A RESOLUTION AUTHORIZING THE PRE-QUALIFICATION OF FOUR (4) REAL ESTATE BROKERAGE FIRMS FOR THE PURPOSE OF PROVIDING PROFESSIONAL REAL ESTATE BROKERAGE SERVICES IN ACCORDANCE WITH §253.014 OF THE TEXAS LOCAL GOVERNMENT CODE. WHEREAS, the City of Port Arthur, Texas, operates as a home-rule municipality under the authority granted by the Texas Constitution and laws of the State of Texas; and WHEREAS, a City is authorized to sale real property via a public auction as set forth in 253.008 of the Local Government Code or by contract with a licensed real estate broker as set forth in §253.014; and WHEREAS, the City of Port Arthur solicited Requests for Qualifications (RFQs) to procure the services of a Real Estate Brokers as defined in Chapter 1101 of the Texas Occupations Code, in order to comply with the provisions of§253.014 of the Texas Local Government Code; and WHEREAS, the Purchasing Division solicited Requests for Qualifications (RFQs) to prequalify licensed real estate brokers, which were published on August 6 and August 13, 2025, in the Port Arthur News (see attached Exhibit"A"); and WHEREAS,a total of four(a) responses were received on August 27, 2025; and WHEREAS, the City of Port Arthur,through pre-qualifying matrix process (see attached Exhibit "B"), deems that: American Real Estate of Beaumont, Texas; Dee Richards Beaumont, Texas; Advantage Real Estate of Port Neches, Texas and Colliers International North Texas, LLC of McKinney, Texas are qualified brokers as set forth in Chapter 1101 of the Occupations Code and meet the requirements of§253.014 to allow the governing body to contract with for the sale of real property that the municipality owns or holds in trusts and has the authority to sell. THAT,upon determination by the governing body that real property owned or held in trust by the City should be sold, the City Manager will be authorized to negotiate and enter into a contract with a specific broker, selected from the pre-qualified list attached as Exhibit"B", based on the broker's demonstrated expertise and experience most suited for the assignment. PURPOSE The purpose of the Request for Proposal is for the City of Port Arthur to obtain a list of qualified, experienced and licensed Texas Real Estate Brokers in order to provide Real Estate Brokerage Services for Citywide use, in accordance with the terms, conditions, and specifications herein. The successful proposer will assist in the sale of properties through the Multiple Listing Service (MLS) and other appropriate marketing channels in accordance with the Texas Local Government Code, including but not limited to Sections 253.008 and 272.001. II. QUALIFICATIONS & EXPERIENCE 1. Proposers shall have experience in the Port Arthur market area in marketing, leasing, and selling properties. The brokers of the firms to be assigned to this list should have familiarity with laws and practices applicable to public agency real estate matters. 2. Proposers shall be in the business of Real Estate and must possess sufficient financial support, equipment, and organization to ensure they can satisfactorily perform the services if awarded a Contract. 3. Proposers must demonstrate successful provision of services of similar magnitude to those specified in the scope of services to at least one entity similar in size and complexity to the City of Port Arthur or demonstrate the managerial and financial ability to perform the work. 4. Additional requirements: a. Proposer or principals must have relevant experience in Real Estate Brokerage services. Project managers assigned must be experienced real estate brokers. b. The City may require evidence of qualifications, financial, technical, and managerial capabilities before awarding a contract. c. Firms or principals must not have pending lawsuits against the City, unpaid taxes, unpaid utilities,judgments, or conflicts of interest unless waived by the City Council. d. Firms or principals must not be in arrears or default of any debt or contract involving the City or have failed to perform faithfully on any previous contract with the City. III. LOCAL BUSINESS PREFERENCE 1. Proposers seeking Local Business Preference must submit within ten (10) calendar days of request: a. A copy of a current City of Port Arthur or Jefferson County business tax receipt. b. Proof of business presence within the City or County for at least six (6) months (e.g., utility bills). IV.TECHNICAL SPECIFICATIONS/SCOPE OF SERVICES The selected real estate broker will be responsible for the following: 1. Marketing and Listing Services a. List designated City-owned properties on the MLS. b. Develop and execute a comprehensive marketing plan for each property. c. Provide signage and online promotion where appropriate. 2. Brokerage and Negotiation a. Represent the City in all negotiations with prospective buyers. b. Present all written offers and provide market analysis and recommendations. 3. Advisory Services a. Provide advice regarding property valuation, i.e., broker price opinion(BPO) b. Portfolio organization and analysis c. Strategic planning for property leasing and disposal 4. Compliance and Reporting a. Ensure that all transactions comply with applicable provisions of the Texas Local Government Code including but not limited to Sections 253.008 and 272.001. b. Provide monthly status reports and updates on marketing and sales activity. 5. Transaction Management a. Oversee escrow and closing activities. b. Assist with document preparation for final conveyance (e.g., deeds,resolutions, disclosures). 6. Deliverables may include valuation reports, marketing strategies, and planning reports per issued task orders. 7. Contractors shall: a. Evaluate vacant or underutilized City land and provide revenue assessments and disposition recommendations. b. Ensure all transactions are approved by the City and comply with applicable rules, ordinances, and the City Charter. Page 5 of 21 l c. Be compensated based on performance, with sales commissions derived from transaction proceeds. d. Include proposed commission percentages in their response. 8. PRE-QUALIFIED REAL ESTATE BROKER LIST The City may waive irregularities in proposals or the RFP process. The City reserves the right to include or exclude firms based on its best interest and best value for the City. In determining the best value for the City,the City may consider: 1. The purchase price; 2. The reputation of the bidder and of the bidder's goods or services; 3. The quality of the bidder's goods or services; 4. The extent to which the goods or services meet the city's needs; 5. The bidder's past relationship with the city; 6. The impact on the ability of the city to comply with laws and rules relating to contracting with historically underutilized businesses and non-profit organizations employing persons with disabilities; 7. The total long-term cost to the city to acquire the bidder's goods or services; 8. Any other relevant criteria specifically listed in the request for bids or proposals. VIII.TERM OF AGREEMENT • This RFP does not commit the City to award a contract or pay any preparation costs. • The initial term of the agreement shall be one (1) year with the option to extend for an additional one-year period upon mutual agreement. RESERVATION OF RIGHTS The City reserves the right to: • Reject any or all proposals. • Waive informalities or irregularities. • Award the contract to the proposer offering the best value. • Cancel or modify the solicitation. • Include or exclude firms from the pre-qualified Real Estate Broker List.
