NO. 24302 — A resolution calling for a public hearing to consider a Zoning Map Amendment (Zone Change) Introduction: The Port Arthur City Council is being asked to consider the approval of Proposed Resolution No. 24302, calling for a public hearing to consider granting a zone change request for approximately 0.4814 acre of land being out of the Rosemont Addition, Jefferson County, Texas. The property is located at 3537 39th Street. The request aims to change the zoning from a Planned Development District to a Medium-Density Residential District for residential development. Background: On or around April 28, 2025, the property owner of 3537 39th Street, applied for a zone change for approximately 0.4814 acre of land being out of the Rosemont Addition, Jefferson County, Texas. The property is located at 3537 39th Street. In accordance with Appendix A, Section 6.03 of the City of Port Arthur Zoning Ordinance, any person or corporation having a proprietary interest in any property may petition the city council for a change or amendment to the provisions of this ordinance. The Planning & Zoning Commission may on its own motion or on request from the City Council institute a study and proposal for changes and amendments in the public interest. The Planning & Zoning Commission conducted a public hearing on August 4, 2025, at 5:30 P.M. Budget Impact: None Recommendation: It is recommended that the City Council consider the approval of Proposed Resolution No. 24302, calling for the City Council to conduct a public hearing to consider granting a zone change request for approximately 0.4814 acre of land being out of the Rosemont Addition, Jefferson County, Texas. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A ZONING CHANGE FOR 0.4814 ACRES OF LAND CONSISTING OF ALL OF LOTS 15-20, BLOCK 23, ROSEMONT ADDITION, CITY OF PORT ARTHUR, JEFFERSON COUNTY, TEXAS (3537 39TH STREET) FROM PLANNED DEVELOPMENT DISTRICT — 30 (PD-30) TO MEDIUM DENSITY RESIDENTIAL (MDR) Z25-04 — KODE PROPERTIES WHEREAS, it is being requested that the City Council consider a zoning map amendment for a 0.4814-acre tract of land as delineated in Exhibit "A"; and, WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a public hearing must precede any zoning change; and, WHEREAS the Planning and Zoning Commission held a public hearing for this case on August 4, 2025. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: THAT the facts and opinions in the preamble are true and correct. THAT a public hearing to consider a Zoning Map amendment from Planned Development to Medium Density Residential District for 0.4814-acre tract of Land being out of the Rosemont Addition, City of Port Arthur, Jefferson County, Texas, delineated in Exhibit "A" shall be held on October 7, 2025, at 10:00 a.m. in the City Council Chambers, Fifth Floor, City Hall, 444 4th Street, Port Arthur, Texas, or by telephonic and videoconference. THAT notice of the public hearing shall be published at least fifteen days prior in the City's official newspaper before going to the City Council. THAT a copy of the caption of this Resolution is spread upon the Minutes of the City Council.
