Introduction:
The intent of this Agenda Item is to seek the Port Arthur City Council's ratification of Change Order
No. 2 with SETEX Construction Corp.,(SETEX) of Beaumont,Texas for the concrete lined ditch DD7
upgrades and abatement subcontractor remove and dispose of 400LF of 12" OD Transite pipe for the
amount of$34,930.00, as authorized by the City Manager. Project No. DIUP10.CON. Account No.
307-21-053-8517-00-10-000.
Background:
Recent developments in the Rice Farm Road Drainage Basin have increased flows into the unimproved
Drainage District 7 (DD7) Ditch B2-A, located along the Interurban Right-of-Way (ROW). Pursuant
to Resolution No. 24-318, approved by the Port Arthur City Council,the City Manager was authorized
to enter into an interlocal agreement with Jefferson County Drainage District No. 7 (DD7) for the
construction of a concrete lined channel at the Entergy Interurban Right-of-Way (ROW) along Rice
Farm Road. DD7 has agreed to furnish labor and equipment subject to the requirements of the Texas
Government Code, Sec. 791. DD7 has the knowledge, experience, staff and equipment to construct the
channel within the B2-A ditch, with the City furnishing the design, engineering, materials, and
oversight.

Pursuant to Resolution No. 23-476, approved by Port Arthur's City Council, Soutex Surveyors &
Engineers(Soutex) of Port Arthur, Texas,was selected to provide design, plans, and bid phase services
for the Rice Farm Road Drainage Improvement Project: Phase 1.
The Purchasing Department advertised for competitive qualified bidders on March 22, 2025 and March
29, 2025 under Bid Number P25-039. Bids were opened on Wednesday, April 16, 2025 with five
contractors responding. Eastex Utility Construction, LLC, of Beaumont, Texas; Brystar Contracting,
Inc. of Beaumont, Texas; SETEX Construction Corp. of Beaumont, Texas; MK Constructors of Vidor,
Texas; and APEX Alliance, LLC, of Port Neches, Texas. After review by the Engineering Division,
Soutex, and staff, it was determined that SETEX Construction Corp. of Beaumont,Texas, provided the
lowest responsible bid for the amount of$745,752.00.
Pursuant to Resolution No. 25-196, the City Manager was authorized to enter into an agreement with
SETEX Construction Corp. (SETEX) of Beaumont, Texas, for the construction within the B2-A ditch
that includes lining with concrete, replacing culverts, waterline tie-ins, demolition, lane striping,
installation of a 6" curb in place, and paving to match existing.
SETEX, along with City forces, was tasked with locating a 12" AC Water Main valve in order to shut
off a portion of the pressurized water line so that work could be completed. Shutting off the area proved
problematic as there were no valves in the immediate area. The City, Soutex and SETEX determined
that the best course of action was to install an Insta-Valve at an alternate location that would shut off a
smaller portion of the pressurized water line so that a large area of the surrounding community would
not be without water for a significant and unknown amount of time.
Pursuant to Resolution No.25-406,the Port Arthur City Council and the City Manager approved Change
Order No. 1 for the installation of a 12"Insta-Valve installed on the existing 12"water line by SETEX
Construction Corp., with the work subcontracted by JZ Southern Boyz Services, LLC, for the amount
of $33,162.55, modifying the original contract price of $745,752.00 to the new contract price of
$778,914.55 with no additional calendar days being requested.
Field Change Order No. 2 was issued by Soutex due to the hazardous nature of the asbestos,the original
scope of work must be completed by a license Asbestos Abatement Contractor. The nature and scope
of this abatement as explained in CO-07 proposal letter dated October 27, 2025 justifies the issuance of
an emergency change order.
Upon excavation of the 12" water line, it was discovered that the pipe is made of Transite material,
which requires abatement by a licensed asbestos abatement contractor,which falls outside of the original
scope of work. Based upon field observations by DD7, the drainage district instructed the contractor to
turn the end of the concrete ditch at the tie-in location by 30 degrees and raise the elevation of the of the
top of the ditch by one foot. Change Order No. 2 was submitted by SETEX, attached hereto; Change
Order No. 2 increased the contract by$34,930.00 for a new total contract price of$813,844.55. Due to
the additional work needed, 93 calendar days were requested as explained om CO-07 proposal letter
dated October 27, 2025.

Recommendation:
It is recommended that the City of Port Arthur's City Council approve PR No. 24643 authorizing the
City Manager to execute Change Order No. 2 with SETEX Construction Corp., (SETEX)of Beaumont,
Texas for the excavation of the 12"water line,made of Transite material, which requires abatement by
a licensed asbestos abatement contractor, which falls outside of the original scope of work; and per the
DD7, for the contractor to turn the end of the concrete ditch at the tie-in location by 30 degrees and raise
the elevation of the of the top of the ditch by one foot, line for the amount of$34,930.00 and modifying
the original contract price of$778,914.55 to the new contract price of$813,844.55 with 93 additional
calendar days being requested. Project No. DRIP10.CON. Capital Improvement Account No. 307-21-

CONSTRUCTION CORP. OF BEAUMONT, TEXAS, FOR THE
CONCRETE LINED DITCH DD7 UPGRADES AND ABATEMENT

TRANSITE PIPE FOR THE AMOUNT OF $34,930.00. FUNDS ARE

WHEREAS, recent developments in the Rice Farm Road Drainage Basin have

WHEREAS, the City of Port Arthur, in cooperation with DD7, has identified
essential drainage ditch improvements to the area along Rice Farm Road and DD7 ditch
B2-A; and,
WHEREAS, pursuant to Resolution No. 24-318, approved by the Port Arthur City
Council, the City entered into an Interlocal Agreement in which DD7 will construct a
concrete lined channel along the Entergy Interurban ROW; and,
WHEREAS, DD7 has the knowledge, experience, staff and equipment to construct
the channel with the City furnishing the design, engineering, materials, and oversight;
and,
WHEREAS, pursuant to Resolution No. 23-476, approved by Port Arthur's City
Council, Soutex Surveyors & Engineers of Port Arthur, Texas, was selected to provide
design, plans, and bid phase services for the Rice Farm Road Drainage Improvement
Project: Phase 1; and,

WHEREAS, the Purchasing Department advertised for competitive qualified

responsible bid for the amount of $745,752.00; and,
WHEREAS, pursuant to Resolution No. 25-196, the City Manager was authorized
to enter into an agreement with SETEX Construction Corp. (SETEX) of Beaumont, Texas,
for the construction within the B2-A ditch; and,
WHEREAS, SETEX will construct a portion of the DD7 Ditch B2A that includes
lining with concrete, replacing culverts, waterline tie-ins, demolition, lane striping,
installation of 6" curb in place, and paving to match existing; and,
WHEREAS, during construction, the unknown location of the existing 12-inch AC
water main valve created an unforeseen condition requiring immediate remediation to
avoid service disruption and potential hazards to the public health and safety of the
citizens of Port Arthur; and
WHEREAS, pursuant to Section 252.022(a)(2) of the Texas Local Government
Code, a procurement necessary to preserve or protect the public health or safety of the
municipality's residents is exempt from the requirements of competitive bidding; and

WHEREAS, the City, Soutex and SETEX determined that the best course of action
was to install an Insta-Valve at an alternate location that would shut off a smaller portion
of the pressurized water line so that a large area of the surrounding community would not
be without water for a significant and unknown amount of time; and,
WHEREAS, a Field Change Order No. 1 was issued by Soutex to keep the project
moving that was reviewed, approved, and signed by the City Manager with the
understanding that this change to the original scope of work would be presented to the
Port Arthur City Council, in the form of Change Order No. 1; and,
WHEREAS, pursuant to Resolution No. 25-406, the Port Arthur City Council and
the City Manager approved Change Order No. 1 for the installation of a 12" Insta-Valve
installed on the existing 12" water line by SETEX Construction Corp., with the work
subcontracted by JZ Southern Boyz Services, LLC, for the amount of $33,162.55,
modifying the original contract price of $745,752.00 to the new contract price of

WHEREAS, approval of PR No. 24643 for the Port Arthur City Council to authorize
the City Manager to ratify Change Order No. 2 submitted by SETEX Construction Corp.,
of Beaumont, Texas, for the Rice Farm Road Drainage Improvement Project, is hereby
deemed an appropriate action; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR,
TEXAS:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Council of the City of Port Arthur hereby authorizes the City
Manager to ratify Change Order No. 2 from SETEX Construction Corp., of Beaumont,
Texas, for the amount of $34,930.00, in substantially the same form as attached hereto
as Exhibit A; and,
THAT, Change Order No. 2 modifies the original contract price of $778,914.55 by
$34,930.00 to the new contract price of $813,844.55 with 93 additional calendar days
being requested as explained in CO-07 proposal letter dated October 27, 2025 in
substantially the same form as attached hereto as Exhibit B; and,
THAT, funding is available in the Capital Improvement Account 307-21-053-8517-
I 00-10-000; and,

General Contracting City of Port Arthur Engineering,
Construction Management During excavation activities for the demolition and removal of the existing 12"water line it
was discovered that the pipe is asbestos-containing (Transite) material. Due to the hazardous
nature of the asbestos, the original scope of work to cut, cap, and remove the 12"waterline
Design-Build pipe must be complete by a licensed Asbestos Abatement Contractor. The City of Port Arthur
provided contact information for Honesty Environmental Services, a licensed contractor
qualified to perform the required abatement. Upon review, the scope of abatement work
Job Order Contracting includes the demolition and removal of approximately 400 linear feet of Transite(asbestos)
pipe and the performance of two cuts on the 12"waterline.
Facilities Maintenance
Project Plan:
• Abatement work can only be performed when the 12"waterline is fully isolated by the
Commercial Port Arthur Water Department.
• When Water is isolated Sitek Omni Abatement will perform two cuts to allow Setex to
Industrial install (2) 12" isolation caps to isolate 4001f of water line to be demolished by
Abatement Contractors.
Government
• SETEX will be responsible for the excavation and exposure of the existing asbestos
pipe to allow access for the abatement team.
Healthcare
• Sitek Omni Abatement, under the supervision of a consultant from Honesty
Environmental Services, will perform the asbestos abatement and pipe cutting
Infrastructure operations. Sitek will remove and dispose of approximately 400 LF of 12' OD
transite pipe from the excavated trench. Pipe will be cut into manageable sections
Corporate using NESHAP wet methods or disjointed. Pipe will be properly wrapped and labeled
all asbestos debris generated, be removed from work area, and transported and
disposed of as per federal, state and local regulations to an EPA approved landfill
Education and transport to a licensed landfill as manifested asbestos waste.
Performing Arts • The estimated duration for abatement and removal activities is 10 calendar days,
once the line is isolated.

Add 18"thick concrete wall lip footer on each side of the concrete-lined ditch (22 SY).
Design-Build • Stabilized Sand Subgrade:
Add 4"of 2-sack stabilized sand subgrade within the concrete-lined ditch due to poor
existing subgrade conditions and erosion prior to form-up(60 Tons).
Job Order Contracting • North Wall Extension:
Add 2 linear feet of top wall to make the north wall 10'wide from the ditch bottom,
Facilities Maintenance maintaining a 2:1 slope on the ditch (14 SY).
• Delay and Additional Labor Due to Profile Revision:
Account for 5 calendar days of delay due to ditch bottom profile change after the
Commercial original planned slope was revised. This revision required removal and re-forming
prior to the bottom pour(40 man-hours).
Industrial Total Cost:$7,661.00

General Contracting Subject: Project Delay Due to 12"Waterline Isolation
We are submitting this letter to provide an explanation of the project delays that have
Construction Management accumulated to date on the Rice Farm Road Drainage Improvements. The summary below
outlines the primary causes of the significant delays encountered throughout the course of
this project.
Design-Build Setex Construction was issued a Notice to Proceed on June 23, 2025, with an original
contract duration of 120 calendar days. Upon commencement of the project, it was
Job Order Contracting determined that the existing 12"waterline required additional isolation due to the unknown
location of the isolation valves. Further Progress on the project was dependent upon timely
isolation of the 12"waterline to allow for revisions and demolition beneath Willowood Lane.
Facilities Maintenance The initial request for isolation of the 12"waterline was submitted to the City of Port Arthur
Water Department on July 7, 2025. The Water Department was unable to locate the
necessary valve to shut off the 12" line, which prevented commencement of critical work
Commercial activities associated with the waterline revision.
During this delay period, Setex maintained a field presence and continued performing non-
industrial dependent work items, including tree removal and general site clearing. Coordination efforts
with City personnel continued as multiple attempts to isolate the 12" line remained
unsuccessful. The inability to achieve full isolation of the line caused a significant impact to
Government the project's critical path and overall completion schedule.
Full isolation of the 12"waterline was ultimately achieved on October 21, 2025, following
installation of a new 6" isolation valve. This new valve provided the necessary control to
Healthcare complete the waterline revision work and eliminated the need for future water outages to the
surrounding apartment complexes.
Infrastructure Setex respectfully requests that all delays associated with the 12"waterline isolation be
recognized as non-compensable and non-contractor-related, and that the project completion
date be extended accordingly.

Summary of Delay and Justification
Isolation of the 12"waterline was critical to the execution of several contract work items.
Education While Setex advanced non-dependent tasks, major portions of the project—specifically the
Willowood Lane Box Culvert installation and related work at Jimmy Johnson Boulevard—
were directly dependent on successful isolation of the line.
Performing Arts The Willowood Lane Box Culvert installation required operation of heavy equipment that
could not be mobilized or used safely until the 12"waterline was fully isolated, capped, and

isolation and demolition, followed by installation of the Willowood Box Culvert and
subsequent relocation of large equipment to Jimmy Johnson Boulevard to complete
remaining work.
