REQUEST:
City Council approval is requested to authorize the City Manager to execute Change Order No.
01 to the existing contract between the City of Port Arthur and Mike Barnett Construction of Port
Neches, Texas, for Phase IV repairs to the Pompeiian Villa, extending the contract term by
thirty-six (36) calendar days to a new completion date of December 29, 2025, at no additional
cost to the City.
ANALYSIS/CONSIDERATION:
In June 2025, the City Council approved Resolution No. 25-267, authorizing a contract with
Mike Barnett Construction in the amount of$415,250.00 for Phase IV repairs to the Pompeiian
Villa, a historic landmark owned by the City of Port Arthur.
The project scope encompasses structural, mechanical, and architectural restoration work
necessary to preserve the building's integrity. During project implementation, the contractor
experienced delays in obtaining HVAC mechanical equipment materials, which are essential for
the next phase of the work.
Due to these supply chain delays; the contractor has requested a thirty-six (36) day extension to
the project completion date. The additional time requested will not impact the project's cost or
scope, but will enable the proper completion of the remaining work once the materials are
received.
City staff, including the Engineering Department and the project manager, have reviewed the
request and determined that the time extension is justified and in the best interest of the City to
ensure the project's successful completion.
RECOMMENDATION
It is recommended that the City Council approve the attached Resolution authorizing the City
Manager to execute Change Order No. 01 to the contract with Mike Barnett Construction of Port
Neches, Texas, extending the contract term by thirty-six (36) calendar days to December 29,
2025, at no additional cost.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
CHANGE ORDER NO. 01 TO THE CONTRACT BETWEEN THE CITY
OF PORT ARTHUR AND MIKE BARNETT CONSTRUCTION OF PORT
NECHES, TEXAS, FOR PHASE IV REPAIRS TO THE POMPEIIAN
VILLA, EXTENDING THE CONTRACT TERM BY THIRTY-SIX (36)
DAYS TO A NEW COMPLETION DATE OF DECEMBER 29, 2025, AT
NO ADDITIONAL COST.
WHEREAS, pursuant to Resolution No. 25-267, adopted by the City Council in June
2025, the City entered into a contract with Mike Barnett Construction of Port Neches, Texas, in
the amount of$415,250.00 for Phase IV repairs to the Pompeiian Villa; and
WHEREAS, during the course of construction, the contractor experienced delays in the
delivery and availability of HVAC mechanical equipment materials necessary for the completion
of the project; and
WHEREAS, as a result of these unforeseen delays, Mike Barnett Construction of Port
Neches, Texas, has submitted Change Order No. 01 requesting an extension of the contract time
by thirty-six (36) calendar days, thereby establishing a new completion date of December 29,
2025; and
WHEREAS, the requested time extension will not result in any increase in the original
contract amount; and
WHEREAS, City staff has reviewed and recommends approval of Change Order No. 01
as reasonable and necessary to complete the project in accordance with contract requirements;
and
WHEREAS, the City Council finds it in the best interest of the citizens of the City of
Port Arthur to approve said change order to ensure timely and proper completion of the
restoration of the historic Pompeiian Villa.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. The City Manager is hereby authorized to execute Change Order No. 01 to
the contract between the City of Port Arthur and Mike Barnett Construction of Port Neches,
Texas, for Phase IV repairs to the Pompeiian Villa, extending the contract time by thirty-six (36)

days to a new completion date of December 29, 2025, with no change to the contract amount, in
substantially the same form as attached hereto as Exhibit"A."
Section 3. That a copy of the caption of this Resolution be spread upon the Minutes

Mike Barnett Construction is requesting a Non compensatory contract extension for substantial completion
date to Dec 29th,2025,for the project known as"Foundation Leveling and MEP upgrades for Pompeian Villa-
Phase IV"based upon the following circumstances that are beyond our control.
We have experienced unforeseen delays due to HVAC Mechanical equipment materials availability due to
materials backorder We have listed below the items we are referencing for record.
I. The mechanical contractor received an updated notice that the 3 mechanical units will not be available
in Dallas for further distribution until the estimated ETA date of 11/5/25.Based upon the listed ETA,
the materials will not depart from Dallas to Beaumont and arrive until the week of 11/10 and be
available for access to the mechanical contractor until sometime that same week.
Therefore,our installation will begin on 11/17/2025 at the earliest.Once our installation begins,we will
need additional 36 days—(which includes 2 national holidays)to complete all the HVAC installation
and then complete all other additional trades that are attached to the installation and are pending
completion.
We are attaching a copy of the communication from the Supplier and an updated schedule for the completion
of the project.
With all these listed delays and the allowances for shipping delays.We are requesting this revised substantial
completion and contract extension.
We appreciate your consideration and understanding regarding this matter.
