation of
money to relieve the necessity of the municipality's residents or to preserve the property of the
municipality; and,
WHEREAS, it is further authorized pursuant to Section 252.022(a)(2) of the Texas Local
Government Code to preserve or protect the public health or safety of the municipality's residents.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR,TEXAS:
THAT,the facts and recitals in the preamble are true and correct; and,
THAT, City Council hereby ratifies the emergency cleaning of Clarifier A and the 30-in
pipe to the Primary Clarifier A at the Main WWTP in the total amount of$30,000.00 from Account

No. 405-40-000-8516-00-00-000 contingent upon the approval of the budget amendment in
Proposed Ordinance No. 7351; and,
THAT, a copy of the caption of this Resolution shall be spread upon the Minutes of the
Meeting of the City Council.

RE: Emergency Removal of Clogging from Primary Clarifier A at the Main WWTP
The 30-inch line that feeds raw sewage from the Influent Structure to Clarifier A has been clogged
with rags, dirt, and other debris. This causes influent flows to be diverted to the Stormwater
Clarifier, as the plugging of this line requires all flow to pass through the 30-inch line feeding
Primary Clarifier B, which does not have enough capacity. Passing flow through the Stormwater
Clarifier is only permitted during peak flows. The current treatment operation is a violation of the
TCEQ permit and potentially exposes the City to fines. In addition, to discharges of partially
treated effluent is a public health and safety hazard.
The estimated expenditure for the cleaning of the 30-inch pipe and influent well is estimated to be
$30,000.00 by Empower Industry Solution from Houston, Texas.
I, Ron Burton,City Manager,approve the emergency repair necessary for Primary Clarifier A and
its feed line at the Main WWTP.
