ORDINANCE NO.
AN ORDNANCE AMENDING SUBSUBSECTION (b) OF SECTION 78-71 [FILLING OF
VACANT REGULAR POSITIONS] OF DIVISION 2 [EMPLOYEE SELECTION] OF CHAPTER 78
[PERSONNEL POLICY] OF THE CITY OF PORT ARTHUR CODE OF ORDINANCES BY
PROVIDING AGENCY TEMPORARIES WHO HAVE SIX (6) MONTHS OF CONTINUOUS
SERVICE WITH THE CITY OF PORT ARTHUR BE AFFORDED AN OPPORTUNITY TO BID
ON VACANT POSITIONS IN THE SAME MANNER AS CITY TEMPORARIES
WHEREAS, the City of Port Arthur is a chartered municipality located in Jefferson County,
Texas; and,
WHEREAS, City of Port Arthur, Texas, employs agency temporaries for various reasons
including,but not limited to: increased staffing demand, specialty skill needs, additional assignments; and,
WHEREAS, the experience and training provided by the City represents an investment in the
employee; and,
WHEREAS, the City deems it reasonable and appropriate to allow agency temporaries who have
benefitted from City training to bid on vacant positions for which they qualify.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR,TEXAS:
Section 1. That,the facts and opinions in the preamble are true and correct.
Section 2. That, the City Council hereby amends Article II, Section 78-71(b) as delineated in
Exhibit"A".
Section 3. That, this being an ordinance which does not impose a penalty or fine it shall become
effective immediately upon its passage.
Section 4. That, this amendment be appropriately codified in the City of Port Arthur Personnel
Policy in Article II, Employee Selection,Section 17-22(B)Filling of Vacant Regular Positions.
Section 5. That, all ordinances in conflict herewith are hereby repealed. but only to the extent of
said conflict.
Section 6. That, a copy of this Resolution be spread upon the minutes of the City Council.

Sec. 78-71.- Filling of vacant regular positions.
(a) Department heads shall notify the human resources department when a regular position
becomes vacant and shall recommend whether or not there is a need to refill the position.
Department heads shall also be responsible for anticipating future vacancies due to pending
retirements or terminations and shall also notify the human resources department so that
personnel replacements can be obtained in an orderly and expeditious manner to avoid
disruption or discontinuation of services.
(b) If it is determined by the city manager that there is a need to refill the vacated position, all
nonprofessional and nonsupervisory positions shall be posted for bids on the bulletin
boards maintained by the human resources department for seven consecutive calendar
days. Regular, probationary and employees classified as city temporaries shall be allowed
to submit bids. Agency temporaries that have six (6) months of continuous service to the
city shall also be allowed to submit bids.
(c) Employee bids must be received in the human resources department by close of business
on the seventh day in order to be considered. For all nonprofessional and nonsupervisory
positions, employee bids shall be considered prior to consideration of applicants. If no bids
are received by the end of the seventh day, or if the position is in a professional or
supervisory classification and there are no qualified employees who have indicated an
interest and who could be promoted into the position, the department head shall request
that the human resources department obtain an adequate supply of qualified nonemployee
candidates for the vacancy.
