Williams, Assistant Director of Human Resources RE: Resolution Authorizing The City Manager To Execute The Settlement Of A Claim In The Amount of $54,454.21 Made Against Texas Municipal League — Intergovernmental Risk Pool (TML-IRP) As A Result Of Flooding in the Health Department (June 13, 2025) Nature of the request: On June 13, 2025, after heavy rainfall, the Health Department (5860 9th Avenue) experienced flooding issues in several areas of the building. Staff Analysis, Considerations: The City has Property Damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool (TML-IRP) with a $5,000.00 deductible. TML-IRP has offered the City of Port Arthur a settlement of $54,454.21, less the $5,000.00 deductible and less the depreciation amount of $2,421.70, making the final settlement offer $47,032.51 (Exhibit "A" attached). If additional damages are discovered, TML-IRP may issue a supplemental payment. Recommendation: I recommend approval of Proposed Resolution No. 24505 authorizing the property damage settlement against Texas Municipal League — Intergovernmental Risk Pool (TML-IRP) for the flooding damage in the Health Department. TML-IRP has offered to settle the claim for $54,454.21, less the $5,000.00 deductible and less the depreciation amount of $2,421.70, making the final settlement amount to be $47,032.51. This is considered a fair and reasonable settlement for the estimated repairs. Budget Considerations: The funds received will be deposited in Account No. 001-00-000- 4748-00-00-000, Project No. MCLR. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SETTLEMENT OF A PROPERTY DAMAGE CLAIM IN THE AMOUNT OF $54,454.21 MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TML-IRP) AS A RESULT OF DAMAGES OF FLOODING AT THE HEALTH DEPARTMENT (5860 9TH AVENUE) WHEREAS, on June 13, 2025, after heavy rainfall, the Health Department, located at 5860 9th Avenue, experienced flooding issues in several areas of the building; and, WHEREAS, as a result of the damage, a claim was filed with Texas Municipal League Intergovernmental Risk Pool (TML-IRP); and, WHEREAS, TML-IRP has offered to settle the claim for $54,454.21, less the $5,000.00 property physical damage deductible and less depreciation amount of $2,421.70, making the final settlement offer $47,032.51, which is considered a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount of $54,454.21, less the $5,000.00 property physical damage deductible and less depreciation amount of $2,421.70, making the final settlement offer $47,032.51, for the claim against TML-IRP in substantially the same form as delineated in Exhibit "A". Section 3. That, the funds received will be deposited in Account No. 001-00- 000-4748-00-00-000, Project No. MCLR. Section 4.
