No. 15608 approving a Limited Waiver Agreement with Jefferson County, the City of Nederland, and the City of Beaumont as it pertains to the annexation of approximately 116 acres of airport property by the City of Nederland for economic development purposes. A RESOLIITION APPROVING A LIMITED WAIVER AGREEMENT WITH JEFFERSON COIINTY, THE CITY OF NSDERLAND AND THE CITY OF BEAIIMONT AS IT PERTAINS TO THE ANNERATION OF APPROSIMATELY 116 ACRES OF AIRPORT PROPERTY BY THE CITY OF NEDERLAND FOR ECONOMIC DEVELOPMENT PIIRPOSES WHEREAS, on September 9, 1960, the respective governing bodies of the Jefferson County and the cities of Beaumont, Nederland, and Port Arthur jointly sponsored a Resolution (attached hereto as Exhibit "A") agreeing that the parties would not exercise annexation authority over or seek control of lands constituting airport property; and WHEREAS, economic development funds are currently available to the City of Nederland to stimulate the development of the property adjacent to Highway 69, provided that a limited tract of the property can be annexed by the City of Nederland (an aerial map as well as a metes and bounds description of the tract to be annexed is attached hereto as Exhibit "B"); and WHEREAS, the City of Nederland has provided utility services to the tract to facilitate the development of the property; and z.pr156 o8 1 WHEREAS, the Commissioner's Court has authorized Judge Walker to execute a Limited Waiver Agreement, in substantially the same form as Exhibit "C", to accomplish this purpose; and WHEREAS, it is now deemed in the best interests of the citizens for the City of Port Arthur to jointly enter into the Limited Waiver Agreement as to allow the City of Nederland to annex approximately 116 acres of the Southeast Texas Regional Airport property for economic development. NOW THfiREFORE, BE IT RESOLVED BY THE CITY COIINCIL OF THS CITY OF PORT ARTBDR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the Mayor is herein authorized to execute the Limited Waiver Agreement, in substantially the same form as Exhibit "C", which will allow the annexation of approximately 116 acres of airport property by the City of Nederland for economic development purposes. Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. WdEREAS, Jefferson County i~s a highly industrialized section of the Slate of Texas; and 4T'.EREP.S, it is necessary that the respective municipal officials should recognize the potential growth of Jefferson County and combine the it efforts toward promoting the welfare of Jefferson County as a whole; and WHEREPS, it is imperative that the respective councils and com- missions take immediate steps in the direction of combining their efforts and working for Jefferson County projects for the benefit of all the citizens of Jeff es on County; and WriEREdS, it is felt that a good starting point would be to set aside permanently the Jefferson County Airport as a county project since it is owned, operated and financed by the entire citizenship of Tefferso^ County through its Commissioners'-Court and jointly by the Federal Govern- ment by virtue of pre-existing contracts: NOW, THEREFORE, BE IT RESOLVED that Che City Council of Beaumont, Texas; the City Council of Nederland, Texas; and the Port Arthur City Commission of the City of Port Arthur, Texas, do hereby mutually covenant and agree and promise to the respective councils and commissions for zhd in consideration of the provisions herein to adopt and be bound by this Resolution that they and each of them will from this day on relinquish any jurisdiction now held, if any, over the Jefferson County Airport, and further, that they and each of them will not hereafter attempt to control or annex any part of the Jefferson County Airport as it now e:cists or may hereafter exist. E7WIPI7 A.JOc EXHIEIT' .`°C's LIMITED WAIVER AGREEMENT WHEREAS, Jefferson County and the cities of Beaumont, Port Arthur and Nederland, acting by and tluough their respective governing bodies, jointly sponsored a Resolution effective September 9, 1960; and, ' WHEREAS, such Resohitioil embodied an agreement by and between the signatories c.ovenantinQ that none of the parties would annex or seek control over any of the lands then or thereafter constituting County Airport property; and, WHEREAS, the parties now find it desirable to agree to a limited waiver of the terms of the prior Resolution (a copy of which is attached hereto and labeled Exhibit "A"1 to provide an opportunity for the City of Nederland to annex a portion of the lands constituting the Southeast Texas Regional Airport (a description of said portion of property being attached hereto and labeled Exhibit "B"); -NOW, THEREFORE, KNOW ALL BY THESE PRESENTS, that the Resolution of September. 1960, is hereby.reaffinned and remains in full force and effect, the parties hereto agreeing ,for and in carsideration of the mutual covenants herein , that a limited waiver is granted to the City of Nederland allowing it the right to exercise its power of annexation over and against the portion of the Southeast Texas Regional Airport identified by metes and bounds in the property description contained in Exhibit "B", hereto. Nothing herein shall be construed to divest Jefferson County of its continued ownership in and'to said property or its right to develop said property for airport or other purposes. The remainder of the agreement embodied in the Resolution of September, 1960 shall continue in full farce and effect. -This agreement represents the entire agreement of the parties hereto and may not be contradicted by any paml statements made prior to or contemporaneously with its execution. This agreement shall become effective on the date executed by the final si;natory to this agreement.
