RE: PR 24583: Authorizing the City Manager to Accept Close-out Documents for the
Operations Center's Renovation Project Located at 201 West H. O. Mills Boulevard
Submitted by Daniels Building and Construction of Beaumont, Texas, and Approve the
Release of Retainage
Introduction:
This agenda item proposes to authorize the City Manager to accept the close-out documents and release
retainage of$57,826.45 for renovations at the Operations Center as submitted by Daniels Building and
Construction, Inc. of Beaumont,Texas.
Background:
The Operations Center houses the Public Works Department's and the Parks and Recreation
Department's staff. The building required numerous improvements to make the building more
conducive for staff to work.
The City Council, through Resolution 24-489, authorized a contract with Daniels Building and
Construction, Inc. of Beaumont, Texas, for the renovation of the Operations Center for a contract
amount of $1,434,548.00. The renovations included repairing the men's and women's restrooms,
repairing the men's locker room, cleaning and repainting office walls and flooring, cosmetic repairs to
the building's exterior, and the transfer of the unused generator from City Hall.
Staff was able to locate a new, comparably sized generator at a lower cost, resulting in Resolution 25-
143, a deductive change order of$251,871.00 for the relocation of the unused generator from City Hall
to the Operations Center, which reduced the contract amount to $1,182,677.00.
The Public Works Department has received close-out documents from Daniels Building and
Construction, Inc. of Beaumont, Texas, that include the Certificate of Substantial Completion
establishing completion as July 17, 2025, the Contractor's Certificate and Release, the Contractor's
Certificate of Debts Paid, and the Release of Retainage Pay Application for$57,826.45.
Budget Impact:
Funds for the not-to-exceed amount of$57,826.45 are available in the Accounts Payable Retainage
Account, 307-00-000-2050-00-00-000, Operations Center Renovation project,BU0001-CON.
Recommendation:
It is recommended that the City of Port Arthur City Council approve PR 24583, authorizing the City
Manager to accept the close-out documents from Daniels Building and Construction,Inc. of Beaumont,
Texas, and release the retainage in the amount$57,826.45.

WHEREAS, the Operations Center houses the Public Works Department's and the Parks and
Recreation Department's staff, and it required numerous improvements to make the building more
conducive for staff to work; and,
WHEREAS, pursuant to Resolution Number 24-489, the City Council authorized the execution
of a contract with Daniels Building and Construction, Inc. (Daniels) of Beaumont, Texas, for the
renovation of the Operations Center for a contract amount of$1,434,548.00; and,
WHEREAS, pursuant to Resolution Number 25-143, the City Council authorized a deductive
change order of$251,871.00 for the relocation of the unused generator from City Hall to the Operations
Center,which reduced the total contract amount to $1,182,677.00; and,
WHEREAS,Daniels has submitted the final invoice and the Certificate of Substantial Completion
dated July 16, 2025 for the work to which the Certificate applies has been inspected, authorized, and
declared to be complete in accordance with the Certificate of Substantial Completion(Exhibit A);together
with the Contractor's Affidavit of Payment of Debts and Claims (Exhibit B), Contractor's Affidavit of
Release of Liens (Exhibit C), Contractor's Request for Payment of Retainage (Exhibit D), Contractor's
Certificate of Warranty (Exhibit E), Contractor's Certificate of Guarantee (Exhibit F), Certificate of
Completion(Exhibit G), and Certificate of Acceptance(Exhibit H); and,

WHEREAS, Daniels Building and Construction, Inc. of Beaumont, Texas, has submitted the
Certificate of Substantial Completion dated July 17, 2025, and the work to which the Certificate applies
has been inspected, authorized, and declared to be complete in accordance with the contract documents
and made a part hereof as Exhibit A, together with the Contractor's Certificate and Release (Exhibit B),
and the Contractor's Certificate of Debts Paid(Exhibit C); and,
WHEREAS,the retainage for the project is 5% of the work completed and billed,the Release of
Retainage has been submitted by Daniels Building and Construction, Inc. of Beaumont, Texas, for the
amount of$57,826.45, as denoted in Exhibit D; and,
WHEREAS, Daniels Building and Construction, Inc. of Beaumont, Texas, has completed the
contracted project to the satisfaction of the Public Works staff, see Exhibit E; and,
WHEREAS, approval of the acceptance of the Close Out Documents, and Release of Retainage
is herein deemed an appropriate action.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR,TEXAS:
THAT,the facts and opinions in the preamble are true and correct; and,
THAT, the City Council hereby authorizes the City Manager to accept the Certificate of
Substantial Completion(Exhibit A),the Contractor's Affidavit of Payment of Debts and Claims (Exhibit
B),Contractor's Affidavit of Release of Liens(Exhibit C),Contractor's Request for Payment of Retainage
(Exhibit D), Contractor's Certificate of Warranty (Exhibit E), Contractor's Certificate of Guarantee
(Exhibit F),Certificate of Completion(Exhibit G),and execute the Certificate of Acceptance(Exhibit H);
and,
THAT,the City Manager of the City of Port Arthur is hereby authorized to execute on behalf of

7/17/2025. The following items were found to be deficient and must be completed and/or
corrected.
