NO. 24562 — Proposed Resolution Authorizing the Issuance of a Permit to Cirque Entertainment IIII, LLC d.b.a. Paranormal Cirque Introduction: This agenda item seeks the City Council's approval of Proposed Resolution No. 24562, authorizing the issuance of a permit to Cirque Entertainment 1111, LLC d.b.a. Paranormal Cirque to operate under their Big Top Tent at Central Mall, Port Arthur, Texas, from November 28, 2025, through December 1, 2025, in accordance with Chapter 22, Article III, Division 2 of the City of Port Arthur Code of Ordinances. Background: An application has been submitted by Cirque Entertainment IIII, LLC, requesting authorization to conduct a theatrical-style circus performance entitled Paranormal Cirque on a portion of the Central Mall parking lot. The event will be held under a secured Big Top Tent, with setup scheduled for November 26-27, 2025, and performances occurring as follows: • Friday, November 28: 7:30 p.m. • Saturday, November 29: 6:30 p.m. and 9:30 p.m. • Sunday, November 30: 5:30 p.m. and 8:30 p.m. • Monday, December 1: 7:30 p.m. In accordance with Sections 22-91 and 22-92 of the Code of Ordinances, a permit for a circus, carnival, or related performance must be authorized by the City Council prior to issuance. The applicant's submission outlines compliance with public safety, sanitation, and accessibility requirements. "Remember,we are here to serve the Citizens of Port Arthur." Budget Impact: There is no budgetary impact. A RESOLUTION AUTHORIZING THE ISSUANCE OF A PERMIT FOR CIRQUE ENTERTAINMENT 1111, LLC D.B.A. PARANORMAL CIRQUE PURSUANT TO CHAPTER 22, ARTICLE 3, DIVISION 2 OF THE CITY OF PORT ARTHUR CODE OF ORDINANCES. WHEREAS, a permit application has been filed on behalf of Cirque Entertainment IIII, LLC d.b.a. Paranormal Cirque to hold a circus under their Big Top Tent in a portion of the Central Mall parking lot from November 28, 2025, through December 1 , 2025, in the City of Port Arthur, with performances at 7:30 p.m. on Friday, November 28, 2025. 6:30 p.m. and 9:30 p.m. on Saturday, November 29, 2025, 5:30 p.m. and 8:30 p.m. on Sunday, November 30, 2025, and 7:30 p.m. on Monday, December 1, 2025, with setup being on November 26-27, 2025; and, WHEREAS, in accordance with Section 22-91 to 22-92, City Council must authorize the issuance of a permit allowing "any circus, street show, medicine show, carnival, sideshow or any other performance, including shows or exhibits in connection therewith (Exhibit "A"); and, WHEREAS, the Paranormal Cirque will present only human performers and will not include any animals, street shows, medicine shows, carnival, sideshow, or any other performance, including shows or exhibits in connection therewith as described in attachments included as Exhibit "B"; and, WHEREAS, the Paranormal Cirque will not have any games of chance, mechanical rides, any outside vendors, nor will any alcohol be sold or served; and, WHEREAS, the Paranormal Cirque will provide its own dual generator-powered electrical service, necessary locally-rented portable restrooms, including handicapped P.R.NO.24562 10/1412025-PDL PAGE 2 OF 16 accessible units, in-house security service equipped with cell phones to contact medical emergency and local law enforcement, if necessary, and will receive any water service needed from Central Mall; and, WHEREAS, in accordance with Section 22-92, the City Council or any city resident filing a written request may ask for a Public Hearing to be held before considering the issuance of a permit for a "circus, street show, medicine show, carnival, sideshow or any other performance, including shows or exhibits in connection therewith. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: THAT the facts and opinions in the preamble are true and correct. THAT City Council hereby authorizes a permit to be granted to Cirque Entertainment 1111, LLC d.b.a. Paranormal Cirque to perform in Port Arthur at a location in the Central Mall parking lot from November 28, 2025, through December 1, 2025. THAT authorization is subject to the provision of all necessary building codes, permits, and authorizations from the Fire Marshal regarding health and safety. All stake holes are filled following the removal of the tent with either dirt(in the case of dirt or grass locations) or an asphalt cold patch (in the case of asphalt locations) 7. We contact underground alert(if available in your city)to mark underground utilities, before staking. 8. Certificate of insurance,with"additional insured" listings, as you request Cirque Entertainment currently has seven circuses and one car stunt show that are traveling throughout the United States and Canada, and the company is solvent. President Manuel Rebechhi is the sole owner and assumes responsibility for each of the shows, with the main office in Florida and contracting offices in other cities. The show in Port Arthur has no games, no rides, no alcohol, no outside vendors and does not have any animals. It is a Halloween-style circus show that is intended to be fun for the audience. The show is powered by a 250 kW generator and has a back-up generator that will turn on automatically in case the first generator fails. A source of water is usually provided to the circus by the venue on which the circus conducts business. The main tent is round with a diameter of 124 feet. It is flame retardant and a certificate is available to you. The tent has four lighted exits, plus two tunnels that users to the front tent, with five exits available there. All exits are ten feet wide. There are fourteen fire extinguishers total within the two tents, located at the exits and on each of the center poles,which are serviced and inspected on a regular basis. Additional fire extinguishers are located at the generator and inside the ticket booth Paranormal Cirque will have five porta-potties plus one handicapped accessible porta-potty with four hand washing stations. These are serviced on a regular basis. Waste is disposed of via a 30 yard dumpster which is rented in each city. As public safety is a major concern,Paranormal Cirque has six unarmed,in-house security staff on-duty during show hours. (Typically no outside security is needed, nor hired.) They see to it that all city ordinances are consistently observed, as well as assisting with on-site parking and crowd control, as needed. Since the success of the show is partially dependent on the visual elements, security will be dressed in wardrobe fitting the theme of the show. In order to accommodate physically challenged patrons, Paranormal Cirque has implemented the following in accordance with TITLE 24 DISABLED ACCESS: 1. A designated parking area at the closest point of access to the circus. This will be located as close as logistically feasible to the entrance of the circus. 2. A physically challenged drop-off zone at the nearest point possible to the entrance. 3. One handicapped restroom, equipped with handrails and ramps will be available at all times. Paranormal Cirque arrives on site two days before the day of the first scheduled performance. Set-up begins early morning of that day. All inspections are scheduled for opening day around 10:00 A.M. At this time,the circus is set up enough for inspectors, while not yet open to the public, allowing circus personnel to make any needed adjustments as required. At conclusion of appearance, Paranormal Cirque patches all stake holes with cold patch on the bottom and topped off by a hot patch. If you have special concerns that need to be addressed, I would suggest coming out on one of the set-up days and speaking with circus General Manager. This can be easily arranged for you.
