RE: P.R. 24589- Resolution Ratifying the City Manager's decision to accept the
FY 2025 Body-Worn Camera Grant.
Introduction:
The intent of this agenda item is to seek the City Council's approval to amend Resolution No.
24-455 to include the specific assurances required by the Office of the Governor to ensure
continued eligibility and compliance with grant requirements.
Background:
The Office of the Governor — Public Safety Division notified the City of Port Arthur that the
Port Arthur Police Department's FY 2025 Body-Worn Camera Grant request was approved for
funding in the amount of$132,381.60.
This grant is designed to assist the Police Department in purchasing body-worn camera
equipment, related storage, and cloud-based data systems, including eligible subscriptions
and/or leasing services within the established twelve-month performance period.
The Police Department currently operates under a five-year contract with Utility Associates,
Inc., which was approved by City Council on September 27, 2022, under Resolution No. 22-
443,for an amount of$151,104.90.The FY 2025 grant funds will be applied solely to the portion
of the agreement pertaining to body-worn camera systems and will exclude the in-car camera

system components. A resolution to accept the grant was presented before the City Council under
Resolution 24-455.
Subsequent correspondence from the Office of the Governor advised that additional wording
was required in the City's adopting resolution to affirm the City's obligations under the grant.
Specifically, the revised resolution must clearly state that:
The City Manager is designated and authorized to apply for, accept, reject, alter, or terminate
the grant on behalf of the City of Port Arthur, and in the event of loss or misuse of grant funds,
the City Council assures that all funds will be returned to the Office of the Governor in full.
Budget Impact:
The FY 2025 Body-Worn Camera Grant requires a 25% local match, which has been budgeted
and is available under Account No. 001-17-045-5470-00-30-000 for Fiscal Year 2024-2025.The
match will be provided from existing appropriations within the Police Department's budget.
Recommendation:
It is recommended that the City Council approve Amendment Resolution No. 24-455 to include
the specific assurances required by the Office of the Governor to ensure continued eligibility
and compliance with grant requirements, as outlined above, and adopt the accompanying
resolution to satisfy the grantor's compliance requirements.

A RESOLUTION AMENDING RESOLUTION NO.24-455 IN
RESPONSE TO THE OFFICE OF THE GOVERNOR'S
REQUEST FOR ADDITIONAL LANGUAGE AFFIRMING
THE CITY OF PORT ARTHUR'S OBLIGATIONS UNDER
ITS ACCEPTANCE OF THE FISCAL YEAR 2025 BODY-
WORN CAMERA GRANT FROM THE OFFICE OF THE
GOVERNOR — PUBLIC SAFETY DIVISION, IN THE
AMOUNT OF $132,381.60.
WHEREAS, the Office of the Governor—Public Safety Division has awarded the City of
Port Arthur, Texas, a Fiscal Year 2025 Body-Worn Camera Grant in the amount of$132,381.60;
and
WHEREAS,the grant provides funding for the purchase of body-worn camera equipment,
storage, and cloud-based systems to enhance officer accountability, transparency, and evidence
management; and
WHEREAS, the City of Port Arthur Police Department currently maintains a five-year
contract with Utility Associates, Inc., approved under Resolution No. 22-443 on September 27,
2022, and the FY 2025 grant will offset a portion of those costs specific to body-worn cameras;
and
WHEREAS, the grant requires a 25 percent local match, which has been identified and
appropriated under Account No. 001-17-045-5470-00-30-000 for Fiscal Year 2024-2025; and
WHEREAS, Resolution No. 24-455, adopted by the City Council, authorized acceptance
of the FY 2025 Body-Worn Camera Grant; however, subsequent correspondence from the Office
of the Governor indicated that additional language was required to affirm the City's obligations
under the grant; and
WHEREAS, the Office of the Governor requires the City's resolution to expressly
designate the City Manager as the authorized official with authority to apply for, accept, reject,
alter, or terminate the grant on behalf of the City; and
WHEREAS, the City acknowledges that in the event of any loss or misuse of grant funds,
all such funds shall be returned to the Office of the Governor in full; and
WHEREAS, it is necessary to amend Resolution No. 24-455 to include the specific
assurances required by the Office of the Governor to ensure continued eligibility and compliance
with grant requirements, as set forth in the amended language attached hereto as Exhibit "A."
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.

Section 2. That the City Council hereby amends Resolution No. 24-455 to include the
additional language required by the Office of the Governor, as shown in Exhibit "A," and ratifies
the City Manager's authority to accept and administer the Fiscal Year 2025 Body-Worn Camera
Grant from the Office of the Governor--Public Safety Division, in the amount of$132,381.60.
Section 3. That a copy of the caption of this resolution shall be spread upon the minutes
of the City Council.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ACCEPT THE FISCAL YEAR 2025 BODY-WORN CAMERA
GRANT FUNDING IN THE AMOUNT OF $132 , 381 . 60 WITH A
25% CASH MATCH IN THE AMOUNT OF $33 , 095 . 40 . CASH
MATCH IS AVAILABLE IN ACCOUNT NUMBER 001-17-045-
5470-00-30-000 .
WHEREAS, on February 27, 2024, City Council passed
Resolution 24-075 authorizing the City Manager to apply for
the fiscal year 2025 Body-Worn Camera grant; and
WHEREAS, the Office of the Governor, Public Safety
Office Criminal Justice Division has notified the City of
Port Arthur that the Police Department' s 2025 Body-Worn
Camera grant request was approved in the amount of
$132, 381. 60; and
WHEREAS, in order to receive the aforesaid allocation,
it is necessary that the City Manager accept the award through
the e-grants portal; and
WHEREAS, the Office of the Governor requires the City' s
resolution to expressly designate the City Manager as the
authorized official with authority to apply for, accept,
reject, alter, or terminate the grant on behalf of the City;
and
WHEREAS, the City acknowledges that in the event of any
loss of misuse of grant funds, all such funds shall be
returned to the Office of the Governor in full; and
WHEREAS, the City of Port Arthur Police Department
entered into a five-year contract with Utility Associates,
Inc. for these services on the 27th day of September, 2022
under P. R. No. 22703, Resolution No. 22-443, in the amount of
$151, 104 . 90 per year; and
WHEREAS, this grant would cover the percentage of this
amount solely dealing with the body-worn camera, excluding
the percentage pertaining to the in-car video system; and

AMENDED
WHEREAS, there is a 25% cash match requirement under
this program. Funds are available for this cash match in
account #001-17-045-5470-00-30-000, as approved by Resolution
No. #22-443.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1 . That the facts and opinions in the preamble
