The request has since changed to a private lodge to give special events and meals by invitation only. The bed and breakfast designation is no longer requested due to a change in family circumstances. The neighborhood service designation excludes other schedule uses that are: Educational/institutional, amusement associated, temporary permit or transportation related, commercial, special industry and agricultural in nature. The events will host no more than 90 persons on a large scale for -wedding receptions, parties, luncheons, charitable events, group functions and to incorporate receptions, dinners and special events celebrations only by reservation or invitation. The scope of these events shall be in line with off-street parking only as to the Code. Forty-eight spaces are planned. Landscaping and the aesthetic nature of the facility shall be maintained in accordance with the surrounding properties such that the commercial nature of the property does not compromise the residential setting. There will be no events on Mondays and the City's noise level ordinance shall be enforced. Cars will leave the property by right turn only to avoid left turn congestions. RECOMMENDATION: The Staff recommends approval based on the stipulations in the introduction and that all fire, building inspections and health codes comply. Thereafter, the City's ordinances and codes are met a CO (Certificate of Occupancy) maybe granted as to compliance observed by said divisions mentioned. BUDGETARY/FISCAL EFFECT: None STAFFING/EMPLOYEE EFFECT: None SUMMARY: The approval shall be in line with the criteria set forth in the ordinances, codes and applicants shall adhere to all sections regarding private lodge and special requirements of the Schedule of Uses including off-street parking. There is over three (3) acres for a planned development. The land was platted and filed with the County on October 20, 2009. Agrease- trap is still required for the kitchen to classify as commercial and any other stipulations by the Commission maybe added to the planned development ruling. Exhibits are - A. Proposed daily schedule of operation 2 SECTION 19 PLANNED DEVELOPMENT DISTRICT REGULATIONS 19-i00 THE PURPOSE OF THE "PD" - PLANNED DEVELOPMENT DISTRICT IS TO PROVIDE GREATER FLEXIBILITY AND OPPORTUNITY FOR INNOVATION IN PROJECTS. (9) Transitions Districts as an extension of an existing district where the provision for off-street parking,.screening wails, open space and planting would create a protective transition between a lesser or a ~~~ _ restrictive district. 19-201 Comprehensive Site Pian Required In establishing a Planned Development District, the City Council shall require a comprehensive site plan of the development. This site plan shall be approved and filed a as a part of the Ordinance prior to the issuance of any Building Permit. The required plan shall set forth: the specific categories of land use to be ermitted; requirements for ingress and egress to the property; •public streets with adequate right-of-way in conformance with the Thoroughfare Plan; private streets or driveways; sidewalks; utilities; 'na e; parking space; height of building; maximum lot coveracre, yards and open spaces; 'screen g wa s or ences an other development and protective requirements considere necessary to create a reasonable transition to and protection of the adjacent property. 57 19-202 All Planned Developments to Be Ordinance Amendments Every Planned Develop~ent District approved under the provisions of this Ordinance shall be considered as .an amendment to the Ordinance as applicable to the property involved. In approving the Planned Development District, the City Council may impose conditions relative to the standard of development and such conditions shall be complied with before a Certificate of Occupancy is issued for the use of the land or any structure which is part to the Planned Develapment District and such conditions shall not be construed as conditions precedent to the granting of a Certificate of Occupancy. 19-203 All Planned Developments To Be Shown on Map All Planned Development Districts approved in accordance with the provisions of this Ordinance in its original farm or by subsequent amendments thereto shall be referenced on the Zoning District Map and a list of such Planned Development Districts together with the category of uses permitted therein shall be maintained in the Appendix of this Ordinance. 58 20-100 Creation The City and proper notice from the Planning of an overlay dis~ SECTION 20 , OVE12LAY DISTRICT Council of Port Arthur,-Texas after public hearing to all parties affected and after recommendation and Zoning Commission, may authorize the creation trict. 20-200 District Requirements In establishing an Overlay District in accordance with this section the city Council shall require a boundary map, a statement of purpose and development standards to be applied within the district. Such standards shall be in addition to the standards and conditions adopted for the underlying zoning district(s). 20-201 All Overlay Districts To Be Ordinance Amendments Every Overlay district approved under the provisions of this Ordinance shall be considered as an amendment to the Ordinance as applicable to the property involved. In approving the Overlay District, the City Council may impose standards of development. These standards shall be complied with before a Certificate of Occupancy is issued for the use of the land or any structure which is part of the Overlay District. 20-202 Expert Consultants Ma Be Re y quired Prior to the issuance of a Building Permit andJor Certificate of Occupancy and Compliance the Building Official may require any person, f irm or Co~oration_to retain an expert _ ___ _ _ _ _ _ _ _ _ consu~l~ant or consultants to certify the compliance of the proposed use with the standards of development for the particular Overlay District. Such consultants shall be persons or firms mutually agreeable to the Building Official and to the owner ar operator of the proposed use. The cost to the consultant's services shall be borne by the owner or operator of said use. 2D-203 All Overlay Districts Ta Be Shown On Map All Overlay Districts approved in accordance with the provisions of this Ordinance shall be referenced on the Zoning District Map and a list of Overlay Districts together with the purposes and standards adopted therein shall be maintained in the Appendix of the Ordinance. 59 SECTION 21 SPECIFIC USE PERMITS 21-100 The City Council of the City of Port Arthur, Texas, after public hearing and proper notice to ail parties affected and after recommendations by the Planning and Zoning Commission may authorize the issuance of specific use permits for the uses indicated by "S" in the use schedule, Section 7. 21-200 Information Required For A Special Use Permit The Planning and Zoning Commission in considering and determining its recommendations to the City Council on any request for a Specific Use Permit may require from the applicant plans, information, operating data and expert evaluation concerning the location and function and characteristics of any building or use proposed. 21-300 Requirements The Planning and Zoning Commission shall review the particular facts and circumstances of each proposed specific use in terms of the following general standards to insure that the use: {1) Will be harmonious with and in accordance with ~ the general objectives, or .with any specific objectives of the Comprehensive Plan; (2) Will be designed, constructed, operated, and maintained to be harmonious and appropriate in appearance with the existing or intended _ _ _ -- character -o-f-the- -gene-r~-~ ~iei-n-i~y -an~i-wil3-nc~t - change the essential character of the area; (3) Will have vehicular approaches to the property which shall be so designed as not to create interference with traffic on surrounding thoroughfares; {4) Will not be hazardous or disturbing to existing or future neighboring uses; (5) Will not create excessive additional requirements on public facilities or services; (6) Will not involve uses, activities, processes, materials, equipment or conditions of operation that will be detrimental to any persons, property, or the general welfare by 60 ~~ reason of excessive traffic, noise, smoke, fumes, glare or odors; (7) Will not result in the destruction, loss, or damage of a natural, scenic, or historic feature of major significance. 21-40D Conditional Requirements The City Council may, in the interest of the public welfare and to assure compliance with this Ordinance, establish conditions of operation, location, arrangement and construction of any use far which a permit is authorized. In authorizing the location of any of the uses listed as Specific Use Permits, the City Council may impose such development standards and safeguards as the conditions and locations indicate important to the welfare and protection of adjacent property froze noise, vibration, dust, dirt, smoke, fumes, gas odor, explosion, glare, offensive view or other undesirable or hazardous conditions. 21-500 All Specific Use Permits approved in accordance with the provisions of this Ordinance in its original form or as hereafter amended shall be referenced on the Zoning District Map. A list of such permits shall be maintained in the Appendix of •this Ordinance. As detention ponds, storm water will collect in the pond areas before draining into the existing Drainage District 7 system at a controlled rate. The two new detention ponds will complement an existing detention pond adjacent to the proposed South Detention Pond. The engineering consultant firm hired by the EDC, Arceneaux & Gates, has determined that the detention ponds are necessary to meet drainage needs for the EDC Business Park. The Ponds are part of a larger storm water drainage project intended to provide for the future development needs for the business park. The earth taken from the proposed pond areas will be collected in a five acre spoil area immediately north of the south pond. Eventually all of the soil from the construction project will be used to cover an exposed ditch culvert system to promote an aesthetic effective drainage system throughout the business park.
